Legal analysis: according to the provisions of the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes, hazardous wastes are those included in the national list of hazardous wastes. Legal basis: "National List of Hazardous Wastes"
Article 2 Solid wastes (including liquid wastes) with one of the following circumstances are included in this list:
(a) with one or several hazardous characteristics such as corrosiveness, toxicity, flammability, reactivity, or infectiousness;
(b) not excluded from the hazardous characteristics, which may cause harmful effects on the environment or human health, and need to be exempted from the list. Or human health may cause harmful effects, need to be managed in accordance with the management of hazardous waste.
Article 3 Medical waste is hazardous waste. Classification of medical waste is carried out in accordance with the Classification Catalog of Medical Waste.
Article 4 Chemicals listed in the Catalog of Hazardous Chemicals are hazardous wastes after disposal.
Article 7 The meanings of the relevant terms in this Directory are as follows:
(1) Waste category, which is the classification of hazardous wastes on the basis of the categories delineated in the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal and in the light of the actual situation of China.
(ii) Industry source, refers to the hazardous waste generating industry.
(iii) Waste code, refers to the unique code of hazardous waste, is 8 digits. Among them, bits 1-3 is the hazardous waste generation industry code (based on "National Economic Industry Classification (GB/T 4754-2011)" to determine), bits 4-6 is the hazardous waste order code, bits 7-8 is the hazardous waste category code.
(D) hazardous characteristics, including corrosivity (Corrosivity, C), toxicity (Toxicity, T), flammability (Ignitability, I), reactivity (Reactivity, R) and infectivity (Infectivity, In).
Article VIII of the solid waste is not clear whether the hazardous characteristics, should be identified in accordance with the national provisions of the hazardous waste identification standards and identification methods.
Identified with hazardous characteristics, are hazardous wastes, should be based on its main hazardous components and hazardous characteristics to determine the category of waste, and according to the code "900-000-××" (× × for the category of hazardous wastes code) for categorization and management. Identified as not having hazardous characteristics, is not a hazardous waste.
