In order to strengthen the management of temporary construction waste in urban areas, the implementation of the local government and departmental supervision responsibility, to prevent construction waste piling and dumping, dust pollution and other illegal acts, to maintain urban appearance and environmental health, protect and improve the ecological environment, and specially formulated the provisions of this regulation.
I. Scope of application
The provisions of this regulation applies to the Tongzhou District, Nantong City, Chongchuan District, Gangzha District, Economic and Technological Development Zone administrative area.
Temporary dumps of construction waste mainly includes temporary dumps of engineering residue, centralized collection and transportation of renovation waste, temporary dumps of renovation waste.
Two, set the principle
(a) integrated set. Comprehensive consideration of the amount of generation, collection (transfer) and transportation capacity and transportation distance, disposal methods, environmental impact, the public will and other factors, scientific selection of points, appropriate scale, appropriate number of settings, and strive to set up the number of basic match with the actual needs.
(ii) strict control. Strictly abide by the relevant national, provincial and municipal laws and regulations, in accordance with the specified requirements for the approval of the management, after review and approval before setting up. Prohibit the unauthorized setting of construction waste temporary dumps. Effectively strengthen the day-to-day supervision of illegal dumping sites, in accordance with the law, strict investigation of illegal setup, irregular setup, safety and environmental protection management is not in place and other prominent issues, to ensure that the construction waste temporary dumps set up standardized, in place of the management.
(C) safe operation. Temporary construction waste dump set up to follow the "safety first" principle, in strict accordance with the laws, regulations, the provisions of the safety management requirements, set up and management. Construction and operation of the main unit must develop safety, environmental protection accident disposal plan, clear site management safety and environmental protection responsibilities, the implementation of safety and environmental protection management measures, the regular organization of safety and environmental protection risk investigation and rectification, to prevent the occurrence of safety accidents and environmental pollution.
Three, set up regulations
(a) engineering residue temporary dump
1. shall not be set up for the purpose of profit engineering residue temporary dump.
2. Shall be set up in the red line of the property rights unit.
3. In accordance with the requirements of the legal provisions of the land lease and other relevant procedures to ensure that the land is legal, and clear responsibility for the management of the land.
4. The sanitary protection distance should be ≥500 meters, and there are no residential districts, schools, hospitals, commercial complexes, recreational facilities for the public and other places of public leisure and living within the sanitary protection distance. It is strictly prohibited to set up within 1000 meters of the riverbank line, 50 meters outside the scope of the ecological red line of the river, and within the scope of the provisions of the high-voltage corridor.
5. Fire safety, information technology supervision, vehicle washing, dust suppression and reduction of dust, noise reduction and other necessary facilities should be set up, according to the need to set up classification and sorting, crushing and other pre-processing facilities.
6. Must be set up to close the fence (fence), the field access roads and sorting and stacking sites should be hardened, set up a fixed vehicle washing equipment at the entrance and exit, the installation of video monitoring system and realize the city urban management supervision and command center and the district urban management bureau monitoring platform real-time networking, in accordance with the requirements of the standard set up a rainwater and sewage diversion system, set up online monitoring system and access to the municipal dust regulatory system, and set up a warning system in a prominent position. In addition, it has set up warning signs and place management system public notice boards in conspicuous positions.
(B) renovation waste centralized collection and transportation points
1. By the local street according to the actual situation set up separately or jointly set up by neighboring streets.
2. Set a height of not less than 2.0 meters closed rigid fence and set up a switchable gate, entrances and exits and access should be hardened, and set up washing facilities. Inside and outside the site in accordance with the specification requirements for lighting, dust control, cleaning and fire safety facilities and equipment, and encourage the installation of video surveillance equipment, the stacking place to implement 24-hour management. Street renovation waste centralized collection and transportation sites are suitable for the appropriate location to set up removable dust cover facilities.
3. The interior should be set up to classify the dumping site, respectively, with marking lines on "recyclable", "other garbage", "green waste", "Hazardous waste" are distinguished. The markings are uniformly black on a yellow background, and the lines are uniformly solid yellow.
4. Decoration waste collection and transportation of centralized places should be set up in a conspicuous position in the "centralized collection and transportation of decorative waste" signage, set up a management signboard, write the management unit and the person responsible for the collection and transportation of the place of opening and clearing time, supervision and reporting telephone content.
(C) decorative garbage temporary dump
1. No property management of the old residential neighborhoods, if appropriate points, can be set up after a comprehensive evaluation.
2. Residential neighborhoods managed by property companies must set up temporary storage sites for renovation waste.
3. Renovation waste temporary storage space area ≥ 50 square meters, set a height of not less than 2 meters closed rigid enclosure and set up a switchable gate, entrances and exits and access should be hardened, set up lighting, firefighting equipment, and conditions can be set up to wash the equipment and removable dust control devices.
4. Renovation of the temporary storage of garbage should be set up in the three-format classification of storage tanks, and set up "available construction waste, combustible garbage, other garbage," and other obvious signs, to facilitate the residents to dump.
5. Renovation of the temporary storage of garbage should be set up in a conspicuous position in the "temporary storage of renovation waste" signage, indicating the opening hours, supervision and reporting telephone number and other content, and to arrange for the management of the person.
Four, approval management
(a) the applicant to apply for construction waste temporary dump in accordance with the "construction waste disposal site set up" approval process, the applicant (set up by the unit) to the district urban management department to apply.
1. Setting up a temporary construction waste landfill applications need to provide proof of land use (including proof of land ownership, land certificates, leases, etc.), the management of the plot of responsibility, the opinion of the local street office, the plot of planning plans, the place to set up and classification of disposal programs related materials.
2. Setting up temporary dumps of construction debris, by the regional urban management department is responsible for planning, environmental protection, safety supervision and other departments to jointly carry out the approval and management; set up a centralized collection and transportation of renovation waste, decoration waste temporary dumps by the regional urban management department for direct approval.
3. District urban management department received the application materials, should be carried out in a timely manner on-site investigation, for the application of temporary dumping site of construction debris can be submitted to the City Urban Management Bureau of joint site investigation.
(2) by the site investigation, construction waste temporary dumps meet the provisions of the setup, the district urban management department should be within 10 days for the relevant approval procedures, reported to the municipal urban management comprehensive law enforcement detachment for the record. Not in line with the provisions of the setup, to inform the reasons in writing.
Management of the main body of the unit needs to continue to use, should be in the validity of the expiration date of thirty days prior to the jurisdiction of the urban management department to apply for an extension.
(C) the withdrawal of the centralized collection and transportation of street renovation waste places, should be applied in advance to the district urban management department, in the completion of the site cleanup and acceptance by the district urban management department to be withdrawn.
Five, related requirements
(a) the establishment of construction waste removal security system. Engineering residue temporary dump set up units must sign an agreement with the parcel of land to provide units, in a suitable way to ensure that the temporary dump after the expiration of the use of completely cleaned up, and reported to the jurisdiction of the urban management department for the record.
(ii) clear time limit for removal. In principle, the district's temporary storage of renovation waste should be produced on a daily basis, the longest not more than 1 week. Renovation waste centralized collection points that are full that is clear, the temporary storage of engineering debris time not exceeding 6 months.
(C) strictly regulate the management. In accordance with the requirements of the construction waste classification and disposal program, the yard should be clear classification standards, stacking requirements and disposal specifications. Construction waste stacked more than 3 meters high must be assessed for safety to ensure safe operation. It is strictly prohibited to pile up toxic and hazardous, domestic garbage and construction waste in a mixed pile, and at the same time do a good job of dust prevention, seepage prevention, pollution prevention and other measures to eliminate the occurrence of pollution of the surrounding environment.
(D) improve management responsibility. Temporary construction waste dumps by the setting unit is responsible for the unified management, the district urban management department is responsible for supervision. Construction waste temporary dumps set the expiration of the period, set the unit must be the field of construction waste piled up cleaned up, site leveling, by the district urban management department on-site acceptance, by the plot of land to provide units for follow-up management. If the setup unit fails to clean up in time after the expiration date, the unit providing the land plot will be responsible for the removal.
(E) Strengthen transportation management. The vehicles engaged in the disposal of construction waste in the temporary construction waste dump must be the transportation vehicles belonging to the transportation enterprises that have obtained the "Nantong Urban Construction Waste Disposal (Transportation) Permit" issued by the Municipal Urban Affairs Bureau. At the same time should apply for construction waste discharge permit before disposal activities. Construction waste shall not be given to individuals or unauthorized transport enterprises for transportation.
(F) Outlawing illegal dumping sites. All unauthorized temporary dumps of construction waste must be cleaned up and remedied by the end of December 2019 in accordance with the relevant requirements of the environmental protection of the Yangtze River Economic Belt and solid waste cleanup.
