Chapter I General Provisions

Chapter II Admission and Feeding

Chapter III Dietary Management

Article 12 The weekly recipes shall be adjusted according to the opinions and requirements of the recipients. Chapter IV Services and Nursing Care

Article 14 The homes for the elderly shall make reasonable arrangements for the housing of their dependents. Sanitary isolation shall be carried out for those who have been hospitalized and are suffering from infectious diseases.

Article 15 The homes for the elderly shall provide warm and considerate daily care for their residents, and provide necessary special care for those who cannot take care of themselves.

Article 16 The homes for the elderly shall emphasize affectionate service, provide mental comfort to the recipients, organize learning and recreational activities for the recipients, and implement the democratic and political rights of the recipients.

Article 17 The residents of the homes shall be united in solidarity with each other, pay attention to hygiene, take care of public property, obey the management, and try their best to provide independent services; consciously abide by social morality and the rules and regulations of the homes; and actively take part in productive work and other collective activities.

Chapter V Medical Care

Article 18 The homes for the elderly shall have infirmaries or clinics, with full-time or part-time medical and nursing staff, and shall be equipped with commonly used medicines and basic diagnostic and therapeutic equipment.

Article 19 The infirmary or clinic of the homes for the elderly shall establish health records for the recipients. Relying on local medical institutions, they shall conduct medical check-ups for the recipients once a year, and provide timely treatment for sick recipients.

Article 20 The township finances shall set up special funds, which shall be used exclusively for the expenditure of medical fees for the centralized support of the elderly. Homes for the elderly can also be raised from other sources of medical special funds. Chapter VI Infrastructure

Article 26 The living rooms of the dependent persons shall have good orientation, natural lighting and natural ventilation. In principle, the flat area of the living room is not less than 6 square meters. Room should be equipped with the necessary furniture and daily necessities.

Article 27 The homes for the elderly shall reasonably set up toilets, bathrooms and communal laundry rooms and other public **** hygiene places. The public bathrooms in cottages shall be one for each building, and the public bathrooms in buildings shall be one for each floor, and where possible, bathrooms shall be set up in the apartments as far as possible.

Article 28 The homes for the elderly shall set up public **** recreation, fitness and other activities. Conditional homes for the elderly should be equipped with fitness equipment suitable for use by the elderly.

Article 29 The kitchens of homes for the elderly should be able to meet the needs of the recipients of meals, and should be kept hygienic and clean. There shall be a dining room with tables and chairs to meet the needs of the recipients of meals, and be equipped with facilities for sterilizing cutlery and food preservation equipment.

Chapter VII Sources of Funds

Article 30 The sources of funds for the homes for the elderly include: financial transfers for the centralized support of the five guarantees, special funds arranged by the township financial arrangements, income from social donations, economic income from the homes, and other income.

Article 31 The county finances the five guarantees funds on a monthly basis according to the number of people actually supported by the homes for the elderly, as the living expenses of the five guarantees for centralized support, and set up a special account for management.

Article 32 The township finance shall include the work expenses, personnel expenses, construction expenses and maintenance expenses of the homes for the elderly in the financial budget, and the county finance and the relevant departments shall appropriately subsidize them.

Chapter VIII Production and Operation

Article 33 The homes for the aged shall have the necessary conditions for production and operation, and there shall be a base for planting and raising livestock that can meet the needs of the people they support. Chapter IX Property Management

Article 36 The assets of the homes for the aged shall be managed and used by the homes in accordance with the law, and shall not be appropriated or disposed of at will by any unit or individual. If there are state-owned assets among the assets of the homes for the aged, the disposal plan must be approved and agreed upon by the state-owned assets management department before it can be implemented.

Article 37 The finances of the homes for the elderly shall, in principle, be administered by the township social affairs offices, and the accounting and management, the acquisition and filling out of all kinds of vouchers, the handling of accounts, and the reporting shall be in accordance with the requirements of the "Accounting System for Public Institutions" and the "Norms for Basic Accounting Work".

Article 39 The financial income and expenditures of the homes for the elderly shall be announced to the recipients on a quarterly basis, and shall be subject to the supervision of the supervision and audit departments.

Chapter X: Organization and Construction

Article 40 The homes for the elderly shall implement the presidential responsibility system. Article 42 The main duties of the management committee are: to discuss and adopt major matters of the homes, their rules and regulations, and to supervise their directors, staff members and recipients in their implementation; to discuss, examine and supervise the financial affairs of the homes, and the expenditures on major maintenance and infrastructure projects; to supervise the behavior of the staff members of the homes in their duties; to organize the assessment of the trustworthiness of the directors and staff members; to mediate internal conflicts and disputes among the recipients; and to mediate between the directors and staff members of the homes. Chapter XI Personnel Management

Article 43 The staff of a residential care home for the elderly consists of the director, nursing staff, security staff, financial staff, medical staff and cooking staff. The staff may be full-time or part-time.

Article 44 The staff of the homes for the elderly shall be few and precise. In principle, the staff shall be arranged in the ratio of 1:10, and a strict working system shall be established to specify the duties of each staff member.

Article 45 The directors of the homes for the elderly shall be employed or appointed by the people's governments of the townships, but the opinions of the county civil affairs departments shall be sought. The treatment shall be no less favorable than that of equivalent positions in society.

Article 46 The directors of homes for the elderly shall be subject to both the annual appraisal of the township people's government and the trust assessment of the people supported by the homes. If the annual appraisal is incompetent, the township government shall make adjustments or terminate the employment. Before the dean leaves office, an audit shall be conducted.

Article 47 The other staff of the homes for the elderly shall be appointed by the homes for the elderly. The appointment of the staff of the homes for the aged shall be based on the principles of openness, fairness and meritocracy.

Article 48 An employment agreement shall be signed for the employment of the director and other staff of the homes for the aged.

Article 49 The salary of the director and other staff shall consist of two parts: basic salary and production and operation bonus. The basic salary is determined at the time of appointment (employment), production and management bonus according to the production and operation of the home, in the employment of a clear assessment of the calculation method.

Chapter XII Legal Responsibility

Article 50 The residents of the homes for the aged shall consciously abide by the laws and regulations of the State and the rules and regulations of the homes for the aged, and in case of any violation, the dean or the management committee of the home or the higher-level management organ shall criticize and educate them, and in case of any violation of the law, they shall be investigated and held legally responsible according to the law.

Article 51 If the homes for the aged and their staff members are involved in any of the following cases, the management organ shall, in accordance with its management authority, criticize and educate the persons responsible until disciplinary action is taken against them, and if any of the cases constitutes a violation of the law, they shall be investigated and held legally responsible according to the law:

(a) violating the relevant laws and regulations of the State and infringing upon the lawful rights and interests of those who are provided for;

(b) falsely reporting the number of people provided with support, and fraudulently claiming the funds of the Five Guarantees, medical assistance funds and other financial funds;

(3) Squeezing, embezzling or misappropriating the funds of the home for the aged and encroaching on or illegally disposing of the assets of the home for the aged;

(4) Malfeasance or dereliction of duty resulting in adverse effects or serious consequences.

Chapter XIII Supplementary Provisions

Article 52 These Measures shall be adapted to township homes for the aged. Village-run homes for the elderly with reference to the implementation.
