According to Article 65 of the Regulations on the Supervision and Administration of Medical Devices in People's Republic of China (PRC), medical institutions and operators shall stop using and destroying expired medical devices, and notify the food and drug supervision and administration departments of provinces, autonomous regions and municipalities directly under the Central Government orally and in writing, and record the punishment.

For medical institutions and operators who find that medical devices are out of date, the food and drug supervision department will usually order rectification and may give corresponding administrative penalties such as fines.
