Regulations of Jiangxi Province on the Development of Traditional Chinese Medicine (revised in 2002)

Chapter I General Provisions Article 1 In order to inherit and develop the cause of traditional Chinese medicine, give full play to the role of traditional Chinese medicine in medical and health undertakings, and safeguard citizens' health, these Regulations are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this province. Article 2. Who is engaged in Chinese medicine medical treatment, prevention, rehabilitation, health care, Chinese medicine education, scientific research, academic exchanges and cooperation, supervision and management of Chinese medicine and other activities within the administrative region of this province, must abide by these regulations.

Chinese medicine as mentioned in these Regulations includes integrated traditional Chinese and western medicine and ethnic medicine. Article 3 The development of traditional Chinese medicine should inherit and carry forward the tradition of traditional Chinese medicine, innovate with modern science and technology, promote the development of theory and practice of traditional Chinese medicine, improve the academic level of traditional Chinese medicine and realize the modernization of traditional Chinese medicine. Article 4 The people's governments at or above the county level shall strengthen their leadership over the work of traditional Chinese medicine, adhere to the principle of paying equal attention to both traditional Chinese medicine and western medicine, implement the policy of protecting, supporting and developing traditional Chinese medicine, and encourage various ownership economies to participate in the development of traditional Chinese medicine. The health administrative department of the fifth provincial people's government is in charge of the work of traditional Chinese medicine in the province, and the provincial administration of traditional Chinese medicine is specifically responsible for the management of traditional Chinese medicine in the province.

The health administrative department of the people's government at or above the county level is the competent department of traditional Chinese medicine work within its administrative area.

The planning, construction, finance, personnel, education, culture, science and technology, labor and social security, drug supervision, press and publication, industry and commerce, taxation and other administrative departments or organs of the people's governments at or above the county level shall, in accordance with the division of responsibilities, cooperate with the health administrative departments to do a good job in the development of traditional Chinese medicine. Article 6 The people's government at or above the county level or the administrative department of health shall commend or reward the units and individuals that have made one of the following contributions to the development of Chinese medicine:

(a) outstanding achievements in the implementation of relevant laws and regulations on traditional Chinese medicine;

(2) Having made remarkable achievements in carrying out medical treatment, education and scientific research of traditional Chinese medicine;

(3) Donating or exploring, sorting out, researching and utilizing valuable Chinese medicine literature and secret recipes, prescriptions and diagnosis and treatment techniques with unique curative effects;

(four) Chinese medicine experts who have made outstanding achievements in teaching;

(five) Chinese medicine personnel have worked in township (town) hospitals for a long time and made outstanding achievements;

(6) Donations to support the development of traditional Chinese medicine;

(seven) other outstanding contributions in the development of traditional Chinese medicine. Chapter II Medical Institutions and Employees Article 7 The people's governments at or above the county level shall take measures to run well medical institutions of traditional Chinese medicine. The health administrative department of the people's government at or above the county level shall adjust and improve the layout of Chinese medicine medical institutions according to the regional health planning and the medical needs of the Chinese medicine market.

Chinese medical institutions and other medical institutions shall undertake the tasks of social medical treatment, prevention, health care, rehabilitation and community health services. Article 8 A unit or individual that runs a medical institution of traditional Chinese medicine shall, in accordance with the relevant provisions of the State Council's Regulations on the Administration of Medical Institutions, be examined and approved by the health administrative department of the people's government at or above the county level, and go through the registration procedures before practicing.

Medical institutions of traditional Chinese medicine shall change their names, places, diagnosis and treatment subjects, etc. , and go through the change registration with the original registration authority according to law.

Without the approval of the health administrative department of the people's government at the next higher level, non-profit medical institutions of traditional Chinese medicine shall not be revoked, auctioned or merged. Article 9 The health administrative department of the people's government at or above the county level shall entrust an appraisal organization to grade the medical institutions of traditional Chinese medicine in accordance with the provisions of the state, so that their construction area, business premises, medical equipment, management level and technical quality indicators can gradually reach the standards stipulated by the state and the province. Article 10 Medical institutions of traditional Chinese medicine shall implement the president responsibility system. Medical institutions of traditional Chinese medicine shall enjoy the management autonomy in personnel employment, department setting and income distribution according to law.

Medical institutions of traditional Chinese medicine shall control the entry of non-health technicians, and the proportion of health technicians shall not be lower than the standards set by the state. Article 11 Medical institutions of traditional Chinese medicine should adhere to the direction of running schools with traditional Chinese medicine as the main body, give full play to the characteristics and advantages of traditional Chinese medicine, strengthen the construction of characteristic specialties, introduce and apply modern advanced science and technology, improve comprehensive service functions, improve academic level and medical service quality, and enhance market competitiveness.

Encourage Chinese medical institutions to carry out special services to meet the multi-level Chinese medical needs. Article 12 Medical institutions of traditional Chinese medicine shall standardize the processing and processing of Chinese herbal medicines and the production of Chinese herbal preparations according to law, and ensure the quality of Chinese herbal pieces and preparations.

Medical institutions of traditional Chinese medicine should standardize the channels of drug intake and implement a quality acceptance system for purchased drugs to ensure the safety and effectiveness of patients' medication.

The use of counterfeit and inferior drugs is prohibited. Thirteenth western medical institutions above the second level should set up traditional Chinese medicine or integrated traditional Chinese and western medicine; Township (town) health centers should be equipped with the number of Chinese medicine personnel prescribed by the state, and set up Chinese medicine departments and Chinese pharmacy; Rural doctors should master the basic knowledge of traditional Chinese medicine and the diagnosis and treatment techniques of common diseases and frequently-occurring diseases. Fourteenth Chinese medicine practitioners should be in accordance with the provisions of the "People's Republic of China (PRC) Medical Practitioners Law", take the examination and register, and obtain the corresponding qualifications before engaging in medical practice. Fifteenth medical institutions of traditional Chinese medicine should strengthen the professional training and professional ethics education for Chinese medicine personnel, strictly implement the relevant rules and regulations and operating procedures, and prevent and eliminate medical accidents.
