Article 3: In accordance with the requirements of the government to guide the market, open market transactions, standardized trading operations, and unified supervision of operations, establish a unified tendering and bidding market that is fair and open, has orderly competition, has adequate services, and has strong supervision. Article 4 The Municipal Bidding Supervision and Administration Bureau is responsible for the unified supervision and management of various trading activities, formulating relevant management rules, supervising trading activities, accepting complaints and reports, and investigating and handling illegal activities in trading activities in accordance with the law.
As the city’s unified bidding and bidding trading platform, the Municipal Bidding and Bidding Transaction Service Center is responsible for the operation of specific transactions. After obtaining the corresponding qualifications in accordance with the law, it serves as an agency for public bidding projects that are required by law to act as an agent for bidding matters. Article 5 The following bidding and bidding activities within the urban area of ??this city (including development zones, experimental zones, and Shannan New District) must be conducted at the Municipal Bidding and Bidding Transaction Service Center:

The bidding activities mentioned in the preceding paragraph include transaction method approval, information release, registration acceptance, qualification review, transaction document release (sale), bid evaluation committee formation, bid opening, bid evaluation, etc.
No unit or individual may break projects that require bidding according to law into parts or avoid bidding in other ways. Article 6 The Municipal Bidding Supervision and Administration Bureau shall establish a credit management and disclosure system for relevant parties and practitioners in public resource trading activities. Article 7 For public resource projects that require bidding, the functional departments of the government shall, at the same time as approving the project, approving the land transfer plan, approving the government procurement budget implementation plan, and approving the transfer of state-owned (collective) property rights, submit the approved A copy of the relevant documents shall be sent to the Municipal Bidding Supervision and Administration Bureau. Article 8: No unit or individual may use unreasonable conditions to restrict or exclude potential legal persons, natural persons or other organizations from participating in transactions. For projects that use all state-owned funds or are dominated by state-owned funds, if the tenderer requests to change the bidding and procurement method, the approval procedures must be completed. Article 9: In addition to being released in the media in accordance with national and provincial regulations, public bidding information should also be released on the Municipal Unified Bidding and Bidding Market website.
The content of the bidding announcement for the same bidding project published by the tenderer in two or more media should be the same. Article 10 The Municipal Bidding Supervision and Administration Bureau is responsible for managing the bid evaluation expert database.
Members of the bid evaluation committee shall be randomly selected from the expert database. If a representative of the tenderer of a project subject to public tendering in accordance with the law requests to participate in the bid evaluation committee, it shall be approved by the Municipal Tendering Supervision and Administration Bureau. Article 11: For construction projects that are subject to public bidding according to law, the effective lowest price will be used to win the bid, and for transfer projects and leasing projects, the effective highest price will be used to win the bid. Article 12 The results of the bid evaluation shall be publicized on the Municipal Unified Bidding and Bidding Market website. The tenderer must determine the winning bidder according to the ranking of the winning candidates recommended in the bid evaluation report issued by the bid evaluation committee, and sign a contract with the winning bidder in accordance with regulations. The conclusion and modification of the contract shall be reported to the Municipal Bidding Supervision and Administration Bureau for filing within 5 days. Article 13 Before signing a contract with the tenderer, the winning bidder shall issue a performance guarantee, a low-price risk guarantee, or a performance bond provided by a financial institution to the tenderer. Article 14 After the performance of a government procurement contract, the financial department shall handle the payment procedures for fiscal funds based on the payment notice issued by the Municipal Bidding and Bidding Service Center.
