According to Article 44 of the Labor Law, the specific standard of overtime pay is as follows: if you arrange for a worker to work longer hours on a standard working day, you will be paid not less than 150 percent of your wages; if you arrange for a worker to work on a day off and you cannot arrange for a compensatory break, you will be paid not less than 200 percent of your wages; if you arrange for a worker to work on a statutory day off, you will be paid not less than 200 percent of your wages. If a worker is assigned to work on a statutory day off, he or she shall be paid remuneration of not less than 300 percent of his or her wages. According to the provisions of this article, forcing workers to work overtime in disguise shall be regarded as extending their working hours in violation of the provisions of the Labor Law. The worker may, in accordance with the relevant provisions of the Labor Law and this Law, request the employer to pay him back the wage remuneration for overtime work done to fulfill more than a reasonable number of labor quotas.
If there is a local standard in Wuxi, it cannot be lower than that of the Labor Law, otherwise it is invalid.
