Regulations on Management of Live Pig Slaughtering in Kunming

Chapter I General Provisions Article 1 In order to strengthen the management of pig slaughtering, to ensure the quality of pig products, to protect the health of the people, according to the State Council's "Regulations on the Management of Pig Slaughtering" and the relevant laws and regulations, combined with the actual situation in the city, the formulation of these provisions. Article 2 The implementation of designated pig slaughtering, centralized quarantine, unified taxation, decentralized business system. Without fixed-point, any unit or individual shall not slaughter live pigs (except for individual self-raising and self-feeding in rural areas). Article 3 All units and individuals who slaughter, process, store, transport and sell live pigs and live pig products within the administrative area of the city shall comply with these provisions. Article 4 The products of live pigs referred to in these provisions refer to the carcasses, meat, fat, organs, blood, bones, heads, hooves, skins and hairs of live pigs which have not been processed after slaughtering. Article 5 Any unit or individual shall have the right to report and accuse the violation of these provisions. Chapter II Duties of the Administrative Department Article 6 The administrative department of commodity circulation of the People's Government of Kunming shall be in charge of the supervision and management of pig slaughtering within the administrative area of the city, and its main duties shall be:

(1) to carry out the implementation of the relevant national, provincial and municipal laws, regulations, rules and standards on the management of pig slaughtering and carry out the day-to-day supervision and management;

(2) to be responsible for formulating a target responsibility system for the management of pig slaughtering and organizing the daily supervision and management; and (2) to formulate the city's target responsibility system for the management of pig slaughtering and organize the implementation;

(3) to guide the management of pig slaughtering in counties (cities);

(4) according to the "Overall Urban Planning of Kunming City", in conjunction with the administrative department of the municipal planning, the city's city planning to put forward the setup of pig slaughtering plants (farms) in the city's urban planning within the scope of the main urban area planning planning planning, and organize the implementation of the municipal People's Government after approval;

(E) to be responsible for the review of the qualifications of designated pig slaughtering plants (farms) within the main urban area of the city and the issuance, cancellation and annual inspection of designated slaughtering licenses;

(F) to be responsible for other work in the management of the pig slaughtering industry. Article 7 The administrative departments of commodity circulation of the people's governments of the counties (cities) and districts shall be responsible for the management of pig slaughtering in the administrative area (except the main urban area of Kunming City Planning) and accept the supervision and guidance of the competent departments of commodity circulation of the city. Its duties are:

(1) to implement the national, provincial and municipal laws, regulations and rules relating to the management of pig slaughtering, and to carry out daily supervision and management;

(2) according to the approved general planning of the county (city) district, in conjunction with the planning and management departments of this level, to put forward the setup of pig slaughtering plants (farms) in the administrative area of planning for the approval of the people's government of the same level and organization and implementation of the plan (c) be responsible for the administrative area of the pig slaughtering plant (field) designated slaughtering license issuance, cancellation and annual inspection;

(d) in accordance with the requirements of the municipal people's government, the implementation of the target responsibility system for the management of pig slaughtering;

Chapter III: Setting up of fixed-point slaughtering plants (farms) Article 9: The setting up of fixed-point slaughtering plants (farms) for live pigs must comply with the following conditions:

(1) It must be in line with the city's urban planning;

(2) The straight-line distance from hospitals, schools, kindergartens, residential areas and railway stations must be more than 1,000 meters;

(3) It complies with the state's requirements to set up slaughtering plants (farms) of a scale appropriate to the size of the slaughter, waiting room, public security and planning. (c) The necessary facilities and equipments for pig slaughtering and pig product finishing and placing, as well as special means of transportation, are provided in accordance with the requirements stipulated by the State, such as rooms for waiting for slaughtering, slaughtering, emergency slaughtering, isolation rooms, cooling rooms for meat, processing workshops in line with the production of meat, quarantine and inspection rooms;

(d) There is a water source in accordance with the standards stipulated by the State, sufficient light and good ventilation;

(e) The emissions from the slaughtering of pigs must not exceed 1,000 meters in straight line with the requirements stipulated by the State. (v) There are facilities for harmless treatment of live pigs and live pig products;

(vii) There are necessary inspection equipments, disinfection facilities, disinfection medicines and sewage treatment facilities;

(viii) There are health certificates and professional training certificates issued by medical institutions above the county in accordance with the law. Slaughtering technicians qualified certificate;

(ix) qualified full-time or part-time meat quality inspectors;

(x) in line with the Animal Epidemic Control Law and the Food Sanitation Law provides for other epidemic prevention, health conditions. Article 10 The pig slaughtering plant (farm) shall not be established within the protection area of domestic drinking water source protection zone, airport clearance range, military facilities, electric power facilities, communication facilities and other protection areas. Article 11 The newly constructed pig slaughtering plant (farm) must meet the requirements of scale, factory and mechanization. Article 12 The designated slaughtering plants (farms) of live pigs which have been approved to be established before the promulgation and implementation of these provisions shall be transformed into large-scale, factory-based and mechanized plants, and those which fail to meet the requirements shall be banned. Article 13 The opening of designated slaughtering plants (farms) for live pigs must be in accordance with the approval authority stipulated in Articles 6 and 7, and the application shall be submitted to the administrative department for commodity circulation of the people's government of the city or county (city) district respectively, with relevant information, and the administrative department for commodity circulation shall examine the application in conjunction with the department for planning, environmental protection, etc., and after approval, the construction shall be carried out in accordance with the stipulated requirements. After the completion of the project, the administrative department in charge of commodity circulation will organize the acceptance, issue the designated slaughtering permit, and apply for the relevant certificates and licenses in the administrative departments for industry and commerce before opening for business.
