(3) Promotion of innovation and development-oriented. The scope of this classification is limited to invention patents that have been substantially examined by the patent administrative department under the State Council and have a higher level of innovation, and utility model patents and design patents are not included. Meanwhile, with reference to the Classification of Strategic Emerging Industries (2018), Classification of High-Tech Industries (Manufacturing) (2017) and Classification of High-Tech Industries (Services) (2018), industries with high R&D input intensity are included in the scope of this classification.
(4) Taking internationally recognized classification methods as reference. This classification draws on the measurement methods of the United States and the European Union on intellectual property (patent)-intensive industries, focuses on invention patents, and determines the scope of industries and corresponding industry categories based on the results of statistical data measurement. IV. Classification Methodology
Intellectual property (patent)-intensive industries should have at least one of the following conditions:
1. The scale[1] and intensity[2] of invention patents in the industry are higher than the national average;
2. The scale and intensity of invention patents in the industry and the intensity of R&D inputs[3] are higher than the national average, and it belongs to the strategic emerging industries, high-tech manufacturing industry, high-tech service industry;
3. The industry invention patent intensity and R&D input intensity are higher than the national average, and belong to strategic emerging industries, high-tech manufacturing industry, high-tech service industry.
For industrial industries, the national average in the above conditions refers to the national industrial average.
[1] The scale of invention patents refers to the sum of the number of invention patents authorized during the consecutive five-year period.
[2] Invention Patent Intensity refers to the number of invention patents granted to a unit of employed persons during a consecutive five-year period, i.e. the ratio of the invention patent scale to the average annual number of employed persons during the same period.
[3] R&D investment intensity, refers to the ratio of the enterprise's R&D expenditure to its main business revenue.R&D refers to the creative, systematic work carried out to increase the stock of knowledge (which also includes knowledge about human beings, culture, and society) as well as to devise new applications of existing knowledge. This classification adopts the line classification method and hierarchical coding method to divide intellectual property (patent) intensive industries into two layers, which are represented by Arabic numerical codes.
