Regulations on Prevention and Control of Air Pollution in Hefei City (2018 Amendment)

Chapter I General Provisions Article 1 In order to prevent and control air pollution, protect and improve the environment, safeguard human health, and promote the sustainable development of the economy and society, these regulations are formulated in accordance with the provisions of the Law of the People's Republic of China on the Prevention and Control of Air Pollution and other relevant laws and regulations, and in the light of the actual situation of the city. Article 2 These regulations shall apply to the prevention and control of air pollution in the administrative area of the city. Article 3 The people's governments of cities, counties (cities) are responsible for the quality of the atmospheric environment in their respective jurisdictions, formulate plans, take measures to prevent and control air pollution, protect and improve the atmospheric environment, so that the quality of the atmospheric environment in their respective jurisdictions is not lower than the national standards. Article 4 The administrative department of environmental protection of the people's governments of cities, counties (cities) and districts shall carry out unified supervision and management of the prevention and control of air pollution.

The relevant departments of the people's governments of the cities and counties (cities) implement supervision and management of the prevention and control of air pollution within their respective areas of responsibility. Article 5 Any unit or individual has the obligation to protect the atmospheric environment, and has the right to units and individuals polluting the atmospheric environment to report and complain; the right to the administrative department of environmental protection and other relevant administrative departments and their staff do not fulfill their duties in accordance with the law to report and complain. Chapter II Supervision and Management of Air Pollution Prevention and Control Article 6 The functional zoning of the quality of the atmospheric environment shall be carried out by the competent administrative department of environmental protection in conjunction with the municipal departments of development and reform, planning and other departments in accordance with the overall urban planning and air pollution prevention and control planning, and shall be reported to the municipal people's government for approval and implementation. Article 7 the implementation of air pollutant emission concentration control and the total amount of major air pollutant emission control combined management system.

The emission of pollutants into the atmosphere, the concentration of its pollutant emissions shall not exceed the national and provincial emission standards.

Article 10 enterprises, institutions and other production operators in violation of laws and regulations to discharge air pollutants, causing or likely to cause serious air pollution, or the evidence may be lost or hidden, the city, county (city) district people's government departments in charge of environmental protection and other supervisory and management responsibilities for atmospheric environmental protection, can be the relevant facilities, equipment, goods to take the seizure, impoundment and other administrative Compulsory measures. Article 11 The units shall strengthen the maintenance and overhaul of the production facilities and pollutant treatment facilities, and take measures to prevent the occurrence of air pollution accidents.

Emission or possible leakage of toxic and hazardous gases and gases containing radioactive substances or aerosols of the unit, shall formulate an emergency plan and report the location of the administrative department in charge of environmental protection, the public security organs of the fire agencies and other relevant departments for the record to accept the record of the department shall strengthen the record of the unit's inspection and technical guidance. Chapter III prevention and control of air pollution from coal and fuel oil Article XII of the city, county (city) people's government shall, in accordance with the law, delineate and publicize the high-polluting fuels no-burning zone, and according to the quality of the atmospheric environment, and gradually expand the scope of the no-burning zone.

Enterprises and institutions and other producers and operators in the no-burning zone shall, within the prescribed period, stop using highly polluting fuels, and switch to natural gas, liquefied petroleum gas, electricity or other clean energy.

The people's governments of cities, counties (cities) and districts shall rationally plan the layout of energy development and control the total amount of coal production capacity and consumption. Prohibit the production, sale and combustion of coal does not meet the standards or requirements. Article XIII approved the use of coal-fired boilers, (coke) kilns and other highly polluting fuel combustion facilities, should be equipped with dust removal, desulfurization facilities. In addition to circulating fluidized bed boilers other than coal-fired units should be installed denitrification facilities, new dry-process cement kilns should be implemented low-nitrogen combustion technology transformation and installation of denitrification facilities.

Dust removal facilities to collect smoke (powder) dust, should be sealed, bagged or wet mode of transportation. Article XIV in the urban planning area shall promote cogeneration and centralized heat supply, encourage the use of clean fuels.

In the areas covered by gas pipeline network and centralized heating network, shall not be built, expansion, alteration of heating facilities burning coal, heavy oil, residual oil; the original scattered small and medium-sized coal-fired heating boilers shall be removed within a period of time. Chapter IV Prevention and Control of Exhaust, Odor, Dust Pollution Article XV strictly limit the emission of exhaust gas and dust containing toxic and hazardous substances into the atmosphere; do need to be discharged, it should be purified and treated, and shall not exceed the prescribed emission standards, the total amount of control indicators; continuous disorganized emissions in the production process, closed measures should be taken to collect and treat. Article XVI of the transportation, loading and unloading, storage can emit toxic and hazardous gases or dust substances, should take closed measures or other protective measures. Article XVII in areas of population concentration and other areas that require special protection in accordance with the law, is prohibited to engage in the production of rubber products, business spray paint, bone glue, bone meal, slaughter, livestock and poultry breeding, bio-fermentation and other malodorous, toxic and hazardous gases and dust production and business activities, as well as open-air burning of linoleum, asphalt, rubber, plastics, leather, garbage, or other items that may produce air pollution.

Prohibit the open burning of straw, fallen leaves and other substances that produce smoke and dust pollution in populated areas, around airports, near transportation arteries, and in other areas designated by the people's governments of cities, counties (cities) and districts.
