Measures of Shanghai Municipality on the Safe Use of Underground Space (revised 20 16)

Article 1 (Purpose)

In order to strengthen the management of the safe use of underground space in this Municipality, improve the overall protection and safety management level of this Municipality, and ensure the safety of people's lives and property, these Measures are formulated in accordance with the provisions of relevant state laws and regulations and with the actual situation of this Municipality. Article 2 (Scope of Application)

These Measures shall apply to the safe use and management activities of underground spaces that are open to the public as places of production and business operation and other underground spaces that are places of public activities within the administrative area of this Municipality. Article 3 (Meaning of Related Terms)

The underground space mentioned in these Measures includes civil defense works, ordinary basements and underground rail transit stations. Among them, civil air defense projects only refer to civil air defense projects, including underground protective buildings, air defense command, medical rescue and so on, which are built separately to protect personnel and materials in wartime. And basements that can be used for air defense in wartime and built in combination with ground buildings; Ordinary basement refers to the underground building that is built in combination with the ground building or built separately and does not meet the protection standards of civil air defense projects; The underground station of rail transit refers to the entrance, passage, station hall floor and platform floor of rail transit below the ground. Article 4 (Administrative Department)

The municipal construction administrative department is the comprehensive coordination department for the safe use and management of underground space in this Municipality, responsible for organizing the implementation of these measures, coordinating and urging other relevant administrative departments to perform their safety supervision duties.

The district and county people's governments shall determine a department responsible for the comprehensive coordination of the safe use and management of underground space within their respective districts and counties, coordinate and urge other relevant administrative departments to perform their duties of safety supervision, and accept the guidance of the municipal construction administrative department in business.

Civil defense, transportation, public security, fire protection, water affairs, land and resources planning, health, environmental protection, safety supervision, quality and technical supervision and other departments of this Municipality are responsible for the supervision and management of the safe use of underground space within their respective functions and duties, and cooperate in the implementation of these measures.

Sub-district offices and township and town people's governments shall assist the relevant administrative departments to supervise and manage the safe use of underground space within their respective administrative areas. Article 5 (Joint Meeting System)

The Municipal People's Government shall establish a joint meeting system for underground space management. The joint meeting is responsible for establishing and improving the working mechanism for the safe use and management of underground space, and researching, coordinating and promoting the safe use and management of underground space. The office of the joint meeting is located in the municipal administrative department of construction, and is responsible for the organization of the joint meeting of underground space management. Article 6 (Obligations of Owners of Underground Space)

The property owner of underground space (hereinafter referred to as the property owner) shall perform the following obligations for safe use:

(1) If there are hidden dangers in underground space, it shall promptly organize rectification to eliminate the hidden dangers;

(two) in the event of an accident in the safe use of underground space, it shall assist the relevant administrative departments in the investigation and handling;

(three) to comply with the provisions of the state and other relevant provisions of this Municipality on the safe use of underground space. Article 7 (Obligations of Underground Space Property Management Unit)

The underground space property management unit entrusted by the property owner (hereinafter referred to as the property management unit) shall perform the following obligations for safe use:

(a) responsible for the implementation of the provisions of the state and the city on the safe use of underground space;

(two) in conjunction with the property owners, underground space users in accordance with the underground space emergency plan to develop underground space emergency disposal procedures;

(three) check the safe use of underground space, found hidden dangers, should promptly organize rectification and elimination;

(four) to accept the safety inspection of the city or district, county underground space safety use management comprehensive coordination department and other relevant administrative departments, and eliminate the hidden dangers found in the inspection in time;

(5) When an accident occurs in the safe use of underground space, rescue measures shall be taken in time, and timely report to the comprehensive coordination department for the safe use and management of underground space in the city, district or county or other relevant administrative departments and property owners to assist in the investigation and handling;

(six) to comply with the provisions of the state and other relevant provisions of this Municipality on the safe use of underground space.

If the property owner fails to entrust the property management unit to manage the underground space, the property management unit's obligation of safe use shall be fulfilled by the property owner. Article 8 (Obligations of Underground Space Users)

Users of underground space (hereinafter referred to as users) shall fulfill the following obligations for safe use:

(a) shall not damage the safety facilities and equipment of underground space;

(two) to accept the safety inspection of the city or district, county underground space safety use management comprehensive coordination department and other relevant administrative departments, and eliminate the safety hazards found in the inspection within the specified time;

(3) If the user sublets the underground space, he shall inform the property management unit of the sublease within 5 days after the sublease, in addition to complying with the relevant contract;

(4) When an emergency occurs in underground space, it shall promptly report to the comprehensive coordination department for the safe use and management of underground space in the city or district or county or other relevant administrative departments, and handle it in accordance with the regulations on emergency handling;

(five) to comply with the provisions of the state and other relevant provisions of this Municipality on the safe use of underground space.
