Article 39 of the operator does not implement the government-guided price, government pricing, as well as the statutory price intervention measures, emergency measures, shall be ordered to rectify, confiscate the illegal income, and may also impose a fine of up to five times the amount of the illegal income; there is no illegal income, may be imposed a fine; the circumstances of the case, may be imposed a fine. If there is no illegal income, a fine may be imposed; if the circumstances are serious, the company shall be ordered to suspend business and reorganize.
Article 40 If an operator commits any of the acts listed in Article 14 of this Law, he shall be ordered to make corrections, confiscate the illegal income, and may be fined not more than five times the amount of the illegal income; if there is no illegal income, he shall be warned, and may be fined; if the circumstances are serious, he shall be ordered to suspend his business and rectify the situation, or his business license shall be revoked by the administrative organ for industry and commerce.
If the relevant laws provide otherwise for the penalties for the acts listed in Article 14 of this Law and the authorities to impose such penalties, they may be implemented in accordance with the provisions of the relevant laws.
Acts listed in Article 14 (1) and (2) of this Law, belonging to the national, the State Council price authorities; belonging to the provinces and sub-provincial regional, by the people's governments of the provinces, autonomous regions and municipalities directly under the Central People's Government price authorities.
Article 41 operators due to price violations resulting in consumers or other operators overpayment of the price, shall refund the overpaid portion; causing damage, shall bear the liability for compensation in accordance with the law.
Article 42 of the operator violates the provisions of the price indication, shall be ordered to correct, confiscate the illegal income, and may be fined not more than five thousand yuan.
Article 43 of the operator is ordered to suspend the relevant business and does not stop, or transfer, concealment, destruction of property registered and kept in accordance with the law, shall be sentenced to the relevant business income or transfer, concealment, destruction of property value of more than double or triple the following fine.
