The transportation departments of local people's governments at or above the county level shall be responsible for organizing and leading the management of road dangerous goods transportation within their respective administrative areas.
Industry and information technology, public security, ecological environment, emergency management, market supervision and management departments shall, in accordance with their respective responsibilities, be responsible for the supervision and inspection of activities related to road transport of dangerous goods. Article 5 The State shall establish a platform for sharing information on the supervision of dangerous chemicals and strengthen the safety management of road transport of dangerous goods. Article 6 Dangerous goods prohibited by laws and administrative regulations shall not be consigned or transported. Article 7 Shippers, carriers and shippers shall formulate inspection and recording systems for road dangerous goods transportation, as well as safety production management systems such as personnel safety education and training, equipment management and post operation procedures.
The shipper, the carrier and the shipper shall, in accordance with the requirements of relevant laws and regulations and the Rules for the Transport of Dangerous Goods on Roads (JT/T 6 17), conduct pre-job safety education and training and regular safety education for relevant employees of the unit. Personnel who have not passed the pre-job safety education, training and assessment shall not be allowed to work at their posts.
The shipper, the carrier and the shipper shall properly keep records of safety education, training and assessment. Records of pre-job safety education, training and assessment shall be kept until 12 months after relevant employees leave their jobs; The storage period of regular safety education records shall not be less than 12 months. Article 8 The State encourages road transport enterprises of dangerous goods to adopt advanced technology and equipment and carry out specialized and intensive operations.
It is forbidden to operate dangerous goods transport vehicles. Chapter II Consignment of Dangerous Goods Article 9 The shipper of dangerous goods shall entrust an enterprise with corresponding road transport qualifications to transport dangerous goods. When consigning explosives, fireworks and firecrackers for civilian use, it shall entrust an enterprise with the transportation qualification of Class I explosives or the corresponding articles in Class I explosives. Article 10 The shipper shall determine the category, item, name and number of dangerous goods in accordance with the Rules for the Transport of Dangerous Goods by Road (JT/T 6 17) and abide by the relevant special provisions. Where inhibitors or stabilizers need to be added, the shipper shall add them in accordance with the regulations and inform the carrier of the relevant information. Article 11 The shipper shall not carry dangerous goods in the consigned ordinary goods, and shall not conceal or falsely report dangerous goods as consigned ordinary goods. Article 12 The shipper shall properly package the dangerous goods in accordance with the Rules for the Transport of Dangerous Goods by Road (JT/T 6 17), and set corresponding dangerous goods signs on the outer packaging. Article 13 When consigning dangerous goods, the shipper shall submit the electronic or paper consignment list of dangerous goods to the carrier.
The consignment list of dangerous goods shall include information such as shipper, carrier, consignee, consignor, origin, destination, category, item, name, quantity, packaging specifications, quantity, emergency contact telephone number, and information such as dangerous characteristics of dangerous goods, transportation precautions, first aid measures, fire control measures, leakage emergency treatment measures and secondary environmental pollution treatment measures.
The shipper shall properly keep the consignment note of dangerous goods for a period of not less than 12 months. Article 14 The shipper shall keep the emergency telephone open during the transportation of dangerous goods. Article 15 When consigning highly toxic chemicals, civil explosives, fireworks or radioactive materials, the shipper shall provide the carrier with a road transport permit for highly toxic chemicals, a road transport permit for civil explosives, a road transport permit for fireworks and firecrackers, and a road transport permit certificate or document for radioactive materials issued by the public security organ.
When consigning radioactive materials of Class I, the shipper shall provide the carrier with the nuclear and radiation safety analysis report of radioactive materials transportation approved by the nuclear safety supervision department of the State Council.
When consigning hazardous waste (including medical waste, the same below), the shipper shall provide the carrier with an electronic or paper form of hazardous waste transfer form issued by the competent department of ecological environment. Chapter III Special Provisions on the Transport of Exceptional and Limited Dangerous Goods Article 16 The packaging, marking and packaging test of exceptional dangerous goods, as well as the maximum quantity of dangerous goods that can be transported by each inner container and outer container, shall meet the requirements of the Rules for the Transport of Dangerous Goods by Road (JT/T 6 17). Article 17 The packaging and signs of limited dangerous goods, as well as the maximum quantity and total mass (including packaging) contained in each inner container or article, shall meet the requirements of the Rules for the Transport of Dangerous Goods on Roads (JT/T 6 17). Article 18 When consigning a large quantity of dangerous goods, the shipper shall declare in writing to the carrier that the dangerous goods meet the packaging requirements of the Rules for the Transport of Dangerous Goods by Road (JT/T 6 17). The carrier shall require the driver to carry a written statement with the vehicle.
The shipper shall indicate the exceptional quantity and number of pieces of dangerous goods in the consignment list.
