Application for the qualification of scrap car recycling (dismantling)

According to the provisions of Article 8 of the Detailed Rules for the Implementation of the Measures for the Management of Scrap Locomotive Recycling, the following conditions shall be met for obtaining the qualification of scrap motor vehicle recycling and dismantling:

(1) Having the qualification of an enterprise legal person;

(two) the dismantling business premises meet the overall planning of the city or the land space planning and safety requirements, and shall not be built in environmentally sensitive areas such as residential areas, commercial areas and drinking water source protection areas;

(3) The technical specifications for the site, facilities, equipment, storage and disassembly that meet the national standard "Technical Specifications for Scrap Motor Vehicle Recycling and Dismantling Enterprises" (GB22 128), and the corresponding requirements of professional and technical personnel;

(4) It meets the requirements of the environmental protection standard "Technical Specification for Environmental Protection of Dismantling Scrap Motor Vehicles" (HJ348);

(5) It conforms to the ecological environment protection system stipulated by the state, has corresponding pollution prevention measures, and has a proper disposal plan for the solid waste generated by dismantling.

Article 9? An enterprise applying for qualification identification may apply to the provincial commerce department where the dismantling workplace is located through the "National Automobile Circulation Information Management Application Service" system of the Ministry of Commerce or in written form, and submit the following written materials:

(1) An application report for establishment (which shall specify the name, legal representative, registered capital, domicile, dismantling place, unified social credit code, etc.). The name of the recycling and dismantling enterprise to be established) and the feasibility study report;

(2) Business license of the enterprise;

(3) Articles of association of the enterprise;

(four) the identity card of the legal representative of the enterprise or other valid identity documents;

(5) Land use right, house property right certificate or land lease contract or land use right lease contract or house lease certificate with lease term of more than 10 years;

(6) A list of facilities and equipment purchased or obtained by means of financial leasing for dismantling scrapped motor vehicles and pollution prevention, and ownership certificates such as invoices or financial leasing contracts;

(seven) the approval document of the environmental impact assessment document of the construction project issued by the competent department of ecological environment;

(eight) the list of senior managers and professional and technical personnel;

(nine) enterprise dismantling operation norms, safety regulations and safety standards for solid waste treatment and disposal programs.

Article 10? The provincial commerce department shall review the application materials received, and accept the application for qualification identification if the materials are complete and conform to the statutory form; If the materials are incomplete or do not conform to the statutory form, the applicant shall be informed of the contents that need to be corrected within 5 working days from the date of accepting the application.

The provincial commerce department may entrust the local (city) commerce department where the dismantling business premises are located to examine whether the application materials are complete and conform to the statutory form.

Article 11? After accepting the application for qualification identification, the provincial commerce department shall organize the establishment of an expert group to conduct on-site acceptance examination of the enterprises applying for qualification identification.

The provincial commerce administrative department shall establish an expert database composed of professional and technical personnel in the dismantling of scrapped motor vehicles, ecological environment protection, finance and other related fields, and the number of experts shall not be less than 20. The on-site acceptance review expert group is composed of more than 5 singular experts, randomly selected from the expert database, and should be professionally representative. ?

The expert group shall conduct on-site acceptance review according to the qualification conditions specified in these Rules, and truthfully fill in the "Scoring Opinion Form for On-site Acceptance Review", and the on-site acceptance review experts shall be responsible for the acceptance review opinions.

Article 12? After reviewing the application materials, on-site acceptance evaluation and scoring opinion form, etc. If the Provincial Department of Commerce considers that the application meets the qualification conditions, it shall be publicized on the website of the Provincial Department of Commerce and the "National Automobile Circulation Information Management Application Service" system, and the publicity period shall not be less than 5 working days. During the publicity period, if there is any objection to the application of the publicity enterprise, the provincial commerce department shall organize a hearing and expert re-evaluation according to the needs to verify the objection; If there is no objection to the application of the enterprise, the provincial commerce department will create an enterprise account through the application of the enterprise in the "National Automobile Circulation Information Management Application Service" system, and issue the "Qualification Certificate for Scrap Motor Vehicle Recycling and Dismantling Enterprise" (hereinafter referred to as the "Qualification Certificate"); For those who do not meet the qualification requirements, the provincial commerce department shall make a decision not to recognize the qualification and explain the reasons.

The provincial commerce department shall promptly announce to the public the list of recycling and dismantling enterprises that have obtained qualification certification within their respective administrative areas.

Thirteenth provincial commerce authorities shall complete the examination and make relevant decisions within 20 working days from the date of accepting the application for qualification identification. If a decision cannot be made within 20 working days, the 10 working day may be extended with the approval of the person in charge of the provincial commerce department, and the applicant shall be informed of the reasons for extending the time limit.

The time required for on-site acceptance review and hearing shall not be calculated within the time limit specified in this article.
