Decision of the Nanjing Municipal People's Government on Amending and Abolishing Some Government Regulations

I. To make the following amendments to the following government regulations (25 pieces):

(1) To make amendments to the Measures for the Administration of Statistics in Nanjing (Decree No. 164)

1. To delete in Articles 3, 4, 5 (1), 22 (1), 23 (1), 26 (1), and 28 the words " , County".

2. Delete Article 6, Chapter 4 (Articles 18 to 21), Article 30 (3), Article 31 (2), Article 34 (2), Article 35 (2) (2) and (5), Article 39, Article 40, Article 41 and Article 42.

3. Article 10 shall be amended to read: "Statistical surveys in the city shall be formulated by the competent department for statistical administration of the people's government of the city or district and the relevant departments separately or *** together. If the department in charge of statistical administration of the municipal or district people's government formulates them separately or **** with the department concerned, it shall be reported to the department in charge of statistical administration of the people's government at the provincial level for approval; if the department concerned of the municipal or district people's government formulates them separately or **** with other departments, it shall be reported to the department in charge of statistical administration of the people's government at the same level for approval." .

4. Article 43 shall be amended to read: "Where the circumstances of the violation of the law by the party concerned are serious or the means are bad, or the offense is repeated, the punishment shall be heavier; where the circumstances are less serious, the punishment may be mitigated as appropriate, provided that the amount of the fine imposed shall not be less than the minimum of the next grade." .

In addition, the order of the articles is adjusted accordingly.

(2) Amendments to Nanjing Funeral Management Measures (Decree No. 185)

1. Amend "county" to "district" in Article 3, paragraph 2, and Article 19, items (1) and (2).

Deleting ", county" in Article 19 (3).

2. Add a paragraph to Article 8 as paragraph 2: "Eligible residents of the city shall be exempted from the fees for basic funeral services such as receiving and transporting of human remains, handling, refrigeration, make-up, cremation, and public welfare depository, and the related costs shall be borne by the municipal and district finances." .

3. Article 12 shall be amended to read: "Where the remains of a person who died an unnatural death need to be temporarily preserved, they shall be stored in a funeral parlor with embalming equipment. The period of storage shall not exceed three months, except when the preservation is extended by a decision of the public security authorities; if the remains are not disposed of after that time, the funeral management organization, with the assistance of the public security authorities, may dispose of the remains in accordance with the law. The required expenses shall be paid by the responsible person, and if the responsible person is not clear or there is no responsible person, it shall be paid by the local financial department.

The unnamed body is notified by the local public security organs to receive the funeral parlor. After the public security organs make an identification and go through the cremation procedures, the body will be cremated by the funeral parlor, and the required expenses will be paid by the local financial department." .

4. Add a paragraph to Article 13 as paragraph 2: "The city encourages land-saving burial styles, and for residents who take river burial, tree burial, flower burial, lawn burial and deep burial and other ways of interring cremated ashes that do not retain permanent markers, subsidies shall be given by the financial department in accordance with the relevant provisions of the Beneficial Burial." .

5. Article 15 shall be amended to read: "If the ashes are buried in cemeteries or pagodas, one can purchase a grave or a pagoda space with the cremation certificate issued by the funeral parlor. Operating cemeteries shall not exceed 1 square meters of land area of double holes, single holes shall not exceed 0.7 square meters. If the deceased belongs to overseas Chinese, Hong Kong, Macao, Taiwan, or celebrities, the need to increase the area of the grave shall be reported to the funeral management institution for approval, but shall not exceed 5 square meters. The period of use of the graves in the operational cemetery and the tower space in the tower mausoleum shall not exceed 20 years in general, and the one-time collection of the management fee shall not exceed 20 years at the longest. If a grave (tower space) is requested to continue to be used after the expiration of its useful life, it shall go through the renewal procedures and pay the usage fee in accordance with the relevant regulations." .

Add a paragraph as the second paragraph: "The original provisions shall apply to the term of use of the graves (pylons) in the operating cremation cemeteries before the implementation of the provisions of the preceding paragraph." .

6. Article 18 is amended to read: "The construction of new funeral halls, cemeteries, columbariums, towers and other funeral facilities shall be in accordance with the principle of facilitating funeral reform and the convenience of the public, and in line with the city's special plan for the construction of funeral facilities, as well as other conditions stipulated by laws and regulations, and the relevant land use, construction and other relevant formalities shall be carried out in accordance with the law. " .

7. Article 22 was amended to read: "Rural public welfare cemeteries can only be used for the burial of the town (street), the village or by the district civil affairs department unified designation of neighboring towns without public cemeteries (street), the village of the ashes of the dead. Rural public welfare cemetery by the town people's government (street office) is responsible for the construction and management.

No rural public welfare cemetery shall be used to engage in cemetery business activities, do not meet the conditions of acquisition in violation of the provisions of the acquisition of public welfare cemetery graves are not protected by law." .

8. Article 23 to add a paragraph as paragraph 2: "Funeral parlors shall strictly implement the basic funeral service prices government pricing." .

Add one paragraph as the third paragraph: "Sales of operational cemeteries shall be labeled with the name and number of the grave type, the material and specifications of the main material, the charges for the burial fee, the contents of the grave care and management services and the charges, and sales of funeral goods shall be labeled with the name and price of the goods." .
