Measures for the Administration of Chinese Medicine Clinics (for Trial Implementation)
Article 1: In order to provide the State Administration of Traditional Chinese Medicine and the State Council of Traditional Chinese Medicine with a comprehensive set of guidelines for the administration of Chinese medicine clinics, the State Council of Traditional Chinese Medicine is hereby promulgating the following guidelines for the administration of Chinese medicine clinics. p>
Article 1 In order to strengthen the management of Chinese medicine clinics and ensure that citizens enjoy safe, effective and convenient Chinese medicine services, these measures are formulated in accordance with the relevant provisions of the Law of the People's Republic of China on Practicing Physicians and the Regulations on the Administration of Medical Institutions.
Second drug retail pharmacies apply for the establishment of Chinese medicine clinics, the application of these measures.
Article 3 The State Administration of Traditional Chinese Medicine is responsible for the supervision and management of Chinese medicine clinics. Local people's governments at or above the county level health administrative departments, traditional Chinese medicine management department is responsible for the supervision and management of Chinese medicine clinics within the administrative region.
Article 4 The application for the establishment of Chinese medicine clinic of the drug retail pharmacy, must also have the following conditions:
(1) with the "Drug Certification of Quality Management Standards", "Drug License" and business license;
(2) with an independent business area of traditional Chinese medicine tablets, the tablets area shall not be less than 50 square meters;
(3) the quality of traditional Chinese medicine tablets meets the standards of the Chinese medicine industry;

Article V set up a Chinese medicine clinic, must be set up in accordance with the planning of medical institutions, by the local people's government at the county level of the administrative department of health, traditional Chinese medicine management department in accordance with the "Regulations for the Administration of Medical Institutions", "Regulations for the Implementation of Medical Institutions" and "Chinese medicine clinic basic standards" as well as the relevant provisions of the set up of the relevant provisions of the approval and registration of practice. Chinese medicine clinics can be registered as the second place of practice of Chinese medicine practitioners, but at least one Chinese medicine practitioner's first place of practice is the clinic.
Article 10: Chinese medicine practitioners of the Chinese medicine category may practice in Chinese medicine clinics, while practitioners of other categories may not practice in Chinese medicine clinics.
Article XI of Chinese medicine clinics can only provide Chinese medicine prescription services, shall not exceed the scope of practice; at the same time sitting in the category of Chinese medicine practitioners shall not be more than two people.
Article XII of the Chinese medicine clinic practice, shall strictly abide by the relevant state laws, regulations, rules and technical specifications, and strengthen the education of Chinese medicine practitioners, prevention of medical accidents, to ensure the safety of medical care and quality of service.
Article 13 Chinese medicine clinics shall establish and improve the following rules and regulations:
(1) Code of professional ethics and code of conduct for personnel;
(2) job responsibility system for personnel;
(3) employment, training, management, assessment, rewards and punishments system;
(4) technical specifications and work system;
(5) medical accident prevention and reporting system. (v) medical incident prevention and reporting system;
(vi) medical quality management system;
(vii) medical waste management system;
(viii) registration system for patients;
(ix) financial, charging, archives, information management system;
(x) other relevant systems.
Article XIV of the Chinese medicine clinic to strictly implement the state on Chinese medicine medical record writing, prescription management. To be strictly in accordance with national regulations standardize the use of the relevant departments uniformly printed bills.
Article XV of traditional Chinese medicine clinics should be in a prominent position in the diagnosis and treatment subjects, diagnostic and treatment means, diagnosis and treatment time and charges.

Article XVII of the local people's government at the county level health administrative departments, traditional Chinese medicine management department is responsible for the implementation of Chinese medicine clinic daily supervision and management, establish and improve the supervision and evaluation system, the implementation of information disclosure and reward and punishment system.
Article 18 of the local people's governments at the county level health administrative departments, traditional Chinese medicine management shall establish a social democratic supervision system, regularly collect the opinions and suggestions of the citizens receiving services, the satisfaction of the citizens receiving services as the assessment of traditional Chinese medicine clinics and practitioners of traditional Chinese medicine as an important criterion.
Article 19 violation of the "Chinese People's **** and the State Practitioners Law", "Regulations on the Administration of Medical Institutions" and its implementing rules and other laws, rules and regulations, shall be punished in accordance with the relevant provisions.
Article 20 Provinces, autonomous regions and municipalities directly under the Central Health Administration, the Chinese medicine administration may, in accordance with these measures, to develop specific implementation details.
Article 21 These Measures shall be interpreted by the State Administration of Traditional Chinese Medicine.
Article 22 These Measures shall come into force on the date of promulgation.
Annex 2
Basic Standards for Chinese Medicine Clinics
I. Chinese medicine clinics are set up by pharmacies with at least 400 varieties of traditional Chinese medicines, and are only allowed to provide prescription services for traditional Chinese medicines.
Second, the personnel
At least one after obtaining the qualification of physician registered in the medical institutions continuously engaged in clinical work for more than 5 years in the category of Chinese medicine practitioners.
