Qinghai Province Interim Regulations on Mineral Resources

Chapter 1 General Principles Article 1 Mineral resources are the country’s precious wealth and an important material basis for socialist modernization. In order to strengthen the unified management, protection and rational development and utilization of mineral resources in our province and ensure the current and long-term needs of socialist construction, these regulations are specially formulated. Article 2 The mineral resources mentioned in these regulations include: metal minerals, non-metallic minerals, fuel minerals, underground water, underground thermal energy and other mineral resources in solid, liquid and gaseous states. Article 3: All mineral deposits (i.e. mineral resources) within the territory and waters of our province are owned by the state, that is, by all the people, and no unit or individual may use any means to appropriate or destroy them.

The ownership of mineral resources on the surface or underground does not change the state-owned nature of the mineral resources.

No unit or individual may conduct geological work, mine, or collect and sell mineral products without approval from the relevant provincial departments. Article 4: Implement the policy of comprehensive survey, exploration, and comprehensive development and utilization of mineral resources. When conducting geological work and developing and utilizing mineral resources, we must prevent waste, ensure production safety, and protect the natural environment. Article 5: All units and individuals should protect mineral resources and have the right to stop, expose, and report various violations of these regulations.

Rewards will be given to those who have contributed to the implementation of these regulations and the protection of mineral resources. Those who violate these regulations and cause loss and waste of mineral resources shall be punished. Article 6 People's governments at the state, city and county levels should strengthen their leadership in the rational development, utilization and protection of mineral resources and conscientiously implement relevant national laws, policies and these regulations.

The Qinghai Provincial Bureau of Geology and Mineral Resources has the responsibility for supervision and inspection of the implementation of these regulations. Chapter 2 Mineral Resources Management Article 7: Implement unified leadership, unified planning, division of labor and hierarchical management of the province's geological work, development, utilization and protection of mineral resources.

The Provincial Bureau of Geology and Mineral Resources is responsible for the unified management of registration of geological work in the province, and supervision and inspection of the development, utilization and protection of mineral resources.

Relevant industrial departments in the province are responsible for business management and the development, utilization and protection of mineral resources according to the scope of division of labor stipulated by the state. Article 8 Any regional geological survey of various scales, regional geophysical and geochemical prospecting, airborne geophysical and geochemical prospecting, ground inspection and verification of various geophysical and geochemical prospecting anomalies, and mineral surveys of various scales within our province shall be systematically mobilized. A unified registration and management system is implemented for the project's mineral point inspection, preliminary and detailed exploration of mineral deposits, regional hydrogeological surveys at various scales, urban water supply and agricultural and animal husbandry hydrogeological surveys, and geothermal geological surveys. Scattered and local geological work survey projects do not fall within the scope of registration.

Units applying for geological work should submit the work plan, work area scope and research extent map, technical equipment and technical strength to the Provincial Bureau of Geology and Mineral Resources before carrying out field work according to the geological work plan. Apply for registration. Upon review and approval, a geological work permit will be issued. Those without a license are not allowed to carry out work, and banks will not grant funds.

Approved geological work projects must complete tasks on schedule and submit reports in a timely manner. If work is not carried out within the year without justifiable reasons, the geological work permit will automatically expire.

The registration validity period for geological work is up to four years. If you need to extend the period after the expiration, you should apply for registration again. Those with legitimate reasons will be given priority for approval. Article 9 A division of labor and hierarchical approval management system shall be implemented for geological survey and exploration reports in accordance with relevant regulations.

All geological survey and exploration reports submitted for approval shall comply with relevant regulations. For general geological survey and exploration reports, an approval decision shall be made within three months after the report is submitted. For important geological exploration reports, the approval period shall not exceed six months.

The Provincial Mineral Reserves Committee is responsible for examining and approving geological exploration reports provided for mining construction design and use in the province. For all geological exploration reports (including preliminary exploration and detailed exploration reports) that are approved by various competent departments in accordance with regulations, a copy of the approval resolution shall be submitted to the Provincial Mineral Reserves Committee for record. Article 10: Implement a unified management system for geological data and mineral reserves. Various geological results, geological archive data and the dynamics of various mineral reserves must be submitted and reported to the Provincial Geological Data Office in a timely manner in accordance with the "National Geological Data Collection and Submission Measures" and the "Mineral Reserve Table Filling Regulations" respectively. Article 11: Implement an application and approval management system for mining. Without approval, no unit or individual may mine without authorization. Open an account with the People's Bank of China with a mining license.

1. State-owned enterprises that apply to mine large and medium-sized minerals (referring to the scale of mineral deposit reserves. The same below) must meet the following conditions:

1. There is a geological exploration report resolution that has been reviewed and approved;

2. Developed a comprehensive mining planning plan or mining design;

3. Comply with national and provincial construction planning and layout requirements;

4. Land acquisition complies with national regulations;

5. Have necessary funds, equipment, materials, power, transportation conditions and technical strength;

6. Do not hinder the normal mining and production safety and environmental protection of adjacent ore bodies;

7. Arrangements for staff living facilities comply with relevant regulations.

Applications for mining large and medium-sized minerals must be approved by the Provincial Planning Commission. When the unit applying for mining submits the plan task statement to the Provincial Planning Commission, it should also submit a mining application to the Provincial Geology and Mineral Resources Bureau. The Provincial Bureau of Geology and Mineral Resources shall review mineral reserves, comprehensive development and utilization of mineral resources, mining scope, etc., and submit the review opinions to the Provincial Planning Commission. At the same time as the plan mission is approved, the Provincial Bureau of Geology and Mineral Resources will issue a mining license.

2. Enterprises that apply to mine small-scale minerals shall refer to the conditions in paragraph 1 of this article for review and approval in accordance with the following provisions:

1. Any application to mine copper, lead, zinc, nickel, mercury, potash, boron, lithium, asbestos, natural sulfur, pyrite and other important minerals, or to open a small mine in the area surrounding a large or medium-sized mine, shall be subject to the Provincial Geology and Minerals Bureau Bureau approval.

2. In addition to the above-mentioned types of minerals, applications for opening small mines shall be reviewed and approved by state and municipal people's governments, regional administrative offices, and county people's governments authorized by the provincial people's government, and mining licenses shall be issued on their behalf. After the application is approved, it shall be filed with the Provincial Bureau of Geology and Mineral Resources. The Provincial Bureau of Geology and Mineral Resources shall inspect and supervise the approval status.

3. The limits of any approved mining area shall be vertically downward from the surface boundary, and a distance of twenty meters must be left between adjacent mining areas.

When a mining company expands its mining scope beyond the approved mining limits, it must reapply.

The mining license is valid for ten to thirty years. If you continue to mine after the expiration, you must reapply for approval procedures.

4. After the promulgation of these Regulations, all mines that have been mined shall apply for registration procedures.
