What is the procedure for applying for the qualification recognition of end-of-life motor vehicle recycling (dismantling) enterprises?

According to Article 8 of the latest version of the Implementing Rules for the Management of Recycling of End-of-Life Motor Vehicles of the State in 2019 (draft for comments), to obtain the qualification accreditation for recycling and dismantling of end-of-life motor vehicles, the following conditions shall be met:

(a) having the legal personality of an enterprise;

(b) the dismantling and dismantling operation site conforms to the overall urban planning or territorial spatial planning of the place where the site is located and the security requirements, and shall not be constructed In residential areas, commercial areas, drinking water source protection zones and other environmentally sensitive areas;

(3) in line with the national standard "End-of-Life Motor Vehicle Recycling and Disassembling Enterprises Technical Specification" (GB22128) of the site, facilities and equipment, storage, dismantling technical specifications, as well as the corresponding requirements of professional and technical personnel;

(4) in line with the environmental protection standard "Environmental Protection for the Dismantling of End-of-Life Motor Vehicles" (HJ348 Technical Specification). (HJ348) requirements;

(e) with ecological environmental protection system in line with national regulations, with the appropriate pollution prevention and control measures, the dismantling of solid waste generated by the proper disposal program;

(f) the main body of the application is not in violation of the provisions of the Implementing Rules and other serious violations of the law and breach of trust.

Article 9 Enterprises applying for accreditation shall apply through the Ministry of Commerce's "National Automobile Circulation Information Management Application Service" system or in writing to the competent provincial department of commerce in the place where the dismantling site is located, and submit the following written materials:

(1) Application report for the establishment of the application (which shall contain the applicant's name, legal representative, registered capital, residence, dismantling site, unified social credit code and other content) and feasibility study;

(ii) enterprise "business license";

(iii) enterprise charter;

(iv) enterprise legal representative ID card or other valid identity documents;

(v) business site land use right, Proof of ownership of housing or lease period of more than 10 years of land lease contract or land use right rental contract and housing lease documents;

(vi) the acquisition or acquisition by way of financial leasing for the dismantling of end-of-life motor vehicles and pollution prevention and control of the list of facilities and equipment, as well as invoices or financial leasing contracts and other documents evidencing ownership;

(vii) ecological and environmental authorities to issue the Approval documents for environmental impact assessment documents of construction projects;

(viii) List of professional and technical personnel;

(ix) Enterprise dismantling operation specifications, safety regulations and solid waste safety, standardized treatment and disposal programs.

Article 10 of the provincial competent department of commerce shall review the application materials received, the materials are complete, in accordance with the statutory form, shall accept the application for accreditation; incomplete or not in accordance with the statutory form of the materials, shall, within five working days from the date of receipt of the application, inform the applicant enterprise needs to make corrections.

Provincial competent department of commerce may entrust the competent department of commerce at the local (municipal) level where the dismantling operation site is located to examine whether the application materials are complete and conform to the statutory form.

Article XI of the provincial business department accepts the application for accreditation, should be organized to set up a group of experts to apply for accreditation of enterprises for on-site acceptance review.

Provincial departments in charge of business should be established by the dismantling of end-of-life motor vehicles, ecological and environmental protection, finance and other related fields of professional and technical personnel composed of a pool of experts, the number of experts in the pool of not less than 20 people. On-site acceptance assessment expert group consists of more than five odd experts, randomly selected from the expert database of experts, should be professionally representative.

The expert group in accordance with the provisions of these rules for accreditation conditions, the implementation of on-site acceptance assessment, truthfully fill out the "on-site acceptance assessment and scoring opinion form". On-site acceptance assessment experts shall be responsible for acceptance assessment.

Article XII of the provincial business department after reviewing the application materials, "on-site acceptance assessment and scoring opinion form," etc., that the application meets the conditions of accreditation, in the provincial business department website and the "National Automobile Circulation Information Management Application Service" system to be announced, the public period of not less than five working days. During the period of publicity, if there is any objection to the application of the enterprise, the competent department of commerce at the provincial level shall, according to the need, organize hearings, expert reassessment and review, etc. to verify the objections; if there is no objection to the application of the enterprise, the competent department of commerce at the provincial level shall, in the system of "National Automobile Circulation Information Management Application Service", pass the application of the enterprise, create the account of the enterprise and issue the "Scrap Motor Vehicle Recycling and Disposal". Issue the Certificate of Qualification Recognition for End-of-Life Motor Vehicle Recycling and Disassembling Enterprises (hereinafter referred to as "Certificate of Qualification Recognition"). If the conditions for qualification are not met, the competent provincial business department shall make a decision not to recognize the qualification and explain the reasons.

The competent provincial business department shall make the list of recycling and dismantling enterprises in the administrative region that have obtained the qualification certification to the public in a timely manner.

Article 13 The competent provincial business department shall accept the application for accreditation within 20 working days from the date of completion of the review and make the relevant decision. 20 working days can not make a decision, approved by the person in charge of the provincial business department, can be extended by 10 working days, and shall inform the applicant of the reasons for the extension of the deadline.

The time required for on-site acceptance review, hearing, etc. is not counted in the period specified in this article.
