The rural habitat management referred to in these regulations refers to the activities of regulating, managing and supervising the rural habitat environment with the main contents of rural planning and construction management, village appearance management, living garbage management, toilet renovation and fecal pollution management, living sewage management, agricultural waste management and civilized countryside style construction. Article 3 The governance of rural human settlements adheres to the principles of government guidance, village (neighborhood) democracy, multiple inputs, local conditions, and equal emphasis on construction and management. Article 4 the establishment of municipalities, districts and counties, townships and streets of the hierarchical responsibility of the work mechanism.
City, district and county people's governments to organize and lead the work of rural human settlements in their administrative areas. The municipal people's government shall establish a work coordination mechanism to guide the resolution of major problems in the management of rural human settlements.
Township people's governments and street offices are responsible for the specific work of rural habitat management within their jurisdiction.
The new districts and parks established by law shall be responsible for the relevant work of rural human settlements in their respective areas of responsibility. Article 5 The departments in charge of agriculture and rural areas of the people's governments of cities, districts and counties shall be responsible for the comprehensive coordination, organization and promotion, supervision and management of rural human settlements within their administrative areas.
The relevant departments of the people's governments of cities, districts and counties, such as development and reform, finance, civil affairs, natural resources, ecological environment, housing and urban-rural construction, commerce, environmental sanitation, transportation, health, culture and tourism, are responsible for the work related to the governance of rural human settlements in accordance with their respective responsibilities. Article 6 The village (resident) committee may, in accordance with the law, convene a meeting of the village (resident) people to formulate and improve village rules and regulations and residents' conventions on the environmental governance of rural human settlements, and to supervise the village (resident) people in maintaining environmental hygiene and carrying out environmental governance of human settlements. Article 7 The people's governments of cities, districts and counties shall include the funds required for the governance of rural human settlements in the financial budget at the same level.
Encourage innovative investment and financing methods, the establishment of government investment-based, social capital participation in the diversified funding mechanism. Article 8 encourages the development of scientific and applicable technology research on rural human settlements environmental governance, the promotion and application of advanced technology to improve the level of governance. Article IX local people's governments at all levels, as well as organs, organizations, enterprises and institutions should strengthen the rural human settlements environmental governance publicity and education, to enhance public awareness of participation in governance activities, and establish a good social customs.
Radio, television, newspapers and periodicals, networks and other media shall strengthen the public welfare propaganda and public opinion supervision of the governance of rural human settlements.
The competent authorities in charge of education shall incorporate the laws, regulations and knowledge related to the governance of rural human settlements, such as the reduction of domestic garbage at source, sorting and recycling, and harmless treatment, into the education of schools and kindergartens, as well as into social practice. Article 10 Local people's governments at all levels shall give commendations and rewards to units and individuals with remarkable achievements in the governance of rural human settlements in accordance with the relevant provisions of the State. Article 11 Any unit or individual has the obligation to maintain the results of rural habitat management, and has the right to persuade, stop, complain or report on behavior that harms the rural habitat.
The relevant departments shall investigate and deal with complaints and reports in a timely manner according to law. Chapter II planning and construction management Article 12 municipal, district and county people's governments in charge of agriculture and rural areas shall, in conjunction with the relevant departments to prepare the rural habitat management plan, and according to law into the national economy and social development planning, after approval, organization and implementation.
Rural habitat management planning should be compatible with the economic and social development of rural areas, in line with the territorial spatial planning, and with the ecological environment functional area planning and other special planning. Article 13 The people's governments of townships and villages organize the preparation of township planning and village planning.
Rural planning should integrate the needs of agricultural production and life and traditional cultural protection, the use of natural topography and historical and cultural resources, shaping the landscape environment rich in vernacular characteristics, reflecting the spatial elements of multi-level. Encourage conditional villages to carry out planning and design. Article 14 The departments in charge of agriculture and rural areas of the municipal, district and county people's governments shall promote the construction of informationization and digitalization of rural human settlements, and carry out, in conjunction with the relevant departments, the intelligent management of such elements as environmental indicators, facilities and equipment, production and operation, hygiene and sanitation, convenient services, social security, and the movement of people. Article 15 The people's governments of the districts and counties shall strengthen the integration of governmental input resources, to avoid duplication and unrealistic infrastructure construction.
Promoting multi-village *** build *** enjoy public **** service facilities, saving intensive use of investment and land resources. Article 16 The people's governments of cities, districts and counties shall strengthen the construction of the following infrastructures:
(1) drinking water, electricity, gas, communication and drainage facilities;
(2) public **** toilets and facilities for treating domestic garbage, construction garbage, bulky garbage, and sewage;
(3) roads, bridges and culverts, water conservancy, green areas, and gardening facilities;
(4) marketplaces, cultural plazas, cultural squares, and gardening facilities; and ) marketplace, cultural plaza, public **** parking lot (space) facilities;
(v) straw, agricultural film, manure, agricultural packaging, sick and dead animals and poultry recycling facilities;
(vi) other infrastructures related to rural human settlements management.
Township people's governments and street offices should combine the actual formulation of infrastructure construction needs, and complete the construction of related projects. Encourage villages (residents) to self-finance their own infrastructure construction projects.
Infrastructure construction projects should be consistent with national and provincial standards and technical specifications. Municipal, district and county people's government departments should fulfill the approval, management and supervision responsibilities according to law.
