Living garbage as referred to in these regulations refers to solid waste generated in daily life or activities providing services for daily life, as well as solid waste regarded as living garbage as stipulated by laws and administrative regulations. Article 3 The management of rural household garbage adheres to the principles of government-led, public participation, local conditions, focusing on long-term effects, comprehensive utilization and integrated promotion. Article 4 The people's governments at or above the county level shall strengthen the organization and leadership of the management of rural living garbage, incorporate the management of rural living garbage into the national economic and social development planning, determine the objectives of rural living garbage management, coordinate the planning and layout of facilities, formulate policies and measures to promote the reduction, resourcefulness and harmlessness of rural living garbage, and increase the investment of funds required for the management of rural living garbage.
The people's governments at the county level are responsible for the management of rural household garbage.
The people's governments of townships cooperate in the daily management of rural living garbage under their jurisdiction. Article 5 The administrative department of housing and urban-rural construction of the provincial people's government and the administrative department of environmental sanitation of the people's governments of cities (states) and counties (cities and districts) shall be responsible for the supervision and management of the cleaning, collection, transportation and disposal of rural living garbage. Article 6 The administrative department of environmental protection of the people's governments at or above the county level is responsible for the unified supervision and management of the prevention and control of pollution of the environment by rural domestic garbage.
The relevant administrative departments of the people's governments at or above the county level in charge of development and reform, finance, agriculture and animal husbandry, commerce, health and family planning, land and resources, transportation, water conservancy, forestry, tourism and other relevant administrative departments in accordance with their respective responsibilities to do a good job in the management of rural living garbage. Article 7 The village people's committee, through the formulation of village rules and regulations and the signing of responsibility, carries out the work of cleaning, categorizing and placing of rural household garbage, and urges the units and individuals in the village to do a good job of keeping the village clean. Article 8 The people's governments at all levels shall strengthen the publicity and education of rural household garbage management, advocate green, civilized and healthy lifestyles, cultivate exemplary models, and commend and reward civilized farmers, hygienic families, beautiful courtyards, and beautiful countryside demonstration villages.
Radio and television, newspapers and magazines, the Internet and other news media, should strengthen the public welfare propaganda of rural household waste management.
The villagers' committees shall make use of village broadcasting rooms, cultural activity rooms, moral lecture halls, blackboard newspapers, village affairs bulletin boards and other carriers to publicize the knowledge of garbage classification, environmental protection obligations, and advanced and typical deeds in a form that is pleasing to the villagers.
Rural primary and secondary schools, kindergartens should be based on the characteristics of minors, regularly carry out general knowledge of hygiene, waste reduction and classification of knowledge, education and practical activities. Chapter II Planning and Facilities Construction Chapter II Planning and Facilities Construction Article 9 The people's governments at or above the county level shall prepare a special plan or implementation program for the management of rural living garbage in the administrative area, and connect with the improvement of rural habitat and rural environment improvement planning.
Preparation of planning or implementation programs, shall seek the views of relevant departments, deputies to the National People's Congress, members of the Chinese People's Political Consultative Conference, experts and scholars and the public. Article 10 city (state), county (city, district) people's government is responsible for the administrative area of rural living garbage collection, transportation, treatment facilities and equipment and premises.
No unit or individual shall damage, unauthorized demolition, deactivation and encroachment, relocation, alteration of rural living garbage collection, transportation, treatment facilities and equipment and places. Article 11 The siting of rural domestic waste disposal sites shall be in accordance with the overall planning of townships and villages, professional planning for environmental sanitation, as well as the provisions and requirements of the "Pollution Control Standards for Domestic Waste Landfills" and "Pollution Control Standards for Domestic Waste Incineration," etc., and shall be co-ordinated and laid out by the people's governments of the municipalities (states) and counties (municipalities and districts), and shall not be situated in the following areas:
(1) near the water sources;
(ii) basic farmland protection zones, nature reserves, cultural relics protection zones, scenic spots;
(iii) other areas in need of special protection. Chapter III Cleaning, Classification and Disposal Article 12 A responsible person system shall be implemented for the cleaning of rural domestic garbage.
The villagers or users of the garbage in front of and behind the houses of villagers' residences shall be the responsible persons.
The villagers' residential district garbage, the implementation of property enterprise management, property service enterprises as the responsible person; without the implementation of property enterprise management, the villagers' committee as the responsible person.
The villagers' committee is responsible for the garbage in public **** areas and public **** buildings such as roads, rivers, waterways, cultural squares and so on in the villages.
The garbage from the offices of institutions, enterprises, social groups and other organizations, their units are the responsible persons.
The operator or management unit is the responsible person for the garbage in the business places such as the marketplace, exhibition and fair, malls and stores, and catering services.
The land operator is the responsible person for the garbage in the field.
If the responsible person for garbage management cannot be specified, the villagers' committee or township people's government shall appoint the responsible person.
