Article 2 These Measures shall apply to drainage and recycled water planning, construction, operation, use, protection and related management activities of drainage and recycled water facilities within the administrative area of ??this city. Article 3 The municipal and district (county) water administrative departments shall organize the preparation of drainage and reclaimed water planning and construction plans in their respective administrative areas and organize their implementation, and shall be responsible for the supervision and management of drainage and reclaimed water.
Departments of development and reform, environmental protection, planning, housing and urban-rural construction, municipal city appearance, landscaping, transportation and other departments should do a good job in drainage and recycled water-related work in accordance with their respective responsibilities. Article 4 Drainage and reclaimed water facility operators shall perform maintenance and management responsibilities in accordance with the law, ensure the safe and normal operation of facilities, and handle drainage and reclaimed water emergencies in a timely manner.
The operating unit of drainage and reclaimed water facilities may entrust the operating unit to undertake specific maintenance matters, and the entrustment shall sign a written agreement.
The operating units of drainage and recycled water facilities have the right to understand users’ use of drainage and recycled water facilities, stop damage to drainage and recycled water facilities, and have the right to receive compensation in accordance with the law. Article 5 This Municipality encourages and supports scientific research and technological development on drainage and recycled water, accelerates the transformation and industrialization of technological achievements, introduces and promotes new technologies, new processes, and new materials, and improves the reuse and resource utilization of sewage and sludge. Chapter 2 Planning and Construction Article 6 The city's drainage and reclaimed water plan and the central city's drainage and reclaimed water plan shall be organized and compiled by the municipal water administrative department. After review by the municipal planning administrative department, they shall be reported to the Municipal People's Government for approval and implementation. District (county) drainage and recycled water plans for areas outside the central city shall be organized and compiled by the district (county) water administrative department. After being reviewed by the municipal water administrative department in conjunction with the planning administrative department, they shall be reported to the district (county) people's government for approval and implementation. . The drainage and reclaimed water planning of central cities and districts (counties) should comply with the city's drainage and reclaimed water plan.
Drainage and reclaimed water planning should include current situation analysis, drainage volume prediction, drainage mode, sewage treatment principles, facility layout and scale, reclaimed water utilization goals, sludge disposal and resource utilization, etc.
Drainage and recycled water planning should be coordinated with national economic and social development plans, as well as overall land use planning, urban overall planning, environmental protection planning, water resources planning and flood control planning. Article 7 The municipal and district (county) water administrative departments shall organize the formulation of construction plans for drainage and reclaimed water facilities based on drainage and reclaimed water planning and regional development needs. Article 8 Urban areas should make unified planning and construction of public drainage and recycled water facilities, so as to separate rainwater and sewage, support factory networks, give priority to pipe networks, and coordinate with road construction. Pipe network construction should ensure systematicity.
Rural areas should build drainage and recycled water facilities based on actual conditions and local conditions. Article 9: If the utilization and protection of public drainage facilities are involved in new construction, reconstruction, or expansion construction projects, the planning administrative department shall notify the water administrative department to participate in the review when reviewing the project planning and design. Article 10 The construction funds for special drainage and recycled water facilities shall be included in the total investment of the construction project, and the construction unit shall organize the construction in accordance with the requirements of the project construction plan, and shall be designed, constructed, inspected and put into use at the same time as the main project.
In areas outside the coverage area of ??the public drainage pipe network, if new construction, reconstruction, or expansion construction projects meet the scale requirements, the construction unit shall construct sewage treatment and recycled water facilities in accordance with relevant regulations. Article 11 After completion acceptance and filing of public drainage facilities, the construction unit shall hand over the facilities to the operating unit determined by the water administrative department. The operating unit shall accept it and assume the responsibility for the operation, maintenance and safety management of the facilities.
Both parties to the transfer shall jointly inspect the transferred facilities, sign a transfer agreement, and handle the transfer procedures for facility files. The handover agreement should include, among other things, the results of facility inspections.
Chapter 3 Operation and Maintenance Article 12 The operating unit of public drainage and recycled water facilities in urban areas shall be determined by the water administrative department in conjunction with relevant departments.
The owner of the dedicated drainage and reclaimed water facilities is responsible for the operation and maintenance and bears the corresponding funds. Among them, if property management is implemented in a residential area, the owner or the property service company entrusted by him shall be responsible; if there is a residential management unit, the residential management unit shall be responsible.
Public drainage and reclaimed water facilities in towns (townships) and villages are operated and maintained by the people's governments of the towns (townships) where they are located; auxiliary drainage facilities within the scope of highways are operated and maintained by the transportation department.
