2.<<Interim Measures for the Management of Urban Employees' Basic Medical Insurance Designated Retail Pharmacies>>

Article 1 In order to strengthen and standardize the management of urban employees' basic medical insurance designated retail pharmacies, these measures are formulated in accordance with the "State Council's Decision on the Establishment of a Basic Medical Insurance System for Urban Employees" (Guo Fa [1998] No. 44).

Article 2 The designated retail pharmacies referred to in these Measures refer to the retail pharmacies that provide out-of-prescription dispensing services for urban workers' basic medical insurance participants, as examined by the labor security administrative departments of the co-ordination areas and determined by the social insurance agencies. The dispensing of prescriptions refers to the act of purchasing medicines at designated retail pharmacies by insured persons with prescriptions from designated medical institutions.

Article 3 of the designated retail pharmacies to review and determine the principles are: to ensure the quality of basic medical insurance medication varieties; the introduction of a competitive mechanism, a reasonable control of the cost of pharmaceutical services; the convenience of the insured to purchase medicines after medical treatment and ease of management.

Article 4 of the designated retail pharmacies shall have the following qualifications and conditions:

(1) hold the "Drug Business Enterprise License", "Drug Business Enterprise Certificate of Conformity" and "Business License", and pass the annual inspection of the drug supervision and management department;

(2) comply with the "Chinese People's **** and the State Drug Administration Law" and the relevant laws and regulations, and have a sound and complete drug (ii) comply with the Drug Administration Law of the People's Republic of China and relevant regulations, and have a sound and perfect drug quality assurance system to ensure the safety, effectiveness and quality of service;

(vi) Strictly carry out the relevant policies and regulations of the basic medical insurance system for urban workers, and have a standardized internal management system, with the necessary management personnel and equipment.

Article 5 A retail pharmacy willing to undertake the designated services of the basic medical insurance for urban workers shall submit a written application to the labor security administrative department of the coordinating area and provide the following materials:

(1) a copy of the license of the drug business enterprise, certificate of conformity, and business license;

(2) documents certifying the titles of the pharmacy technical personnel of pharmacists or above;

(C) a list of pharmaceutical products and the previous year's business income and expenditure;

(D) documents proving that the supervision and management of drugs, the price department supervision and inspection qualified;

(E) other materials prescribed by the administrative department of labor security.

Article 6: The administrative department of labor security examines the qualification of retail pharmacies for fixed-point treatment on the basis of their applications and the various materials provided.

Article 7: The social insurance administration agencies in the integrated areas shall determine the designated retail pharmacies within the scope of the retail pharmacies that have obtained the qualification of designated retail pharmacies, and shall issue designated retail pharmacy labels and make them known to the public, so that the insured persons can choose to purchase medicines.

Article 8 of the social insurance agencies and designated retail pharmacies to sign an agreement, including the scope of services, service content, quality of service, drug billing methods, as well as drug auditing and control, etc., to clarify the responsibilities, rights and obligations of both parties. The agreement is generally valid for one year. If either party violates the agreement, the other party has the right to terminate the agreement, provided that it notifies the other party and the insured in advance and reports it to the labor security administrative department for the record.

Article IX of the external prescription must be issued by a physician of the designated medical institution, with the signature of the physician and the seal of the designated medical institution, and the prescription should be reviewed and signed by a pharmacist, and kept for more than 2 years for verification.

Article 10 of the designated retail pharmacies should be equipped with full-time (part-time) management personnel, and social insurance agencies **** with the management of the work. External prescriptions should be managed separately and accounted for separately. The designated retail pharmacies shall regularly report to the social insurance agencies in the coordinating area on the dispensing services and costs incurred.

Article 11 of the social insurance agencies to strengthen the designated retail pharmacy prescription dispensing services to check and audit the cost. The designated retail pharmacies are obliged to provide information and list of accounts related to the cost audit.

Article 12: Social insurance agencies shall settle the fees in full and on time in accordance with the relevant policies and regulations of basic medical insurance and the agreements signed with the designated retail pharmacies. The social insurance agency shall not pay for expenses that violate the regulations.

Article 13 The administrative department of labor security shall organize the supervision and administration of medicines, price, pharmaceutical industry authorities and other relevant departments to strengthen the supervision and inspection of prescription dispensing services and management of designated retail pharmacies. The qualifications of designated retail pharmacies shall be subject to annual audits. For those designated retail pharmacies that violate the regulations, the labor security department may, depending on the circumstances, order them to make corrections within a certain period of time, or cancel their qualifications as designated pharmacies.

Article 15 of the provinces (autonomous regions and municipalities directly under the Central Government) labor security administrative departments can be based on these measures to formulate implementation details.

Article XVI of these measures shall come into force on the date of publication.
