Regulations of Zhejiang Province on Metrology Supervision and Management (202 1 Revision)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Metrology Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this province, with a view to standardizing metrological activities and their supervision and management, ensuring the unity of national metrological units and the accuracy and reliability of measurement values, promoting the development of production, trade, science and technology, and safeguarding the national interests and the legitimate rights and interests of consumers and business operators. Article 2 These Regulations shall apply to metrological activities and their supervision and management within the administrative area of this province.

The measurement activities mentioned in these Regulations include the use of measurement units, the establishment of measurement standards, the manufacture, repair, sale and use of measuring instruments, the verification and calibration of measuring instruments, the issuance of measurement data, the measurement and settlement of goods or services and other related activities. Article 3 The metrological activities shall follow the principles of accuracy, standardization, honesty and law-abiding.

The implementation of metrological supervision and management should follow the principles of scientific justice, openness and transparency, legal procedures, convenience and efficiency. Article 4 The metrological administrative departments of the people's governments at or above the county level shall be responsible for the metrological supervision and management within their respective administrative areas, and other relevant departments shall cooperate with each other to do a good job in the metrological supervision and management within their respective functions and duties. Article 5 The people's governments at or above the county level shall strengthen their leadership over metrological work, incorporate metrological work into the national economic and social development plan, coordinate and urge relevant departments to do a good job in metrological supervision and management, encourage and support research on metrological science and technology, guide enterprises and institutions to establish and improve metrological management systems, popularize advanced metrological science and technology and management methods, and incorporate the funds needed for the implementation of metrological supervision and management into the fiscal budget at the corresponding level.

Township people's governments and sub-district offices shall assist in the measurement supervision and management in accordance with the prescribed duties. Sixth to encourage and support the relevant industry associations (societies) to play the role of industry self-discipline, professional and technical guidance, vocational and technical training, information consultation and so on in measurement activities. Chapter II Units of Measurement and Measuring Instruments Article 7 Whoever engages in the following activities and uses units of measurement shall use the national legal units of measurement:

(1) Making official documents, bulletins and statistical statements;

(2) Engaging in teaching and scientific research and publishing academic papers and reports;

(3) Editing and broadcasting audio-visual programs such as radio, movies and television, and publishing books, newspapers, audio-visual products and advertisements;

(4) Making road traffic signs and other graphic signs;

(5) Producing and selling products, providing services, marking product labels and price labels, and compiling product instruction manuals;

(6) Printing bills, tickets, account books and vouchers;

(seven) to formulate standards, technical specifications and other technical documents;

(eight) issued by the verification, calibration, inspection and testing data and documents;

(nine) other activities stipulated by the state that the national legal units of measurement should be used.

Non-national legal units of measurement such as import and export commodities, publishing ancient books and literary works shall be implemented in accordance with relevant state regulations. Eighth provincial metrology department according to the needs of economic, social and scientific and technological development, formulate and improve the province's value delivery system planning.

The metrological administrative department of the people's government at or above the county level shall, according to the planning of the province's value delivery system, organize the establishment of social public measurement standards as the basis for unifying the value of the administrative region.

Social public measurement standards shall be kept and maintained by special personnel, and shall not be stopped without authorization. Article 9 To manufacture or repair measuring instruments, the following conditions shall be met:

(1) Having a fixed place and facilities suitable for manufacturing and repairing measuring instruments;

(2) Having technicians and inspectors suitable for the measuring instruments manufactured or repaired;

(3) Having inspection conditions to ensure the accuracy of measuring instruments manufactured or repaired;

(4) Having corresponding quality management system and measurement management system;

(5) Other conditions stipulated by the state. Tenth to encourage the use of international standards or advanced standards at home and abroad to develop new products of measuring instruments.

To manufacture new products of measuring instruments listed in the catalogue of measuring instruments under compulsory administration by the state, the type approval certificate of measuring instruments shall be obtained in accordance with state regulations. Eleventh the following measuring instruments shall be subject to compulsory verification according to law; Without verification, verification unqualified or beyond the verification period, shall not be used:

(1) social public measurement standard;

(two) the highest standards of measurement used by enterprises, institutions and relevant departments of the province;

(3) Working measuring instruments used in administrative law enforcement and judicial expertise to ascertain facts and judge legal responsibilities shall be listed in the catalogue of measuring instruments under compulsory management by the state;

(4) Working measuring instruments for trade settlement, safety protection, medical care and environmental monitoring, which are listed in the catalogue of measuring instruments under compulsory management by the state.

Working measuring instruments other than those specified in the preceding paragraph, which involve the vital interests of citizens, legal persons or other organizations and require compulsory verification, shall be determined by the provincial metrological department in conjunction with relevant provincial departments according to the development of economy, society, science and technology, and shall be promulgated and implemented after being approved by the provincial people's government. Twelfth measuring instruments that are not subject to compulsory verification can be traced back by calibration. Thirteenth any unit or individual shall have the following acts:

(a) manufacturing and selling measuring instruments that have been explicitly eliminated or prohibited by the state;

(two) manufacturing and selling measuring instruments without enterprise name and address, or selling measuring instruments without certificate (seal);

(3) manufacturing measuring instruments of approved types, changing product structure, key parts, etc. Changing the original approved model without authorization;

(4) Adding cheating devices or adding cheating functions to measuring instruments;

(five) the destruction of metrological verification seals (seals) or anti-cheating devices;

(6) Forging, stealing or reselling metrological verification certificates (seals) or metrological calibration reports;

(seven) other prohibited acts as prescribed by laws and regulations.
