According to the relevant provisions of the Interim Regulations on the Granting and Transfer of the Right to Use State-owned Land in Cities and Towns, the maximum term of the right to use land is determined according to the following uses:
(1) 70 years for residential land.
(2) 50 years for industrial land.
(3) 50 years for land used for education, science and technology, culture, health and sports.
(4) 40 years for commercial, tourism and entertainment land.
(5) Comprehensive or other land use for 50 years.
When the term of land use right expires, the land user may apply for renewal. If renewal is required, a new contract shall be signed, the land use right premium paid and registration made in accordance with the regulations.
According to the relevant content of the "Shanghai Urban Planning and Management Technical Regulations (Land Use, Building Management)", the construction land in Shanghai, according to its main purpose and the basic principles of functional zoning, with reference to the "Urban Land Use Classification and Planning and Construction Land Use Standards" (GBJl37-90) is categorized as follows:
(1) Residential land (R). It refers to various types of piece or sporadic land such as residential neighborhood, residential neighborhood, residential group and unit living area. Residential land includes residential land, land for public ****service facilities below the level of residential neighborhoods and subdistricts, road land and green space.
①The first type of residential land (R1) refers to land with mainly low-rise residences, low building density, high green space rate and good environment;
②The second type of residential land (R2), refers to land with mainly multi-storey residences;
③The third type of residential land (R3), refers to land with mainly high-rise residences.
(2) Land for public **** facilities (c). Refers to residential areas and residential areas above the level of administrative, economic, cultural, educational, health, sports and scientific research and design and other institutions and facilities of the land, excluding residential land in the public **** service facilities land, mainly:
① Administrative office land (c1), refers to the land of the administrative organs, parties and social organizations and other institutions;
② commercial and financial industry land (C2). Refers to land for commerce, finance, insurance, services and hotels;
③ Culture and entertainment land (C3). Refers to land for facilities such as press and publication, culture and art, radio, film and television, book exhibition and amusement;
④ Sports land (c4), refers to land for stadiums and sports training bases etc., excluding land for sports within units such as schools;
⑤ Medical and health land (c5), refers to land for facilities for medical treatment, health care, sanitary and epidemic prevention, rehabilitation and first aid etc.
6 Land for education and scientific research and design (c6), referring to land for institutions of higher education, secondary specialized schools, adult schools, amateur schools, schools for the disabled, work-study schools, and scientific research and survey and design institutes, etc., excluding land for secondary schools, elementary school, and child-care facilities (which are included in the land for residential use).
(3) Industrial land (M). Refers to the land for production workshops, warehouses and their hock facilities of industrial and mining enterprises, mainly;
①The first category of industrial land (M1), refers to industrial land that is basically free of interference and pollution to the environment of residential and public **** facility land;
②The second category of industrial land (M2), refers to industrial land that is somewhat interfering and polluting to the environment of residential and public **** facility land;
③The third category of industrial land (M3), refers to industrial land that has serious interference and pollution to the environment of residential and public **** facilities land.
(4) Warehousing land (w). Refers to warehousing enterprises, warehouses, yards and packaging and processing workshops and their ancillary facilities land, mainly:
① General warehouse land (w1), refers to the storage of general goods of the general warehouse land;
② Dangerous Goods Warehouse Land (w2), refers to the storage of flammable, explosive and highly toxic and other hazardous goods of the land of the specialized warehouses.
(5) Municipal utility land (u). Refers to municipal utilities at the municipal, district and residential levels and their affiliated buildings (including structures, the same below) and management and maintenance facilities and other land, mainly:
① supply facilities land (U1), refers to the water supply, power supply, gas supply and heat supply and other facilities land, excluding the power plant, gas plant land (nanoindustrial land);
② land for transportation facilities (u2), refers to the public * ** passenger transportation, freight transportation land;

③ post and telecommunications facilities land (u3), refers to the postal, telecommunications and other facilities land;
④ environmental health facilities land (U4). It refers to the land for rainwater and sewage pumping stations, sewage treatment plants, and facilities for collecting and transporting feces and garbage, stacking and treating them;
5) The land for construction and maintenance facilities (U5) refers to the land for construction and maintenance facilities for building construction, equipment installation, municipal engineering, landscaping, and underground structures, etc.
6) The land for other municipal utilities (u6) such as firefighting, flood control, etc.
7) The land for postal and telecommunication facilities (u8) refers to the land for postal and telecommunication facilities;
8) The land for environmental sanitation facilities (U4). .
(6) Green space (G). Refers to the municipal, district and residential level of public **** green space and production protection green space (including water within its boundaries), mainly:
① public **** green space (G1) - refers to the public open to the public, with certain recreational facilities or decorative role of green space, including various types of parks and street green space;
② production protection green space (G2), refers to the green space used for gardening production, isolation, sanitation and security protection of green space.
The division of various types of construction land should follow the principle of land use compatibility. It shall be carried out according to the approved detailed plan; if there is no approved detailed plan yet, it shall be carried out according to the provisions of the zoning plan (or regional structure plan) and the Table of Suitable Scope for Various Types of Construction Land (see Table 10-1).
Any construction project not listed in Table 10-1 shall be determined by the city planning department according to the impact on the surrounding environment and infrastructure conditions.
Where there is a need to change the nature of the planned land, beyond the scope of the provisions of the YuanlO1, should be proposed to adjust the plan, in accordance with the prescribed procedures and examination and approval authority, reported to the municipal urban planning management department for approval after the implementation of the special circumstances, shall be reported to the municipal people's government for approval
