Chapter I General Provisions

Article 5 The provincial people's government housing and urban-rural construction administrative department is responsible for the province's urban appearance and environmental health management.
The municipalities and counties (cities and districts) people's governments are responsible for the administrative department of urban appearance and environmental sanitation management of urban appearance and environmental sanitation in their administrative areas.
Urban and rural planning, urban management and law enforcement, public security, civil affairs, industrial and commercial administration, price, health, transportation, environmental protection and other departments in accordance with their respective responsibilities, and urban appearance and environmental health related management. Article 7 The management of town appearance and environmental sanitation to implement the responsibility area system, clear responsibilities of the relevant responsible person.

(iv) airports, stations, wharves, parking lots, marketplaces, Culture, sports, entertainment, parks and other public gathering places, the management unit is responsible;
(v) railroads, highways, tunnels, rivers, waters and along the coast, the management unit is responsible;
(vi) construction sites by the construction company is responsible for the construction site to be constructed by the land use rights of the landowner is responsible for;
(vii) street-level merchants, all kinds of stalls around the operators are responsible for the operator.
Responsibility area delineated, the town appearance and environmental sanitation administrative department, the town people's government shall inform the responsible person in writing of the specific scope of the area of responsibility and responsibility requirements, and sign a letter of responsibility with the relevant responsible person.

Article 10 Any unit or individual has the right to enjoy the good appearance of the town and environmental sanitation, has the obligation to maintain the appearance of the town and environmental sanitation, and has the right to damage the appearance of the town and environmental sanitation behavior to discourage and report.
The people's governments at or above the county level shall give recognition and rewards to the units and individuals who have made remarkable achievements in the work of townscape and environmental sanitation.
Chapter II town appearance management

Article 21 of the town water supply and drainage management unit shall strengthen the management and maintenance of water supply and drainage network facilities to ensure the normal operation of water supply and drainage network facilities. Excavation of town roads, maintenance of pipelines, dredging rivers or drainage pipes (ditches) produced by the silt, dirt, cultivation or pruning of trees, flowers, lawns and other operations produced by the branches and leaves, soil, construction or maintenance units should be cleaned up in a timely manner.

Article 23 of the construction unit engaged in on-site operations, shall comply with the following provisions:
(a) set up hard enclosures around the construction site on the street;
(b) hardening of the vehicle access roads;
(c) dust control measures taken during construction;
(d) timely removal of slag and other construction waste;
(e) keep the vehicles leaving the construction site clean;
(f) according to the regulations of the drainage, shall not pollute the road surface;
(g) after the stoppage and completion of the project, timely cleanup and leveling of the site.
Approved by the occupation of town roads for construction work, the construction unit shall be in the approved section and period.

Article 27 prohibits unauthorized posting, writing or carving on the exterior walls of buildings, structures or public **** facilities, pavements, poles, trees and other places.

Article 28 The administrative department of urban appearance and environmental sanitation or street offices, town people's government, shall choose appropriate locations in the streets, alleys and residential areas to organize and set up public **** information boards for the relevant organizations and residents to publish free information for the convenience of the people, and is responsible for the management and cleaning.
Article 29 of the town road lighting management unit, shall ensure that the street light rate, equipment intact rate to meet national standards.
Town major roads on both sides of buildings, structures and public **** places, etc., shall be set in accordance with the requirements of the town lighting professional planning landscape lighting facilities.
City, county and town people's governments shall, according to the different seasons and time periods, the provisions of landscape lighting facilities on and off time.
Chapter III Environmental Health Management in Towns
Article 30 The administrative department in charge of town appearance and environmental health shall, in accordance with the professional planning of environmental health in towns and the standards for the construction of facilities, organize the construction of public **** toilets, garbage transfer stations, garbage garbage cans, sprinklers (flushing) vehicle water supply apparatus, environmental health vehicle parking lots and environmental health operators to work and rest places and other environmental health facilities.

Airports, stations, terminals and other transportation hubs and large and medium-sized shopping malls, cultural and sports facilities, tourist attractions, hotels and other places where people gather, should be in accordance with the standards for the establishment of environmental sanitation facilities, supporting the construction of public **** toilets and other environmental sanitation facilities.

Article 32 of the environmental sanitation facilities owners or managers should be timely maintenance and repair of environmental sanitation facilities to ensure that the environmental sanitation facilities in good condition and normal use.

Article 33 Any unit or individual shall not occupy, damage or change the use of environmental sanitation facilities, environmental sanitation facilities shall not be demolished or relocated without authorization. Indeed need to dismantle, relocation, the construction unit shall be put forward in advance to dismantle, relocation program, reported to the town appearance and environmental sanitation administrative department for approval before implementation, and rebuild or compensation in accordance with the law.
Article 34 of the town roads, public **** site cleaning responsibility, shall be in accordance with the operating norms and environmental health standards, regular cleaning, cleaning. The first daily sweeping and cleaning operations shall be completed within the time specified by the administrative department of town appearance and environmental sanitation.
It is strictly prohibited to sweep leaves and garbage into the sewers, green areas and river ditches.
Article 35 No chickens, ducks, geese, rabbits, sheep, pigs and other poultry and livestock and edible pigeons shall be kept in the built-up areas of cities. Except for those engaged in teaching, scientific research or other special activities in accordance with the law.
Keeping pets shall not affect environmental health. Dog keepers out of the house with dogs, should be led by a dog chain (rope), and carry with the removal of dog feces appliances, and timely removal of dog feces.
Article 36 No unit or individual shall have the following behaviors:
(1) spitting or drowning;
(2) littering peels, paper, cigarette butts, chewing gum, plastic bags, beverage bottles (boxes) and other wastes;
(3) not in accordance with the provisions of the dumping of garbage, sewage or feces;
(4) not in accordance with the provisions of the barbecue operation;
(5) not in accordance with the provisions of the barbecue operation;

(e) burning branches, leaves, garbage or other waste in open places, garbage collection containers;
(f) other damage to the appearance of the town and environmental health.
Article 37 Units and individuals shall, in accordance with the specified location, time and other requirements, the household garbage to the designated garbage containers or collection sites. Waste furniture and other bulky garbage shall be put into the designated collection places in accordance with the specified time.
To implement the system of separate collection and recycling of domestic garbage. The area and time for the implementation of separate collection and recycling of domestic garbage shall be determined and announced by the administrative department of town appearance and environmental sanitation. Article 38 The garbage producer shall pay the domestic garbage disposal fee in accordance with the provisions. Article 39 The collection and transportation of domestic garbage generated by residents and feces not connected to the sewage treatment system shall be organized by the administrative department in charge of urban appearance and environmental sanitation. The living garbage generated by the unit shall be collected and transported by the unit, or entrusted to the urban appearance and environmental sanitation operation and service units to collect and transport.
Life wastes shall be transported to the administrative department of urban appearance and environmental sanitation designated by the life of the waste disposal site for disposal.
Article 40 To engage in domestic garbage cleaning, collection, transportation and disposal of business activities, shall apply to the administrative department of urban appearance and environmental sanitation, and obtain a business license before conducting business.
Article 41 The kitchen garbage generated by unit canteens and catering operators shall be collected and disposed of separately in accordance with the relevant provisions of the people's government in the locality, or entrusted to the relevant professional units, and shall not be discharged into the rainwater, sewage drains, watercourses, public **** toilets or mixed with other garbage.
Industrial waste, medical waste, electronic waste and other types of dangerous, toxic and hazardous waste, should be implemented in the collection of designated units with the appropriate qualifications for disposal, shall not be put into the domestic garbage containers or discarded.
Article 42 The construction unit to dispose of construction waste and transportation units to transport construction waste, shall apply to the administrative department of urban appearance and environmental sanitation, to obtain approval for the disposal of construction waste, before disposal, transportation of construction waste.
Vehicles transporting construction waste shall carry with them the approved documents for disposal of construction waste, and shall transport the construction waste to the designated disposal site in accordance with the time, route and quantity approved by the administrative department for urban appearance and environmental sanitation, and shall not be discarded without authorization.
Construction units shall not give construction waste to individuals or transportation units that have not obtained approval for disposal of construction waste for transportation.
Article 43 The construction waste generated by the residents for house decoration activities shall be piled up in accordance with the locations designated by the property service enterprises or community residents' committees, and shall bear the cost of removal.
Property service enterprises or community residents' committees shall promptly commission a professional unit of environmental sanitation to transport the construction waste generated by residents' house decoration to the places designated by the administrative department of urban appearance and environmental sanitation for disposal.
Chapter IV Supervision of Law Enforcement
Article 44 The people's governments of cities, counties and towns shall establish and improve the responsibility system for the administrative law enforcement of urban appearance and environmental sanitation and the system of accountability for faults.
The administrative department of urban appearance and environmental sanitation, urban management and law enforcement agencies shall strengthen the construction of administrative law enforcement team, law enforcement personnel to strengthen education, training, supervision, and improve the quality of law enforcement personnel.
Article 45 of the townscape and environmental sanitation administrative departments of the units and individuals involved in the townscape and environmental sanitation administrative licensing applications, in addition to the administrative licensing decision can be made on the spot, it shall be accepted from the date of the application for administrative licensing within 20 days to make a decision; to make a written decision of not administrative licensing, it shall state the reasons.
Article 46 The staff of the administrative department of urban appearance and environmental sanitation, urban management and law enforcement agencies, shall take the initiative to show their administrative law enforcement documents, comply with the legal procedures, fair and civilized law enforcement, and shall not have the following behaviors:
(a) not in accordance with the statutory duties or legal procedures for administrative law enforcement;
(b) should be accepted to the Reports, complaints are not accepted or accepted reports, complaints are not investigated and dealt with;
(C) scolding, threatening or insulting the parties;
(D) intentional damage, unauthorized handling or misappropriation of the party's belongings;

Article 47 of the townscape and environmental sanitation administrative department, urban management and law enforcement agencies shall establish a complaint, report acceptance system, set up, publish the townscape and environmental sanitation violations of the complaint, report telephone and electronic mailbox, and complaints and reports of timely investigation and processing.
Complaints, reports of urban appearance and environmental sanitation administrative departments, urban management and law enforcement agencies, law enforcement personnel violations, the department receiving the complaint, report shall promptly investigate and deal with.
Chapter V Legal Liability
Article 48 Violation of the provisions of these measures, laws, rules and regulations have been made to penalize, in accordance with the provisions of its implementation; laws, rules and regulations have not been made to penalize, in accordance with the provisions of these measures.
Article 49 violation of the provisions of these measures, the townscape and environmental health responsibility area responsible for the failure of the person in accordance with the requirements of the area of responsibility for sanitation and cleaning, snow and ice clearance, removal of graffiti and other townscape and environmental health work, by the administrative department of the townscape and environmental health and ordered to make corrections within a specified period of time; failure to make corrections, to give a notice of criticism.

(vii) spitting, drowning, or littering peelings, confetti, cigarette butts, chewing gum, plastic bags, beverage bottles (boxes) and other waste;
(h) not in accordance with the provisions of the dumping of garbage, sewage or feces;
(ix) not in accordance with the provisions of the barbecue business.
Article 51 violation of the provisions of this Measures, one of the following acts, by the town appearance and environmental sanitation administrative department ordered to stop the illegal behavior, clean up, remove or take other remedial measures; overdue clean up, removal or take other remedial measures, may be fined in accordance with the following provisions:

(f) recycling enterprises or individual operators littering or burning of waste goods, the unit shall be fined 500 yuan or more than 5,000 yuan per unit, an individual A fine of 50 yuan or more than 200 yuan;
(VII) construction unit in violation of the provisions of the construction site operations management, not set up around the construction site on the street hard fencing, not hardened vehicle access roads, construction without dust control measures, not timely removal of slag and other construction waste, not to keep the vehicles away from the construction site clean, not according to the provisions of the drainage resulting in pollution of the roadway, the project completion Or after the suspension of work is not timely cleaned up and leveled the site, shall be fined from 1000 yuan to 20,000 yuan;
(viii) without the consent of the administrative department of the town appearance and environmental sanitation, unauthorized installation of large-scale outdoor advertisements, affecting the appearance of the town, shall be fined from 2000 yuan to 20,000 yuan;
(ix) without the approval of the administrative department of the town appearance and environmental sanitation. In the town buildings, structures or other facilities on the posting, hanging promotional materials, or the use of physical shape, hanging objects, inflatable devices and other carriers to set up promotional materials, affecting the appearance of the town, shall be fined not less than 200 yuan more than 5,000 yuan;

(k) in the open air, garbage collection containers burning branches, leaves, garbage, or other wastes, shall be a fine of not less than 50 yuan or more than 200 yuan.

Article 53 violation of the provisions of these measures, damage to the townscape and environmental sanitation facilities, the parties shall restore the original state; causing losses, shall bear the responsibility for compensation.
Illegal acquisition of manhole covers, ditch covers, grates and other facilities, by the public security department in accordance with relevant laws and regulations shall be punished; constitutes a crime, be held criminally responsible. Obstruction of urban appearance and environmental sanitation administrative department, urban management and law enforcement agencies of the staff in accordance with the law to perform their official duties, by the public security department shall be punished in accordance with the law; constitutes a crime, shall be investigated for criminal responsibility.
Article 54 In cities, counties and towns where the relative centralization of administrative penalties is in force, the administrative penalties provided for in these Measures shall be implemented by the administrative and law-enforcement agencies of urban management in accordance with the duties determined by the State Council or the provincial people's government.
Article 55 The staff of the administrative department of urban appearance and environmental sanitation, urban management and law enforcement agencies, in the management of urban appearance and environmental sanitation, one of the following acts, shall be given penalties according to law; constitutes a crime, shall be investigated for criminal responsibility:
(1) not in accordance with the statutory duties or legal procedures for administrative law enforcement;

Chapter VI Supplementary Provisions
Article 56 These Measures shall come into force on March 1, 2010.
