Legal analysis: secondary recall within 48 hours. According to the severity of the drug safety hazard, drug recalls are categorized as:
(1) Class I recall: use of the drug may cause serious health hazards;
(2) Class II recall: use of the drug may cause temporary or reversible health hazards;
(3) Class III recall: use of the drug does not generally cause health hazards, but for other reasons need to be recalled.
Legal Basis: The Law of the People's Republic of China on the Administration of Medicines
Article 2: This Law shall apply to the development, production, operation, use and supervision and management of medicines within the territory of the People's Republic of China. Medicines referred to in this Law are substances, including traditional Chinese medicines, chemical medicines and biological products, which are used for the prevention, treatment and diagnosis of human diseases, and for the purpose of regulating the physiological functions of human beings, and for which there are indications or functions, as well as usage and dosage.
Article 3 The management of medicines shall be centered on people's health, adhere to the principles of risk management, whole process control and social ****governance, establish a scientific and strict supervision and management system, comprehensively improve the quality of medicines, and safeguard the safety, efficacy and accessibility of medicines.
Article 4 The State develops modern and traditional medicines, giving full play to their role in prevention, medical treatment and health care. The State protects the resources of wild medicinal herbs and varieties of Chinese medicines, and encourages the cultivation of authentic Chinese medicinal herbs.
Article 93 The State implements a system of essential medicines, selects an appropriate number of varieties of essential medicines, strengthens the organization of production and stockpiling, improves the supply capacity of essential medicines, and meets the basic needs for medicines for the prevention and treatment of diseases.
