District, county (city) sports administrative departments are responsible for the construction and management of sports facilities within their respective administrative regions. Other relevant departments of the municipal, district and county (city) people's governments shall assist the sports administrative departments in the construction and management of sports facilities according to the division of responsibilities. Article 5 The construction and management of sports facilities shall follow the principles of overall planning, adapting measures to local conditions, rational layout, standardization and practicality, convenience to the masses and improvement of use efficiency. Article 6 The municipal, district, county (city) people's governments shall incorporate the planning and construction of sports facilities into the national economic and social development plans; in accordance with the national regulations on the quota quotas for urban public facilities land, public sports facilities shall Facility construction shall be incorporated into urban construction planning and overall land use planning. Article 8: Enterprises, institutions, social groups, individuals, and overseas institutions and individuals that invest in or donate funds to build public sports facilities will be given preferential treatment and rewards. The construction of public sports facilities shall be subject to review and approval by the sports administrative department. Article 9 When building, renovating or expanding residential areas, public sports facilities shall be planned and constructed in accordance with the land use indicators prescribed by the state. The construction of public sports facilities in residential areas should be designed, constructed and accepted simultaneously with the main projects in residential areas; the planning, design and acceptance of public sports facilities in residential areas must involve the participation of the sports administrative department. Article 10: Newly built and expanded schools of all types and levels should construct sports venues in accordance with the standards prescribed by the state. If the sports facilities of the original school do not meet the prescribed standards, measures should be taken to gradually reach the prescribed standards. Article 11: Sports facilities implement a registration system. The property rights unit of sports facilities shall go through the registration procedures for sports facilities with the city or the local district or county (city) sports administrative department. Sports facilities are managed by property rights units. Article 12 The management unit of sports facilities shall establish and improve management systems for the use, maintenance, safety, and sanitation of sports facilities to ensure the integrity and safe use of sports facilities. Article 13 Public sports facilities must be open to the public and provide services for national fitness. Public sports facilities provide free services to disabled people and the elderly on weekends and holidays; provide preferential treatment to students; and provide paid services to others. Article 14 Citizens should take good care of sports facilities and abide by the regulations on the management of sports facilities. Article 15 Those who use sports facilities to carry out business activities must obtain approval from the sports administrative department and register with the industrial and commercial administrative department. No organization or individual may use sports facilities to engage in illegal business activities. Article 16 The use of sports facilities for advertising must comply with the provisions of the Advertising Law of the People's Republic of China, obtain the consent of the sports administrative department, and report to the relevant management department for approval. Article 17 No organization or individual may occupy or destroy public sports facilities. If sports facilities are temporarily occupied due to special circumstances, they must be approved by the sports administrative department and planning department and returned in time. If the use of sports venues is changed in accordance with urban planning, new sites must be selected for repayment in accordance with relevant national regulations. Article 18: No organization or individual may change the nature of use of public sports facilities without authorization. If changes are required due to special circumstances, they must be approved by the municipal sports administrative department and planning department and reported to the Municipal People's Government for approval. Sports facilities invested and constructed by units or individuals must be approved by the registration management department if the nature of use is changed due to special needs. Article 19 Organizations and individuals that have made outstanding achievements in the protection and management of sports facilities shall be commended and rewarded by the municipal, district, county (city) people's governments or sports administrative departments.
Article 20 If, in violation of the provisions of Article 11 of these Regulations, the property rights unit of sports facilities fails to complete the registration procedures with the sports administrative department, the sports administrative department shall order it to register within a time limit. Article 21 Anyone who violates the provisions of Article 15 of these Regulations and uses sports facilities to carry out illegal business activities shall be punished by the relevant departments in accordance with the law. Anyone who uses sports facilities to carry out business activities without approval shall be ordered by the sports administrative department to complete the formalities. Article 22 Anyone who violates the provisions of Articles 17 and 18 of these Regulations by occupying or destroying sports facilities or changing the nature of use of sports facilities without authorization shall be ordered by the sports administrative department to make corrections within a time limit and shall bear civil liability in accordance with the law. Those who violate public security management shall be punished by the public security organs in accordance with the law; if a crime is constituted, criminal liability shall be investigated in accordance with the law. Article 23 If a staff member of the sports administrative department or a public sports facility manager abuses his or her power, neglects his or her duties, engages in malpractice for personal gain, or changes the nature of the use of sports facilities without authorization, causing damage to the sports facilities, the superior authority or the unit where he/she works shall take action against them. The directly responsible managers and other directly responsible personnel shall be given administrative sanctions in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
