General principles
Article 1 In order to strengthen the management of the computerized welfare lottery betting stations in our province, and to ensure that the sales of computerized welfare lottery tickets (hereinafter referred to as "lottery tickets") are carried out in a normal manner, the provisions of the Interim Measures for Lottery Issue and Sales Management of the Ministry of Finance are hereby formulated.
The second rule of the lottery is to manage the betting centers of computerized welfare lotteries in the province.
Second, the Guangdong Welfare Lottery Distribution Center (hereinafter referred to as the "provincial center") is responsible for the management and supervision of computerized welfare lottery betting stations in the province, and authorizes the welfare lottery distribution centers of municipalities at and above the local level (hereinafter referred to as the "city center") to manage the computerized welfare lottery betting stations in their respective areas in accordance with these measures.
Article 3 The staff of welfare lottery centers at all levels in Guangdong Province, and the persons in charge of all computerized welfare lottery betting centers and salespersons must abide by these measures.
Chapter II: Conditions and Procedures for Applying for the Establishment of Betting Centers
Article 4: Conditions for Applying for the Establishment of Betting Centers
(1) Enterprises, institutions, social organizations and private non-enterprise units with legal personality or individuals who have a permanent household registration in Guangdong Province, who are over 18 years of age, who are in full possession of the capacity for civil rights and behavior, and who have an education level of high school or above.
(2) The unit or individual applying for the establishment of a betting center must specify the mode of operation of the betting center (whether it specializes in Welfare Lottery or also operates other lotteries).
(3) The entity or individual applying for the establishment of a betting center must submit a market feasibility analysis report of the site under application.
(d) The entity or individual applying for the establishment of a betting center must be directly involved in the operation and management of the betting center, and must have sales personnel specializing in the sale of welfare lottery tickets. Betting centers may not be transferred or subcontracted.
(5) The unit or individual applying for the establishment of a betting center must have the ownership, right of use or lease right of the betting center site, and may not use the temporary construction of houses, tin roofs and leased demolition of the house as a dedicated betting center site, the area of the Welfare Lottery betting center shall not be less than 10 square meters in principle.
(6) The distance between welfare lottery betting stations: cities (including county towns) should not be less than 500 meters in principle; townships in developed areas can set up betting stations in accordance with urban standards, and townships and villages in underdeveloped areas can set up betting stations based on the density of the population and the state of economic development.
(VII) apply for the establishment of betting stations units or individuals must have a registered address in the city where the application for betting stations can provide a guarantee according to law units or local permanent residence, 18 years of age or older, with full civil rights and behavioral capacity, the ability to have the economic capacity of the individual economic guarantee.
Article V Procedures for the Establishment of Betting Stations
(1) The plan for the establishment of betting stations in each city shall be reported to the provincial center for the record of the third department of the market, and the provincial center shall issue the betting machines, "sales permits" and "salesman induction certificates" according to the plan reported by the city centers.
(2) Any unit or individual in line with Article 4 of these measures, in writing to the location of the city center to apply. The applicant must provide the city center with his or her own valid identification documents, household registration, educational certificates, information on the guarantor and information on the address where the betting station is intended to be opened, the real estate license or lease agreement. After the initial review of the city center agreed to set up the betting station, must be provided by the province, the city center of the betting station design pattern for decoration (cost by the betting station at their own expense); betting station decoration by the city center to meet the requirements of the inspection, before the official approval of the establishment of the city center.
(3) The unit or individual approved to set up a betting station shall pay a deposit of RMB 10,000 yuan for each betting machine (which is uniformly submitted to the deposit account of the Provincial Department of Finance as a deposit for delinquency or refusal of payment of lottery sales by the betting machine and betting station), and shall sign a "Guangdong Provincial Computerized Welfare Lottery Sales Contract" with the city center. After signing the "Guangdong Province Computerized Welfare Lottery Sales Contract" with the city center, the city center will assist the betting station to open a special lottery sales line (at the betting station's own expense); at the same time, the betting station must participate in the province's unified property insurance for betting machines (at the betting station's own expense).
(4) The person in charge of the betting station approved for establishment and the salesperson must accept the business training of the city center and pass the examination before issuing the betting machine, sales license and salesperson's induction card to start selling lottery tickets.
(5) The city center can set up betting centers in accordance with the local practice through public solicitation and bidding from the society.
Chapter III Sales, Redemption, Settlement, Equipment and Records Management
Article 6 Sales Management
(1) Betting centers must abide by the "Guangdong Provincial Computerized Welfare Lottery Betting Stations Staff Code", and operate the betting machines in strict accordance with the "Hotline Betting Machines User's Manual".
(2) Betting centers must sell lottery tickets in accordance with the time agreed in the Sales Contract of Guangdong Computerized Welfare Lottery, and may not close down without the approval of the city center during the holiday period (except for the city break).
(3) Lottery tickets are denominated in RMB and sold at face value, premium or discount sales are strictly prohibited.
(4) Tickets printed incompletely and unclearly by betting centers are regarded as invalid tickets and shall not be sold to bettors and shall be corrected in the city center with invalid tickets (except for those with no password line) before the closing of the current period of sale.
(5) It is strictly prohibited to sell tickets printed by foreign tickets, offshore tickets or tickets printed by other betting centers; it is strictly prohibited to print local tickets for sale in foreign countries and other betting centers; and it is strictly prohibited to sell expired tickets.
(6) It is strictly prohibited to charge bettors any fees other than the purchase price of the tickets, to force bettors to purchase tickets or to defraud bettors during the sales process, or to promote other products in the name of selling lottery tickets.
(7) It is strictly prohibited to use the betting centers as a cover for selling "private lottery", illegal publications or other activities that are in conflict with national laws and regulations.
(viii) It is strictly prohibited to sell lottery tickets to minors under the age of 18.
Article 7: Redemption Management
(1) The winning ticket is the only proof of redemption and is valid for redemption for the current period, and redemption of prizes begins on the day following the draw (for details of redemption periods, please refer to the relevant methods of various lottery games), and cannot be redeemed after the expiration date and is considered to be forfeited; and if the winning ticket cannot be correctly identified due to defacement, damage or alteration, the winning ticket cannot be redemptioned, and it is treated as forfeited.
(2) The hotline sales system for prize redemption is implemented throughout the province, and betting centers are responsible for the redemption of low prizes and other prizes for all kinds of lottery tickets (see the relevant methods for all kinds of lottery games for specific requirements), and shall not refuse to redeem prizes or delay the redemption of prizes for any reason.
(3) The winning amount of the winning ticket is subject to confirmation by the betting machine. The betting center shall not cheat the winners by fraudulently claiming the prize money or underpaying the prize money.
(4) The prize money of the betting center shall be paid by the betting center from the sales money of the current period, and when the prize money to be paid exceeds the sales money, the exceeding part may be deducted from the sales money of the next period; meanwhile, the betting center shall have a reserve fund for the redemption of prizes by the lottery players.
(5) The betting center must recover the tickets that have been cashed in when they are processed for redemption, and organize and save the winning tickets that have been cashed in for 90 days in categories, phases, and prizes for inspection, and may destroy them themselves after the retention period has expired. If a betting center causes the loss of a ticket that has been cashed during the redemption period, the betting center bears full responsibility for any economic disputes caused.
Article VIII: Settlement management of sales money and handling fee for selling lottery tickets
(1) The betting centers must deposit the lottery sales money payable into the special savings account designated by the provincial center according to the requirements of the provincial and city centers, and the banks are entrusted by the provincial centers to make unified deductions.
(2) The formula for calculating the amount payable by the betting center for each period of lottery sales is as follows:
The amount payable for lottery sales in the current period = sales in the current period - the amount of redemption of lottery prizes
(3) Except for special circumstances, the city center shall pay the lottery sales handling fee payable by the betting center for the previous month before the 15th day of each month.
Article IX Management of Betting Equipment
(1) Betting machines are special equipment used for the sale of lottery tickets, and may not be used for any other purpose; they may not be disassembled or their parts replaced without authorization; and the programs and relevant data files loaded inside the machines may not be accessed, modified or copied.
(2) The personnel of the betting center must take care of the equipment, and effectively achieve the "eight prevention": anti-theft, fire, lightning, sun, moisture, dust, shock, and anti-magnetic.
(3) The failure of the betting machine or the loss of the betting machine should be promptly reported to the city center. The failure of the betting machine by the city center or the betting machine supplier is responsible for the maintenance, the betting station shall not be unauthorized to deal with the failure of the betting machine.
(4) The damage to the betting machines caused by the mismanagement of the betting centers should be compensated for the corresponding losses, and the loss of the betting machines must be compensated for at the cost price of RMB 13,000 per unit.
(5) The economic losses and responsibilities arising from the loss of a betting machine in a betting center shall be borne by the betting center in addition to the compensation paid by the insurance company in accordance with the regulations.
Article X file management
The city center of the betting center on the implementation of the file management system, each betting station to establish a file, the betting station number, address, contact phone number, the person in charge of the basic situation of the salesman, business training and assessment of the annual rewards and penalties, and so on for the record.
Article XI of the betting station migration and personnel replacement management
(a) betting station without the approval of the city center, shall not change the sales address, due to special circumstances need to migrate, must be reported to the city center for approval to submit to the provincial center of the market for the record of the Department of the three before the relocation of the address, and in the original betting station to post a notice.
(2) betting stations to replace the salesman, must be reported in advance by the city center for the record, the city center is responsible for the training, after the examination, after receiving the certificate of duty to sell lottery tickets.
Chapter IV Penalties and Rewards
Article 12 The province and the city center have the right to penalize the offending betting stations in accordance with these administrative measures. The penalties imposed by the city center on the betting stations shall be reported in writing to the Third Department of Market of the provincial center for record.
Article 13 The provincial and city centers shall suspend the sale of lottery tickets for one to seven days in accordance with the severity of the following circumstances in the betting stations.
(1) violation of Article 6 (1) to (4) and (8) of these Regulations;
(2) refusal to handle prize redemption for the winner by the bettor's complaint;
(3) failure of the betting station to pay the full amount of the current period's payable lottery ticket sales money on time;
(4) violation of Article 9 (1) to (3) of these Regulations;
(5) (E) Diversion of thermal paper lottery tickets, betting slips and promotional materials for other purposes or causing serious waste;
(F) Disobedience to the management of the city center (e.g., failure to implement the documents and notices of the city center, failure to participate in the meetings, trainings, and promotional activities according to the requirements of the city center, and failure to report the change of salespersons to the city center for the record, etc.).
Article XIV of the suspended betting stations must be timely rectification, rectification to the city center to apply for inspection, the city center inspection through the provincial center of the market to apply for the resumption of the right to sell lottery tickets.
Article 15 The provincial and city centers have the right to cancel the lottery sales qualification of betting centers under the following circumstances.
(1) If the situation in Article 13 occurs more than three times within one year, and it still refuses to correct the situation after criticism and education;
(2) If it violates the situations in (2), (4) and (5) in Article 4 of these Measures;
(3) If it violates the situations in (5) to (7) in Article 6 of these Measures (if the situation is serious enough to violate the laws and regulations of the state, then it will be transferred to the judicial organs for handling)
(d) fraudulent claiming of prizes or underpayment of prizes and other acts of cheating winners;
(e) unauthorized change of sales address without the approval of the city center;
(f) not according to the requirements of the province and the city center of the unified specification of the decorations, the city center issued a written notice of rectification is still ineffective;
(g) the betting station staff poor service attitude, within a year by the The city center investigation and verification, after issuing a written notice of rectification is still ineffective;
(viii) low sales, was included in the local final elimination range after rectification is still ineffective. The city center to rectify the betting station to be issued in advance written "rectification notice", and handle the delivery procedures.
Article XVI of the betting stations shall not default or misappropriation of lottery sales, otherwise, suspend or cancel its sales qualification, the deadline for the recovery of the default or misappropriation of lottery sales, the circumstances are serious, the transfer of judicial organs to pursue their legal responsibilities.
Article 17 The betting centers that have been disqualified from selling lottery tickets shall be processed according to Article 20 of these Regulations.
Article 18 The betting stations with no violation records throughout the year are eligible to participate in the selection of excellent betting stations at the national, provincial and municipal levels, and the provincial and municipal centers will recognize and reward the excellent betting stations.
Article 19 The person in charge of the betting station and the salesman actively put forward rationalization suggestions for the welfare lottery cause, which are adopted by the province and the city center, and the province and the city center will commend and reward them.
Chapter V Termination of Betting Stations
Article 20 When a betting station terminates the sale of lottery tickets, it shall go to the city center for termination of the sales procedures. The betting center shall return the deposit (without interest) to the betting center and terminate the sales contract within ten working days after the betting center settles the sales payment with the city center within seven working days and returns the betting machines, sales licenses, induction certificates, remaining thermal paper lottery tickets, betting slips, and removes the original signboards and logos related to the welfare lotteries such as "Nan Yue Fung Choi". The center will return the deposit (without interest) to the betting center within ten working days and cancel the sales contract. If the betting center owes money or damages the betting machines, the city center will deduct the compensation cost from the deposit, and the betting center will still bear the shortfall.
Chapter VI Supplementary Provisions
Article 21 The city center from the local actuality, with reference to the implementation of the implementation of the rules of the management of betting stations (methods), reported to the provincial center for the record before coming into force.
Article 22 The interpretation of these measures belongs to the Guangdong Provincial Welfare Lottery Distribution Center.
Article 23 These Measures shall come into effect on August 1, 2005. In case of any conflict between the management regulations of betting centers and these Measures, these Measures shall prevail.
