The conditions and procedures required to open a pharmacy are as follows:
1. Personnel and qualifications. To open a pharmacy, it is required to have more than three people, one of whom is a pharmacist or a pharmaceutical technician with the title of Chinese medicine pharmacist or above, and all of them must obtain a pharmacy practitioner's license;
2. If the business premises meet the requirements, the Food and Drug Administration will send approval for the establishment;
3. Business license, including drug business license, business license, tax registration certificate and food hygiene license;
4. Capital reserve;
5. The formalities include the original and photocopy of the academic qualifications, professional qualifications or professional titles of the legal representative, person-in-charge of the enterprise and person-in-charge of quality, and their resumes, professional and technical personnel qualification certificates and letters of appointment, etc.
Article 5 of the Measures for the Administration of Drug Business License
To set up a drug retail enterprise, it should meet the requirements of the number of local permanent residents, region, traffic conditions and actual needs, conform to the principle of facilitating people to buy drugs, and meet the following requirements:
(1) It has rules and regulations to ensure the quality of the drugs it deals in;
(2) having qualified pharmaceutical technicians according to law;
pharmaceutical retail enterprises dealing in prescription drugs and over-the-counter drugs must be equipped with licensed pharmacists or other qualified pharmaceutical technicians according to law. The person in charge of quality should have more than one year (including one year) experience in quality management of drug business.
pharmaceutical retail enterprises dealing in over-the-counter drugs of Class B, as well as pharmaceutical retail enterprises established in rural areas below towns and villages, shall be equipped with business personnel in accordance with Article 15 of the Regulations for the Implementation of the Drug Administration Law, and licensed pharmacists if conditions permit. During the business hours of the enterprise, the above personnel shall be on duty.
(3) The enterprise, its legal representative, the person in charge of the enterprise and the person in charge of quality are not under the circumstances stipulated in Articles 75 and 82 of the Drug Administration Law;
(4) having business premises, equipment, storage facilities and a hygienic environment suitable for the drugs handled. The establishment of retail pharmacies in supermarkets and other commercial enterprises must have an independent area;
(5) having the ability to equip drugs that meet the needs of local consumers, and ensuring 24-hour supply. The number of national essential drugs that drug retail enterprises should have is determined by the food and drug supervision and administration departments of all provinces, autonomous regions and municipalities directly under the Central Government in light of local specific conditions.
if the state has other provisions on dealing in narcotic drugs, psychotropic drugs, toxic drugs for medical use and preventive biological products, those provisions shall prevail.
