Measures for the Administration of Express Business License (revised on 20 19)

Chapter I General Provisions Article 1 In order to standardize the management of express delivery business license and promote the healthy development of express delivery industry, these Measures are formulated in accordance with the Postal Law of People's Republic of China (PRC), the Administrative Licensing Law of People's Republic of China (PRC), the Provisional Regulations on Express Delivery and other laws and administrative regulations. Article 2 These Measures shall apply to the application, approval, supervision and management of the express delivery business license. Article 3 The postal administrations of the State Council, provinces, autonomous regions and municipalities directly under the Central Government and the postal administrations below the provincial level established in accordance with the provisions of the State Council (hereinafter referred to as postal administrations) are responsible for the management of express delivery business licenses. Article 4 The management of express delivery business license shall follow the principles of openness, fairness, impartiality, convenience and high efficiency.

Postal administration departments should make full use of computer networks, big data and other information technologies to improve the efficiency of express business license management services. Article 5 Whoever engages in express delivery business shall obtain the express delivery business license according to law, and accept the supervision and management of postal administrations and other relevant departments. Without permission, no unit or individual may engage in express delivery business. Chapter II Application and Acceptance Article 6 The application for express delivery business license shall comply with the provisions of Article 52 of the Postal Law of People's Republic of China (PRC). Article 7 To apply for a business license for express delivery business, an applicant shall have the following service capabilities:

(a) the service network and the delivery capacity of letters, parcels, printed matter and other articles (hereinafter referred to as express mail) that are suitable for the geographical scope and business scope of the application;

(two) to provide express business consulting, telephone inquiry and Internet information inquiry services;

(3) Having a place or facility suitable for the geographical scope and business scope of the application for receiving and sending express mail;

(4) If the courier service is operated through information networks such as the Internet, it has the information processing ability suitable for the geographical scope and business scope of the application, and can keep the courier service information for not less than 3 years;

(5) Where express mail is sorted, sealed, received, sent or transported, it shall have a closed processing place with appropriate area and be equipped with corresponding equipment, which meets the requirements of postal administrations and state security organs to perform their duties according to law.

Those who specialize in receiving and sending express mail within the scope of provinces, autonomous regions and municipalities directly under the Central Government shall have the service capabilities listed in items 1 to 4 of the preceding paragraph; It shall also sign a written agreement or letter of intent with a cooperative enterprise engaged in express delivery business. Article 8 To apply for a business license for express delivery business, an applicant shall have the following service quality management system and business operation specifications:

(a) the service type, service time limit, service price and other service commitment publicity management system;

(2) Management system of complaint acceptance and compensation;

(3) Operating specifications for business inquiry, acceptance, sorting and delivery. Article 9 To apply for a business license for express delivery business, the following safety guarantee systems and measures shall be provided according to the business scope of application:

(a) the security system of employee safety and user information security;

(2) Emergency plan;

(3) Acceptance inspection and real-name acceptance system;

(4) Express mail safety inspection system;

(five) equipped with monitoring, security and other equipment and facilities in line with state regulations;

(six) equipped with a unified computer management system, equipped with a data interface that meets the requirements of postal management, and can provide data related to express delivery services;

(seven) technical measures to monitor and record the running state of the computer management system;

(eight) backup and encryption measures of express service information data. Article 10 Anyone who applies for international express delivery business shall also be able to provide customs declaration materials for delivering express mail to relevant departments. Airports, import and export ports and other places, facilities and equipment under customs supervision shall meet the requirements for the customs to perform its duties according to law. Eleventh to apply for express business license, the following materials shall be submitted to the postal administration department as stipulated in the first paragraph of Article 53 of the Postal Law of People's Republic of China (PRC):

(1) An application for the express delivery business license;

(2) Pre-approval materials of enterprise name or business license of enterprise legal person;

(3) A description of the conditions stipulated in Articles 7 to 10 of these Measures;

(4) Other materials as prescribed by laws and administrative regulations.

The application for express business license can be made through the information system of postal administration department. Twelfth postal administrations shall, in accordance with the provisions of Article 32 of the Administrative Licensing Law of People's Republic of China (PRC), handle the application for express delivery business license put forward by the applicant. Chapter III Examination and Decision Article 13 The postal administration department shall, within 45 working days from the date of accepting the application for express delivery business license, make an examination and make a decision on approval or disapproval. If approved, the express delivery business license shall be issued and announced; If it is not approved, it shall notify the applicant in writing and explain the reasons.

When examining the application for express delivery business license, the postal administration department shall consider national security and other factors, and solicit the opinions of relevant departments. Article 14 If the applicant does not actually have the customs declaration data and the conditions of processing places, facilities and equipment specified in Article 10 of these Measures within the area specified by the postal administration of the State Council, but promises that it can be realized within the agreed time limit, the postal administration that accepts the application may determine that the applicant meets the relevant conditions. The agreed time limit shall not exceed 6 months from the date when the postal administrative department makes the administrative licensing decision.

The postal administration department shall check whether the licensee has fulfilled its promise within the agreed time limit. If it is found that the actual situation of the licensee is inconsistent with the promised content, the postal administration department shall revoke the express delivery business license.
