Centralized Bidding and Procurement Catalog and Procurement Methods

Article 25 The bidder implements centralized bidding and procurement of the following medicines:

(1) medicines in the basic medical insurance medicine catalog;

(2) medicines that are commonly used in clinical practice and have a large procurement volume;

(3) other medicines identified by the administrative department of health or the bidder to be subject to centralized bidding and procurement. Other drugs.

Article 26 Provinces, autonomous regions and municipalities directly under the Central Health Administration is responsible for the preparation of the centralized bidding and purchasing catalog of medicines for medical institutions in the administrative region. Article 27 The inclusion of centralized bidding and procurement catalog of drugs, the bidder shall not purchase on its own. Article 28 No centralized bidding and procurement shall be carried out for narcotic drugs, psychotropic drugs, toxic drugs for medical use and radiopharmaceuticals for which the state implements special management. For the time being, centralized bidding and procurement of Chinese herbal medicines and Chinese medicinal herbs is not implemented. Each region shall establish a public procurement system to regulate the procurement of Chinese herbal medicines and Chinese medicinal tablets.

Article 29 The methods of bidding for procurement include open bidding for procurement and inviting bidding for procurement. Open bidding procurement is mainly applicable to varieties that are commonly used in clinical practice, purchased in large batches or amounts, and capable of creating sufficient competition.

Open bidding refers to the procurement method in which the bidder invites bids from unspecified suppliers of medicines by means of a bidding notice.

Invitation to tender refers to the procurement method in which the bidder invites specific suppliers of medicines to tender by means of an invitation to tender.

Article 30 The centralized bidding and procurement of medicines is based on open bidding. No invitation to bidding for procurement or centralized bargaining for procurement shall be allowed for medicines that can be sold through open bidding. For the procurement of smaller subject matter, fewer potential bidders or need to be completed within a shorter period of time, the procurement project can be invited bidding procurement. Article 31 After two to three rounds of public bidding for medicines in the same procurement catalog, centralized bidding and procurement may be continued, or other centralized procurement methods may be independently selected by the bidders.

Article 32 For the varieties that have been included in the centralized bidding and procurement catalog but cannot be sold through both centralized bidding and centralized bargaining, the bidders may purchase them on their own.
