Robbery, in general, is punishable by three to ten years of imprisonment and a fine; if the circumstances are particularly serious, it is punishable by ten years of imprisonment, life imprisonment or death, and a fine or confiscation of property.
Theft, in general, shall be sentenced to less than three years of imprisonment, detention or control, and or a single fine; the amount of huge or other serious circumstances, shall be sentenced to more than three years than ten years of imprisonment, and a fine; the amount of particularly large or other particularly serious circumstances, shall be sentenced to more than ten years of imprisonment or life imprisonment, and a fine or confiscation of property.
Fraud of public or private property, the amount of larger, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or control, and or a single fine; the amount of huge or other serious circumstances, shall be sentenced to fixed-term imprisonment of not less than three years and not more than ten years, and shall be punished by a fine; the amount of particularly large or other particularly serious circumstances, shall be sentenced to fixed-term imprisonment of more than ten years or life imprisonment, and shall be punished by a fine or confiscation of property.
Extortion and blackmail of public or private property, the amount of larger or repeated extortion, shall be sentenced to fixed-term imprisonment of not more than three years, detention or control, and a fine or a single fine; the amount of huge or other serious circumstances, shall be sentenced to fixed-term imprisonment of not less than three years and not more than ten years, and a fine; the amount of particularly huge or other particularly serious circumstances, shall be sentenced to fixed-term imprisonment of not less than ten years, and a fine.
Article 263 of the Criminal Law stipulates that anyone who robs public or private property by violence, coercion or other methods shall be sentenced to fixed-term imprisonment of not less than three years and not more than ten years and shall be punished by a fine; if one of the following circumstances exists, he shall be sentenced to fixed-term imprisonment of not less than ten years, life imprisonment or death penalty and shall be punished by a fine or confiscation of property:
(1) home invasion robbery;
(2) robbery in a public **** transportation;
(iii) robbery of banks or other financial institutions;
(iv) repeated robbery or robbery of a huge amount;
(v) robbery resulting in serious bodily injury or death;
(vi) posing as a member of the uniformed services robbery;
(vii) armed robbery;
(viii) robbery of military goods or rescue, disaster relief and relief materials.
Article 265 of the Criminal Law stipulates: Anyone who, for the purpose of profit-making, steals or connects another person's communication line, copies another person's telecommunication code number, or uses telecommunication equipment or facilities that he/she knows to be stolen or copied, shall be convicted and punished in accordance with the provisions of Article 264 of this Law.
Article 266 of the Criminal Law stipulates: If the amount of fraudulent public or private property is relatively large, the person shall be sentenced to fixed-term imprisonment of not more than three years, detention or control, and a fine or a single fine; if the amount is huge or there are other serious circumstances, the person shall be sentenced to fixed-term imprisonment of not less than three years and not more than ten years, and a fine; if the amount is particularly huge or there are other particularly serious circumstances, the person shall be sentenced to fixed-term imprisonment of not less than ten years or life imprisonment, and a fine or confiscation of property. Article 274 of the Criminal Law stipulates that anyone who extorts public or private property in a relatively large amount or repeatedly does so shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or control, and shall be punished by a fine or a single fine; if the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years and not more than ten years and shall be punished by a fine; if the amount is particularly huge or there are other particularly serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than ten years and shall be punished by a fine. imprisonment and a fine.
