Measures of Guiyang Municipality on the Administration of Municipal Engineering Facilities

Chapter I General Provisions Article 1 In order to keep municipal engineering facilities intact, give full play to their use efficiency, maintain a clean and tidy city appearance, and ensure traffic safety and smooth drainage, this Law is formulated in accordance with the Conditions for the Administration of Road Traffic in People's Republic of China (PRC) and the Regulations on the Administration of Municipal Engineering Facilities of the former Ministry of Urban and Rural Construction and Environmental Protection, and in combination with the situation of this Municipality. Article 2 These Measures shall apply to the municipal public works facilities in the following cities:

(1) Urban roads: main roads, branch roads, small streets and alleys, sidewalks, public squares, public parking lots, street clearing, shoulders and their ancillary facilities;

(2) Urban drainage facilities: rainwater pipes, sewage pipes, rainwater and sewage confluence pipes, open channels, culverts, drainage ditches, pumping stations, sewage treatment facilities, grit chambers, inspection wells and other ancillary facilities;

(3) Urban bridges and culverts: bridges, culverts, overpass bridges, footbridges, underground passages and their ancillary facilities;

(4) Urban lighting facilities: lighting facilities in urban roads, bridges, footbridges, underpasses, squares and public green spaces (excluding parks). Article 3 The people of the whole city shall establish a good habit of caring for municipal public facilities, have the obligation to protect municipal public facilities, and have the right to stop and report acts that damage municipal public facilities. Chapter II Division of Management Article 4 The municipal engineering facilities shall be managed in a unified way and managed by different levels and departments. Article 5 The Municipal Public Utilities Bureau is the functional department of the municipal government for the unified management of municipal engineering facilities in the whole city, and its directly affiliated units are responsible for the maintenance, repair and management of urban trunk roads and their ancillary facilities, street lamps and other public lighting facilities and drainage facilities. Sixth district urban construction departments and sub-district offices shall be responsible for the maintenance, repair and management of small streets and alleys and their affiliated municipal facilities in accordance with the division of responsibilities stipulated by the district government. Article 7 With the approval of the municipal government, markets, public squares and public parking lots set up by urban roads and municipal facilities shall be maintained, repaired and managed by charging units. Article 8 Municipal facilities such as non-public roads, bridges, drainage ditches, etc. in cities shall be maintained, repaired and managed by property rights units, and shall be subject to the supervision and inspection of municipal facilities management departments of cities and districts. Chapter III Road Management Article 9 The Municipal Public Security Bureau is responsible for the unified management of urban and rural road traffic in the city, and the main road traffic in the city is managed by the Municipal Traffic Police Detachment; Road traffic in small streets and alleys is managed by the urban public security bureau; Suburban road traffic is managed by Suburban Public Security Bureau. Tenth city roads should always be kept intact, clean and smooth, and all units and individuals must abide by the following provisions:

(a) without the approval of the public security department, no unit or individual may occupy the road to set up stalls, park vehicles, pile up goods, set up scaffolding, build houses, conduct fair trade and other activities that hinder traffic. Occupation of urban roads and municipal facilities to set up markets must be approved by the municipal government.

(two) it is forbidden to burn, smash, crush, bubble and other activities that corrode, drag, damage and pollute roads.

(three) without the approval of the public security department, motor vehicles are prohibited from entering sidewalks and squares. Motor vehicles are prohibited from trying to brake and conducting driver training activities on non-designated roads.

(four) without the approval of the public security department and the municipal administration department, it is forbidden for iron-wheeled vehicles and tracked vehicles to drive on urban roads.

(five) it is forbidden to dig ditches on urban roads to divert water, pile up crops, dump garbage, waste soil, sewage and other wastes.

(6) Without the consent of the public security, landscape and municipal administration departments, it is not allowed to plant street trees, hedges, flowers and trees on the road, and it is not allowed to set up billboards and pipelines crossing the road; Street lamps, light signals and traffic signs shall not be blocked, which will hinder the safe sight distance and the passage of vehicles and pedestrians. Eleventh where the new construction, renovation, relocation and maintenance of engineering facilities and greening must temporarily occupy and dig roads, it shall be handled in accordance with the following provisions:

(a) the application, approved by the public security department, to the municipal engineering management department to pay the occupation excavation fee, and then to the public security department to receive the "occupation excavation permit", before construction. Due by the charging unit is responsible for the repair.

(2) During the construction of road excavation project, the occupation excavation permit shall be hung at the construction site for inspection.

(three) after the completion of the road excavation project and the demolition of the road, the occupying excavation unit shall notify the municipal engineering management department for acceptance within 48 hours.

(4) When excavating roads, in case of underground pipeline equipment, surveying markers, fire hydrants, overhead poles, drainage ditches, cultural relics and all underground and above-ground facilities, the road excavation unit shall contact relevant units to cooperate and properly protect them. Twelfth when digging roads, the following traffic safety measures should be taken:

(1) Fences and warning signs should be set around the construction site, and red flags should be hung at night (in foggy days).

(2) Measures should be taken to ensure the safe passage of vehicles and pedestrians at the entrances and exits of houses along intersections and roads.

(3) Trench excavation at intersections and crossing roads shall be carried out in half according to the road width, and at night if necessary. Thirteenth in case of emergency repair, emergency rescue and disaster relief of underground pipelines such as tap water pipelines, the construction can be carried out first, and the emergency excavation procedures must be completed within 24 hours.
