Regulations of Heze Municipality on Prevention and Control of Water Pollution

Chapter I General Provisions Article 1 In order to protect and improve the water environment, prevent and control water pollution, ensure water ecological safety, safeguard public health, promote the construction of ecological civilization in Heze, and promote sustainable economic and social development, in accordance with the People's Republic of China (PRC) Environmental Protection Law, the People's Republic of China (PRC) Water Pollution Prevention Law, the Shandong Water Pollution Prevention Regulations and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and control of pollution of surface water bodies and underground water bodies such as rivers, lakes, wetlands, reservoirs, channels, pits and ponds within the administrative area of this Municipality. Article 3 The prevention and control of water pollution should aim at improving the quality of water environment, adhere to the principles of giving priority to prevention, giving priority to protection, comprehensive treatment and bearing the responsibility for damage, give priority to the protection of drinking water sources, strictly control industrial pollution, agricultural non-point source pollution and urban and rural domestic pollution, actively promote ecological control and restoration, and prevent, control and reduce water environmental pollution and ecological damage. Article 4 The people's governments of cities, counties (districts) and towns (townships) shall be responsible for the water environment quality within their respective administrative areas. The people's governments of cities and counties (districts) shall, in accordance with the relevant provisions, formulate plans for the prevention and control of water pollution in their respective administrative areas and incorporate water environmental protection into the plans for national economic and social development, change the mode of economic development, adjust and optimize the industrial structure, promote circular economy and clean production, and protect and improve the quality of water environment.

Water pollution prevention and control planning and implementation plan shall conform to the control requirements of ecological protection red line, and define the water environment quality improvement objectives and index requirements, water environment function zoning and zoning function positioning, pollution prevention and ecological protection measures, pollution control projects, financial and technical support, completion time limit, etc. Fifth city and county (District) people's government department in charge of ecological environment (hereinafter referred to as the competent department of ecological environment) to implement unified supervision and management of the prevention and control of water pollution within their respective administrative areas. Other relevant departments shall, in accordance with laws and regulations, do a good job in the prevention and control of water pollution within their respective functions and duties.

In areas where comprehensive administrative law enforcement is implemented, administrative penalties related to the prevention and control of water pollution and administrative coercion related to administrative penalties shall be implemented by comprehensive administrative law enforcement departments according to law.

Town (township) people's government, street offices should cooperate with the drinking water safety, agricultural and rural water pollution prevention, environmental infrastructure construction and operation and other related work.

Enterprises, institutions and other producers and operators that directly or indirectly discharge water pollutants shall bear the main responsibility for water pollution prevention and control, establish and improve the water environment protection management system, disclose water environment information according to law, ensure the normal operation of water pollution prevention and control facilities and stable discharge up to standard, and prevent and reduce water environment pollution and ecological damage. Article 6 The people's governments of cities and counties (districts) shall establish working mechanism, emergency mechanism and joint meeting system for comprehensive improvement of water environment, organize, lead and coordinate water pollution prevention and emergency work within their respective administrative areas, and solve major problems in water pollution prevention and control. Article 7 The people's governments of cities, counties (districts) and towns (townships) shall increase financial input for the prevention and control of water pollution. It will provide financial support for the operation of domestic sewage treatment, sludge treatment and disposal, river regulation, drinking water source protection, water ecological restoration, emergency cleaning and other projects, as well as the classification of environmental supervision capacity building.

City, county (District) people's governments and their competent departments of ecological environment and other relevant departments can guide various market players to carry out water pollution control and water ecological restoration, water pollution prevention facilities construction and operation, water pollution prevention technology evaluation and other services through bidding and entrustment, so as to promote water pollution prevention and control in a market-oriented way. Encourage financial institutions to provide credit support for market-oriented water pollution control projects. Encourage the development of financing leasing business of pollution control equipment. Promote pledge financing guarantees such as equity, project income rights, franchise rights and emission rights. Encourage the adoption of environmental performance contract services, granting development and management rights, etc. Increase the investment of social capital in water environmental protection. Eighth city, county (District), town (township) people's governments and neighborhood offices and relevant departments should strengthen publicity and education on water environmental protection, popularize relevant scientific and technological knowledge, and raise public awareness of water environmental protection.

The news media should increase the publicity of laws, regulations and related policies on water pollution prevention and control, advocate green and low-carbon production, life and consumption patterns, and strengthen public opinion supervision on behaviors that damage the water environment.

Encourage and support scientific and technological research on water pollution prevention and control, popularize and apply advanced water pollution prevention technology and equipment, and improve the level of water pollution prevention and control.

Encourage citizens, legal persons and other organizations to participate in water environmental protection activities through donations, funding and voluntary services, and support water environmental protection public welfare undertakings. Article 9 The government implements a reward reporting system for violations of water environmental pollution, and rewards those who report and verify that they are true, and keeps the information of informants confidential. Incentive measures shall be formulated by the Municipal People's government.

City and county (District) people's governments and their competent departments of ecological environment may, in accordance with the provisions of relevant laws and regulations, commend units and individuals that have made remarkable achievements in water pollution prevention and water environmental protection. Chapter II Supervision and Management Article 10 The people's governments of cities, counties (districts) and towns (townships) shall establish and improve the system of river length and lake length, organize and lead the work of water resources protection, water shoreline management, water pollution prevention and control, water environment management, water ecological restoration, law enforcement and supervision within their respective administrative areas at different levels, segments and regions, and ensure water quality improvement and water ecological safety.

The people's governments of cities, counties (districts) and towns (townships) shall establish a meeting system for river chiefs and lake chiefs, an information sharing system and a work supervision system, coordinate and solve key and difficult problems in the management and protection of rivers and lakes, regularly inform them of the management and protection of rivers and lakes, and urge them to implement the system and perform their duties.
