Lawful. Article 163 of the Criminal Law of the People's Republic of China*** and the State of China stipulates that a staff member of a company, enterprise or other unit who takes advantage of the convenience of his position and solicits other people's property or unlawfully accepts other people's property for the benefit of other people, if the amount is larger, he shall be sentenced to fixed-term imprisonment of less than five years or detention; if the amount is huge, he shall be sentenced to fixed-term imprisonment of more than five years, and he may be punished with confiscation of property.
Staff members of companies, enterprises or other units:
If, in the course of economic transactions, they take advantage of the convenience of their positions and, in violation of the state regulations, accept kickbacks or fees of all kinds under various names, which are returned to their personal ownership, they shall be punished in accordance with the provisions of the preceding paragraph.
Persons engaged in official duties in state-owned companies, enterprises or other state-owned units and those appointed by state-owned companies, enterprises or other state-owned units to engage in official duties in non-state-owned companies, enterprises and other units who commit the acts in the preceding two paragraphs shall be convicted and punished in accordance with the provisions of Articles 385 and 386 of this Law.
