Regulations of Xiangyang Municipality on Water Environment Protection in Hanjiang River Basin

chapter I general provisions article 1 in order to protect and improve the water environment in the Hanjiang river basin of this municipality, prevent and control water pollution, ensure water ecological safety, and promote the construction of ecological civilization and sustainable economic and social development, these regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this municipality. Article 2 These Regulations shall apply to the prevention and control of water pollution and water ecological protection of surface water bodies and underground water bodies in the Hanjiang River Basin (hereinafter referred to as Hanjiang River Basin) within the administrative area of this Municipality. Article 3 The prevention and control of water pollution and the protection of water ecology in the Hanjiang River Basin adhere to the principles of giving priority to protection, giving priority to prevention, social participation, comprehensive management and polluter's responsibility. Article 4 The water quality of the main stream of the Hanjiang River within the administrative area of this Municipality shall be protected according to the Class II standard of the National Environmental Quality Standard for Surface Water. The water quality of the tributaries of Hanjiang River is not lower than Class III standard, and the tributaries that have reached Class II water quality ensure that the existing water quality will not be reduced and gradually improved. Article 5 All units and individuals have the obligation to protect the water environment of the Hanjiang River Basin and have the right to report acts that damage the water environment of the Hanjiang River Basin.

the people's governments of cities and counties (cities, districts) should strengthen the publicity and education of water environmental protection in the Hanjiang river basin, disclose water environmental information according to law, and reward units and individuals that have made outstanding contributions to the water environmental protection in the Hanjiang river basin. Chapter II Government Duties Article 6 The water environment protection in Hanjiang River Basin shall be subject to the government target responsibility system and the chief executive responsibility system. The people's governments of cities and counties (cities, districts) shall be responsible for the water environment protection in the Hanjiang River Basin within their respective administrative areas, formulate and implement comprehensive water environment management and ecological protection plans at different levels, and establish and improve the water environment investment guarantee mechanism and ecological compensation mechanism.

township people's governments (sub-district offices) carry out water environment protection in Hanjiang river basin according to the provisions of laws and regulations. Article 7 the competent department of environmental protection of the municipal people's government shall exercise unified supervision and management over the water environmental protection of the Hanjiang river basin, and perform the following duties:

(1) to organize the preparation of the water environmental protection plan of the Hanjiang river basin and the delineation plan of drinking water source protection areas;

(2) to draw up the functional zoning of water environment, the total amount control and reduction scheme of local water pollutants and the emission standards according to law;

(3) Prepare emergency plans for water pollution emergencies, and investigate and handle water pollution incidents;

(4) regularly carry out water environment monitoring and assessment, and publish water environment quality information of Hanjiang River Basin in municipal public media every month;

(5) supervise the pollution of drinking water sources;

(6) to supervise the tail water discharge of centralized sewage treatment business units, the wastewater treatment and discharge of industrial enterprises and medical institutions;

(7) supervising the activities of livestock breeding and aquaculture to pollute water bodies;

(8) Other duties as stipulated by laws and regulations. Article 8 The relevant departments of the people's governments of cities and counties (cities, districts) mainly perform the following duties in the water environment protection work of the Hanjiang River Basin:

(1) The water administrative (aquatic) department is responsible for working out the water resources protection plan, water function zoning and fishery waters development plan in the basin in conjunction with the environmental protection departments, monitoring the water quality of the water function areas, supervising sand mining and gold panning in rivers, and supervising the pollution prevention and control of aquaculture activities;

(2) The competent agricultural authorities shall manage the use of agricultural inputs such as pesticides and fertilizers according to law, guide and supervise the prevention and control of water pollution in livestock and poultry breeding, and prevent and control agricultural non-point source pollution;

(3) The competent department of urban and rural construction is responsible for the construction, operation and management of urban sewage centralized treatment facilities and supporting pipe networks, the treatment of urban black and odorous water bodies, and the organization and promotion of the construction of domestic sewage and garbage collection and treatment systems in ports, docks and rural areas;

(4) The competent forestry authorities are responsible for the construction and management of wetlands, Hanjiang shelterbelts, water conservation forests and shoreline protection ecological isolation belts;

(5) The urban management department is responsible for investigating the dumping of industrial wastes, construction wastes, domestic wastes and other wastes into the bank slopes of urban dikes, as well as washing, car washing and bathing on the banks of urban areas that may pollute water bodies;

(6) The transportation department is responsible for supervising the prevention and control of water pollution of ships, barges, ports and docks, and the prevention and emergency treatment of shipping pollution accidents, and investigating and dealing with ships and barges operating illegally on the water;

(7) the competent health department is responsible for the supervision of drinking water safety and hygiene, participating in the delineation of drinking water source protection areas, the prevention and emergency treatment of sudden accidents of drinking water source pollution, and supervising the disposal of sewage and waste in medical institutions;

(8) The competent department of land and resources is responsible for the supervision and management of water pollution prevention in the process of exploration, mining and groundwater exploitation.

the people's governments of cities and counties (cities, districts) shall, according to the actual needs, designate relevant departments to regularly clean up the floating objects that hinder the water ecological protection in the important waters of the Hanjiang river basin. Article 9 The relevant departments of the municipal and county (city, district) people's governments, such as development and reform, letter, public security, supervision, finance, tourism, administrative examination and approval, industry and commerce, shall, according to their respective functions and duties, supervise and manage the prevention and control of water pollution and the protection of water ecology. Article 1 The people's governments of cities and counties (cities, districts) shall establish a regional and departmental cooperative linkage mechanism for water environmental protection, hold joint meetings regularly, carry out joint and cross-disciplinary law enforcement, and establish a joint emergency response mechanism for information sharing and accidents.
