Implementing Rules for the Measures for the Relief and Administration of Vagrants and Beggars without a Means of Subsistence in Cities

Article 1: In accordance with the provisions of the Measures for the Administration of Rescue of Vagrants and Beggars with No Means of Subsistence in Cities (hereinafter referred to as the Measures for the Administration of Rescue), the present Implementing Rules are hereby formulated. Article 2 "rescue management measures" stipulated in the "urban homeless vagrants begging" refers to their own inability to solve the food and lodging, no friends and relatives to rely on, and do not enjoy the urban minimum subsistence guarantee or rural five guarantees of sustenance, is wandering in the city begging for a day's life.

Though the vagrant begging behavior, but does not have the circumstances specified in the preceding paragraph, is not a rescue object. Article 3 Vagrant beggar to the rescue station for help, shall truthfully provide the following information:

(1) name, age, gender, identity card or other documents that can prove identity, the location of my household registration, place of residence;

(2) whether to enjoy the urban minimum subsistence guarantee or rural five guarantees of sustenance;

(3) vagrant begging reasons, (c) the reasons for vagrancy and begging, time and process;

(d) the names, addresses and contact information of close relatives and other close relatives;

(e) the condition of belongings. Article 4 The rescue station shall inform the vagrants and beggars seeking help of the scope of the object of assistance and the implementation of the contents of the assistance, and inquire about the situation related to the need for assistance, and register their personal information. Article 5 the rescue station belongs to the rescue object, shall promptly arrange for rescue; does not belong to the rescue object, not rescue and inform the reasons.

If a person is unable to provide personal information due to old age, infancy, disability, etc., the rescue station shall first provide assistance and then ascertain the situation.

If a person refuses to provide truthful information, he shall not be rescued. Article 6 the recipient shall not carry dangerous goods into the rescue station, the goods with them, in addition to the necessities of life, by the rescue station for safekeeping, to be returned to the recipient when he leaves the station. Article 7 The civil affairs departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government shall formulate a system of work and rest, hygiene and study for the recipients of aid stations. Recipients shall abide by the rules and regulations of the rescue station. Article 8 the rescue station for the recipients of food and accommodation, should be able to meet the basic health and safety needs of the recipients. If a rescue station finds that a recipient has intentionally provided false personal information, it shall terminate the rescue. Article XI of the assisted person to return to the place of permanent residence, place of residence or the unit without transportation costs, by the rescue station issued by the car (boat) vouchers, railways, highways, water transport and other transport units to verify the appropriate public **** transportation. The rescue station shall notify the relatives of the assisted person and the relevant organizations and units in the place where the assisted person is going. Article 12 The rescue station shall determine the rescue period according to the situation of the assisted person, generally not exceeding 10 days; if it is necessary to extend the period due to special circumstances, it shall be reported to the higher civil affairs department for the record. Article 13 For disabled persons, minors or other persons with limited mobility among the assisted persons, the rescue station shall notify their relatives or their units to take them back; if the relatives or their units refuse to take them back, the civil affairs department of the people's government of the province of the place of inflow shall notify the civil affairs department of the people's government of the place of outflow to take them back, and send them to their relatives or their units; if the rescue station of the people's government of the province of the place of inflow notifies the civil affairs department of the provincial people's government of the place of outflow to take them back, and send them to their relatives or their units. Where a person crosses provincial boundaries, the civil affairs department of the people's government at the provincial level at the place of inflow shall notify the civil affairs department of the people's government at the place of outflow to take him back and send him to his relatives or his unit. Article 14 For assisted persons with disabilities, minors and other mobility-impaired persons whose relatives or units cannot be identified, but whose hukou location or place of residence can be identified, the civil affairs department of the people's government at the place of inflow shall notify the civil affairs department of the people's government at the place of outflow of the place of inflow to pick them up and send them to their hukou location or place of residence for resettlement; across the province, the civil affairs department of the people's government at the provincial level at the place of inflow shall notify the Article 15 If a person is unable to recognize his or her own behavior or express himself or herself due to old age, infancy or disability, and thus cannot identify his or her relatives or unit, or his or her hukou or place of residence, the competent civil affairs department at the higher level of the rescue station shall propose a resettlement plan and report it to the people's government at the same level for resettlement. Article 16 If a person receiving assistance voluntarily gives up assistance and leaves the rescue station, he or she shall be informed in advance, and the rescue station shall not be restricted. Minors and other persons incapable of civil behavior and persons with limited capacity for civil behavior shall leave the rescue station with the consent of the rescue station.

The recipient leaves the rescue station without authorization, is regarded as giving up the rescue, the rescue station shall terminate the rescue. Article XVII of the rescue station has been implemented or rescue period expires, the recipient shall leave the rescue station. There is no valid reason for not wanting to leave the rescue station, the rescue station shall terminate the rescue.
