Article 1 In order to ensure the implementation of the master plan of Haikou Bonded Area (hereinafter referred to as the Bonded Area), these Measures are formulated in accordance with the Urban Planning Law of the People's Republic of China (PRC) and relevant state regulations. Article 2 The land use and various constructions in the Bonded Area shall conform to the requirements of the Haikou Urban Master Plan, the Technical (Interim) Provisions for the Administration of Haikou Urban Planning and the Detailed Controlling Plan of the Haikou Bonded Area. Article 3 The Planning, Construction and Land Management Bureau of the Bonded Area shall be responsible for the planning and construction management within the Bonded Area, and shall accept the supervision and guidance of the Haikou Municipal Planning Bureau in its operation. Article 4 The planning of the bonded area shall be prepared by the Administrative Committee of the Bonded Area (hereinafter referred to as the Administrative Committee) and shall be implemented after approval by the People's Government of Haikou City. Article 5 Any unit applying for land use in the bonded area must apply for the construction land use planning permit and land use certificate at the Planning, Construction and Land Management Bureau of the bonded area with valid construction project approval documents and land transfer contracts, and the Planning, Construction and Land Management Bureau of the bonded area shall go to the site of the land use to carry out the line-laying and staking. Article 6 No unit shall arbitrarily change the nature of land use in the Free Trade Zone. If there is a need to change the nature of land use of the land which has been granted the right to use due to the need of construction, the unit shall apply to the Planning and Construction Land Management Bureau of the Free Trade Zone for approval, and then the application shall be processed in accordance with the provisions of Article 5 of the present Measures. Article 7 For new construction, expansion and alteration of various buildings, structures, roads, pipelines and other engineering facilities in the Free Trade Zone, the construction unit shall apply to the Planning and Construction Land Management Bureau of the Free Trade Zone with the construction land use planning permit, land use certificate and other relevant approval documents, and the Planning and Construction Land Management Bureau of the Free Trade Zone shall issue the temporary construction project planning permit after examination and approval. The construction unit shall not start the construction procedure until it obtains the temporary construction project planning license. Article 8 After the completion and acceptance of the construction project, the construction unit shall hold the temporary construction project planning permit and the certificate of completion and acceptance of the construction project to the Planning, Construction and Land Management Bureau of the Free Trade Zone for the replacement of the construction project planning permit. Article 9 The construction unit shall apply for the property license at the Planning, Construction and Land Administration Bureau of the Bonded Area with the construction project planning license and relevant documents issued by the Planning, Construction and Land Administration Bureau of the Bonded Area. Article 10 The construction of engineering pipelines within the bonded area shall be approved by the Administrative Committee; those crossing the boundaries of the bonded area shall be handled in accordance with the relevant regulations. Article 11 In case of temporary land use and temporary construction within the bonded area, the construction or use unit shall go to the Land Administration Bureau of Planning and Construction of the Bonded Area to apply for the corresponding formalities. The period of use of temporary buildings generally shall not exceed two years. It is prohibited to construct permanent buildings, structures and other facilities within the temporary land.
Temporary land and temporary construction shall be dismantled within the approved period of use and the site shall be cleaned up according to the requirements of the Planning, Construction and Land Management Bureau of the Free Trade Zone.
Temporary sites and temporary constructions are not allowed to be sublet, sublet or change the nature of use. Article 12 The Planning, Construction and Land Administration Bureau of the Bonded Area shall be responsible for the monitoring and handling of illegal and unauthorized constructions in the Bonded Area. Article 13 These Measures shall be interpreted by the People's Government of Haikou City. Article 14 These Measures shall be implemented from the date of promulgation.
