Shanghai urban planning management technical regulations (land use, construction management) (2003)

Chapter I General Provisions Article 1 In order to strengthen the city's urban construction planning and management, to ensure the implementation of urban planning, improve the quality of the urban environment, according to the "People's Republic of China *** and the State of urban planning law", "Shanghai Municipal Urban Planning Regulations" and the Shanghai Municipal Urban Master Plan, the formulation of these provisions. Article 2 These provisions apply to the city within the scope of the various construction projects. ? Construction works within a specific area, the provisions of Chapter VIII of these regulations shall apply. Article 3 The construction of all construction works shall be carried out in accordance with the approved detailed plan; if there is no approved detailed plan yet, it shall be carried out in accordance with the zoning plan of the central city, the master plan of the new town, the master plan of the central town and the provisions of this Regulation.

Preparation of detailed planning involves building management content, shall comply with the requirements of these provisions. Chapter II Zoning Classification and Suitable Scope of Construction Land Article 4 The construction land in the city shall be classified as follows according to the basic principles of its main use and functional zoning, with reference to the "Urban Land Use Classification and Planning and Construction Land Use Standards" (GBJ137-90):

(1) Residential land; ?

(ii) land for public **** facilities; ?

(iii) industrial land; ?

(iv) land for warehousing;?

(v) land for municipal facilities;?

(vi) green land. Article 5 Residential land (R) refers to various types of piece or piecemeal land such as residential districts, residential neighborhoods, residential clusters and unit living areas. Residential land includes residential land, land for public ****service facilities below the level of residential neighborhoods and subdistricts, land for roads and green areas.

(1) The first type of residential land (R1) refers to land with mainly low-rise residences, low building density, high green space rate and good environment;

(2) The second type of residential land (R2) refers to land with mainly multi-storey residences;

(3) The third type of residential land (R3) refers to land with mainly high-rise residences. Article 6 Land for public **** facilities (C), refers to land for administrative, economic, cultural, educational, health, sports, and scientific research and design institutions and facilities at the residential area and above the level of the residential area, excluding land for public **** service facilities in residential land.

(i) land for administrative offices (C1), land for institutions such as administration, parties and organizations;

(ii) land for commercial and financial industries (C2), land for commerce, finance, services, tourism and markets;

(iii) land for culture and recreation (C3), land for facilities for press and publication, cultural and artistic organizations, radio and television, book exhibitions, amusement rides, etc.<

(iv) sports land (C4), land for stadiums and sports training bases, etc., excluding land for sports within schools and other units;

(v) medical and health land (C5), land for medical, health care, sanitation, epidemic prevention, rehabilitation, and first-aid facilities, etc.;

(vi) education, scientific research, and design land (C6), land for higher education institutes and secondary specialized schools, Scientific research and survey and design organizations and other land. It does not include land for secondary schools, elementary school and child care, which shall be categorized as residential land (R). Article 7 Industrial land (M), land for production workshops, warehouses and their ancillary facilities of industrial and mining enterprises.

(1) Industrial land (M1) of the first category, industrial land which is basically free of interference and pollution to the environment such as residential and public **** facilities;

(2) Industrial land (M2) of the second category, industrial land which has a certain degree of interference and pollution to the environment such as residential and public **** facilities;

(3) Industrial land (M3) of the third category, industrial land (M3) which has a serious interference and pollution to the environment such as residential and public **** facilities; and and other environments with serious interference and pollution of industrial land. Article 8 Warehousing land (W), land used for warehousing enterprises such as warehouses, stockyards and packaging and processing workshops and their ancillary facilities.

(1) Land for general warehouses (W1), refers to the land for general warehouses for storing general goods;

(2) Land for warehouses for dangerous goods (W2), refers to the land for specialized warehouses for storing dangerous goods, such as flammable, explosive and highly toxic goods. Article 9 Municipal Utilities Land (U), land for municipal utilities at municipal, district and residential district levels and their attached buildings (including structures, hereinafter the same) and management and maintenance facilities.

(i) supply facility land (U1), land for facilities such as water supply, electricity supply, gas supply and heat supply, excluding land for power plants and gas plants (included in industrial land);

(ii) transportation facility land (U2), land for public **** passenger transportation, freight transportation and other transportation facilities;

(iii) postal and telecommunication facility land (U3), land for postal, telecommunication and other facilities;

(d) land for environmental sanitation facilities (U4), which refers to land for rainwater and sewage pumping stations, sewage treatment plants, and facilities for collecting, stacking, and disposing of fecal waste;

(e) land for construction and maintenance facilities (U5), which refers to land for construction of house building projects, equipment installation projects, municipal projects, landscaping, and underground structures, and other construction, as well as for maintenance and repair facilities;

(F) Land for other municipal utilities (U6), e.g., land for facilities for firefighting and flood control. Article 10 Greenland (G), public **** greenland and production protection greenland (including water within its boundaries) at municipal, district and residential district levels.

(a) public **** green space (G1), open to the public, with certain recreational facilities or decorative role of green space, including various types of parks and street green space;

(b) production and protection of the green space (G2), refers to the green space used for garden production, isolation, sanitation and security protection.
