Criteria for determining the tenth grade of work-related injuries

The criteria for the tenth grade of work injury: partial organ defects, abnormal morphology, no functional impairment or mild functional impairment, no medical dependence or general medical dependence, and no impairment of self-care.

Medical dependence: work-related injuries that result in disability cannot be separated from treatment after the technical appraisal of the disability grade.

Medical dependence:

a) special medical dependence: the work injury must be treated with special medication, special medical equipment or devices for life;

b) general medical dependence: the work injury must be treated with medication for a long time or for life.

Ability of living independence: a person with work-related disability is unable to take care of himself/herself due to work-related injury and has to rely on others to take care of him/her.

The scope of ability of living independence mainly includes the following five items:

a) Eating: completely unable to eat on their own, relying on the help of others;

b) Turning over: unable to turn over on their own;

c) Urinating and defecating: unable to move on their own, relying on the help of others to defecate and defecate;

d) Getting dressed and washing up: unable to get dressed and wash up by themselves, relying on the help of others;

There are three levels of impairment of self-care:

Comprehensive judgment: The degree of disability is graded according to the organ damage, functional impairment and the degree of dependence on medical treatment and daily life care at the time of technical appraisal of the disability grade, with due consideration of the influence of psycho-social factors caused by the disability.

5.10 Tenth Grade

5.10.1 Principles of Classification

4.1.5 Impairment of self-care in life

The scope of self-care in life mainly includes the following five items:

a) Eating: completely unable to eat on one's own, and relying on the help of other people;

b) Turning over: unable to turn over on one's own;

c) Urination: unable to act on one's own, and relying on the help of other people in defecating;

d) Dressing, washing, and cleaning. ) Dressing and washing: unable to dress and wash themselves, totally dependent on others for help;

e) Autonomous movement: unable to walk around on their own.

Article 37: Employees who are disabled at work and are assessed to be disabled from Grade 7 to Grade 10 shall be entitled to the following treatments:

(1) A one-time disability benefit shall be paid from the Work-Related Injury Insurance Fund in accordance with the grade of the disability, with a standard of Grade 7 disability of 13 months of the person's own salary. The standard is 13 months' salary for Grade 7 disability, 11 months' salary for Grade 8 disability, 9 months' salary for Grade 9 disability, and 7 months' salary for Grade 10 disability.

(2) If the labor or employment contract is terminated at the expiration of the term, or if the employee himself/herself proposes to terminate the labor or employment contract, the one-time medical benefit for the injury will be paid by the Workers' Compensation Insurance Fund, and the one-time disability employment benefit will be paid by the employing unit.
