Shanxi Province construction project bidding management measures

Chapter I General Provisions Article 1 In order to strengthen the management of construction project bidding, maintenance of the construction market order, to protect the legitimate rights and interests of the parties involved in the bidding, according to the "Shanxi Province, the construction market management regulations" of the relevant provisions of the formulation of these measures. Article 2 The construction works referred to in these measures, refers to a variety of housing construction, civil engineering, wiring, piping and equipment installation works (including all kinds of decoration, renovation works).

The bidding referred to in these measures refers to the survey, design, construction of construction works, through the statutory procedures for the selection of the contractor's activities. Article 3 The bidding and tendering of construction works within the administrative area of this province shall comply with these Measures. Article 4 The construction works shall be tendered in accordance with the following provisions:

Projects with a total investment of more than 800,000 yuan by the government and the national ownership units must be tendered;

Other investment projects, the investor chooses to award the contract by tendering, may be carried out in accordance with these Measures. Article 5 The bidding and tendering of construction projects shall be managed hierarchically in accordance with the following provisions:

(1) the provincial construction administrative department shall manage the key construction projects invested by the state and the province, as well as the industrial and transportation construction projects with a total investment of more than 50 million yuan, and the civil construction projects with a total investment of more than 30 million yuan;

(2) the municipal (local) construction administrative department shall manage the construction of projects in addition to the construction projects of the state and the province. (ii) municipal (prefecture) administrative departments of construction manage construction projects with a total investment of more than 3 million yuan other than those stipulated in item (a) of this Article;

(iii) other construction projects are managed by county (municipal) administrative departments of construction. Article 6 The construction administrative departments of the people's governments at or above the county level, is responsible for preparing the supervision and management of bidding and tendering for construction projects within the scope of the authority of self-administration. Its main responsibilities are:

(a) supervise the implementation of laws, regulations and rules relating to bidding and tendering;

(b) review the qualifications of the bidding units and intermediary service organizations, determine the bidding method, review the tender;

(c) investigate and deal with bidding and tendering of illegal acts.

The bidding and tendering management organization is responsible for the supervision and management of bidding and tendering.

The bidding and tendering for construction works shall be organized and implemented by the construction unit or the competent authority of the construction project. Chapter II Bidding Article 7 Bidding for construction works may be invited by construction project or by unit works. Surveying, design and construction can be bidding separately, or overall bidding. Article 8 The bidding unit shall have the following conditions:

(1) having legal personality;

(2) having economic and technical management personnel and the ability to prepare bidding documents that are compatible with the bidding project.

Where the conditions of the preceding paragraph are not available, the bidding work shall be entrusted to intermediary service organizations with appropriate qualifications. Article 9 The construction projects for which tenders are invited shall have the following conditions:

(1) they have been approved for construction by the state, departments and localities, and the implementation of the construction funds has reached more than 60% of the annual plan;

(2) they have obtained the opinion on site selection, the planning permit for the construction site, the planning permit for the construction project, and they have been approved for the expropriation of land and demolition;

(3) they have undergone the construction report procedures and has received a permit for the contracting of works;

(iv) For the bidding of survey and design projects of construction works, the necessary survey and design information and the approved preliminary design estimate shall also be available. Article 10 The bidding documents shall include the following:

(1) a comprehensive description of the project, including the name of the project, address, bidding items, area of land covered, floor area, technical requirements, quality standards, site conditions, bidding methods, and progress requirements;

(2) necessary information and drawings;

(3) a bill of quantities;

(4) a clear (v) the responsibility of the bidder, the validity period of the bidding;

(vi) the mode of supply of major building materials, equipment, finished products, semi-finished products, quantities, processing and ordering, and their adjustment for price changes;

(vii) the date of publication of the bidding notice and the sale of the bidding documents;

(viii) the requirements of the special works and the technical specifications used (i) qualification requirements for bidders;

(j) requirements for the preparation of bids and principles for evaluating and finalizing bids;

(k) schedules for answering questions, bidding, opening, evaluating, and finalizing bids;

(l) main terms of the contract;

(m) procedures for approving the bidding. Article 11 Bidding for construction works may be carried out in the following ways:

(1) public bidding, where the bidding unit posts or publishes a bidding notice in a fixed place for bidding and tendering by means of newspaper, radio or television;

(2) inviting bidding, where the bidding unit sends out invitations for bidding to more than four surveying, designing or constructing units whose qualifications are in line with the requirements of the project;

(3) Negotiated bidding, not suitable for public bidding, invitation to bid or public bidding has not been successful, in order to implement the negotiated bidding, but the bidding unit shall not be less than two. Article 12 Bidding procedures:

(1) the bidding unit issued a bidding notice or issued a bidding invitation, the bidding unit to apply for bidding;

(2) the bidding unit to review the qualifications of the bidding unit, the distribution of bidding documents and design drawings, technical information, etc.

(3) the bidding unit to organize the bidding unit on-site survey, bidding for the answer to the questionnaire;

(4) The bidding unit establishes a bid evaluation organization, formulates methods for evaluating and determining bids, and examines bid proposals;

(e) the bidding unit holds a bid opening meeting and announces the bidding price;

(f) the bidding unit organizes the evaluation of bids, and determines the winning unit;

(g) the bidding unit sends out the verified notification of winning bids;

(h) the bidding unit signs a contract with the winning unit. (ix) The bidding unit and the successful bidder sign the contract.
