Measures for the Administration of Nursing Institutions

Article 1? In order to standardize the management of senior care institutions and promote the healthy development of senior care services, these Measures are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly and relevant laws and administrative regulations.

Article 2? The elderly institutions referred to in these measures refers to the registration in accordance with the law, to provide full-time centralized accommodation and care nursing services for the elderly, the number of beds in more than 10 institutions.

Elderly institutions include for-profit elderly institutions and non-profit elderly institutions.

Article 3? The civil affairs departments of the people's governments at or above the county level are responsible for the guidance, supervision and management of senior care institutions. Other relevant departments are responsible for the supervision of senior care institutions in accordance with the division of responsibilities.

Article 4? Nursing institutions shall carry out service activities in accordance with the laws, regulations and mandatory standards for construction, fire safety, food safety, health care, special equipment.

Elderly institutions and their staff shall, in accordance with the law, to protect the personal and property rights of the elderly admitted to the lawful rights and interests.

Article 5? The elderly and their agents who are admitted to nursing institutions shall abide by the rules and regulations of the institutions and maintain the normal order of service in the institutions.

Article 6? Government-invested nursing institutions shall, on the premise of meeting the needs of special hardship cases for centralized support, give priority to guaranteeing the service needs of widows and orphans, the incapacitated, the elderly, and special family planning families in financial difficulties.

Government-invested elderly institutions can take the entrusted management, leasing and other ways to social forces to operate and manage.
