Notice of the National Health Commission on Issuing Standards for the Establishment of Childcare Institutions (Trial) and Regulations for the Management of Childcare Institutions (Trial) Guowei Population Development [2019] No. 58 to all provinces, autonomous regions, municipalities directly under the Central Government and Xinjiang Production and Construction Corps Health Commission: In order to strengthen the professionalization and standardization of child care institutions, in accordance with the requirements of the "Guiding Opinions of the General Office of the State Council on Promoting the Development of Care Services for Infants and Young Children Under 3 Years Old" (Guobanfa [2019] No. 15), our committee organized The "Standards for the Establishment of Childcare Institutions (Trial)" and the "Management Standards for Childcare Institutions (Trial)" have been formulated (can be downloaded from the website of the National Health Commission). It is now issued to you, please comply with it. The Standards for the Establishment of Child Care Institutions issued by the National Health Commission on October 8, 2019 (Trial) Chapter 1 General Provisions Article 1 is to establish professional and standardized child care institutions. According to the "Law of the People's Republic of China on the Protection of Minors" This standard is formulated by other laws and regulations as well as the "Guiding Opinions of the General Office of the State Council on Promoting the Development of Care Services for Infants and Young Children Under 3 Years Old". Article 2 Adhere to the principles of policy guidance, priority for universal benefit, safety and health, scientific standards, territorial management, and classified guidance, fully mobilize the enthusiasm of social forces, and vigorously develop childcare services. Article 3 This standard applies to institutions that have been registered by relevant departments and filed with the health department to provide full-day care, half-day care, hourly care, temporary care and other childcare services for infants and young children under 3 years old. Chapter 2 Establishment Requirements Article 4 The establishment of childcare institutions shall comprehensively consider the development characteristics of urban and rural areas, and make scientific planning and rational layout based on the level of economic and social development, work foundation and public needs. Article 5 Newly built residential areas shall plan and build childcare institutions commensurate with the size of the permanent population. Old cities and established residential areas should adopt various methods to improve childcare institutions to meet the needs of residents. Article 6 The construction of urban childcare institutions must fully consider the care service needs of infants and young children who migrate to cities as workers. Article 7 In the construction of comprehensive service facilities in rural communities, the construction of childcare institutions should be considered as an overall consideration. Article 8 Employers are supported to provide welfare childcare services for employees in the workplace, either individually or jointly with other units, and can be opened to nearby residents if conditions permit. Article 9 encourages the construction and improvement of childcare institutions in industrial cluster areas and employers with dense employment populations through market-oriented methods, using various forms such as public and private operations, and private assistance. Article 10: Give full play to the infant care service functions of public service facilities in urban and rural communities, and strengthen the functional connection between community childcare institutions and community service centers (stations) and community health, culture, sports and other facilities. Chapter 3 Venue and Facilities Article 11 Childcare institutions shall have their own venues or venues with a lease period of not less than 3 years. Article 12 The site of a daycare institution shall be located in a construction land with good natural conditions, convenient transportation, and compliance with health and environmental protection requirements. It shall be located away from buildings, facilities and pollution sources that are harmful to the growth of infants and young children, and shall meet earthquake resistance, fire prevention, evacuation and other requirements. Article 13 The buildings of childcare institutions shall comply with relevant national standards and industry standards for engineering construction, and shall have living rooms that meet the standard requirements, and shall set up service management rooms and supply rooms as needed. Article 14 The house decoration, facilities and equipment, decorative materials, etc. of childcare institutions shall comply with relevant national safety and quality standards and environmental protection standards, and shall be inspected and maintained regularly. Article 15 Childcare institutions shall be equipped with furniture, appliances, toys, books, game materials, etc. that are in line with the age characteristics of infants and young children, and shall comply with relevant national safety, quality and environmental standards. Article 16 Childcare institutions shall have outdoor activity venues, be equipped with appropriate game facilities, and have corresponding safety protection facilities. On the premise of ensuring safety, nearby public venues and facilities can be used. Article 17 Childcare institutions shall install safety protection facilities and equipment that meet standard requirements. Chapter 4 Staff Scale Article 18 Childcare institutions shall reasonably determine the scale of infants and young children admitted based on site conditions, and allocate staff for comprehensive management, childcare, health care, safety and security.
The person in charge of a childcare institution shall be responsible for all-round work, shall have a college degree or above, have more than three years of experience in child care education, health and other related management work, and shall have passed the job training for the person in charge of the childcare institution. Childcare staff are mainly responsible for taking care of the daily life of infants and young children, arranging games and activities, promoting the physical and mental health of infants and young children, and developing good behaviors and habits. Childcare personnel should have infant and child care experience or relevant professional background, and have received relevant training in infant and child care and mental health knowledge training. Health care personnel should be qualified through health care professional knowledge training organized by maternal and child health care institutions. Security personnel should obtain a "Security Guard Certificate" issued by the public security organ and be dispatched by a security company that has obtained a "Security Service License" from the public security organ. Article 19 Child care institutions generally set up nursery classes (6-12 months, less than 10 people), small child care classes (12-24 months, less than 15 people), and large child care classes (24-36 months, less than 20 people). Three types of classes. Infants and young children over 18 months old can be placed in mixed classes, with no more than 18 people in each class. Each class living unit should be used independently. Article 20: Reasonable allocation of childcare personnel, and the ratio to infants and young children should be no less than the following standards: 1:3 for infant care classes, 1:5 for small nursery classes, and 1:7 for senior nursery classes. Article 21 Health care personnel and cooking personnel shall be assigned in accordance with the relevant nursery health care regulations. Article 22 Independent childcare institutions shall have at least one security guard on duty. Chapter 5 Supplementary Provisions Article 23 The health administrative departments of each province, autonomous region, and municipality directly under the Central Government may formulate specific implementation measures based on this standard. Article 24 This standard shall come into effect from the date of promulgation. Management Standards for Childcare Institutions (Trial) Chapter 1 General Provisions Article 1 is to strengthen the management of childcare institutions. In accordance with the "Law of the People's Republic of China on the Protection of Minors" and other laws and regulations and the "General Office of the State Council's Notice on Promoting the Promotion of Children under the Age of 3" Guiding Opinions on the Development of Infant and Child Care Services", formulating this specification. Article 2: Adhere to the principle of giving priority to children, respect the growth characteristics and patterns of infants and young children, protect infants and young children to the greatest extent, and ensure the safety and health of infants and young children. Article 3 This specification applies to institutions that have been registered by relevant departments and filed with the health department to provide full-day care, half-day care, hourly care, temporary care and other childcare services for infants and young children under 3 years old. Chapter 2 Filing Management Article 4 After registering, a child care institution shall register with the health department at or above the county level where the institution is located, and submit a "Child Care Institution Hygiene Evaluation Report" that is evaluated as "qualified", a fire safety inspection certificate, and the venue. Certificates, staff qualification certificates and other materials, and fill in the registration form (see attachment 1) and commitment letter (see attachment 2). Those who provide catering services must submit a Food Business License. Article 5 The health department shall provide a registration receipt (see Attachment 3) and a notice of the basic conditions of the childcare institution (see Attachment 4) to the childcare institution that applies for registration. Article 6 If a childcare institution changes the registration matters, it shall go through the change registration process with the original registration department. Article 7 If a childcare institution terminates its services, it shall properly place the infants and children in care and the staff, and go through the registration and cancellation procedures. Article 8 The health department shall disclose relevant policies and regulations on childcare services, registration requirements for childcare institutions, and relevant information about childcare institutions on the official website, and accept public inquiries and supervision. Chapter 3 Collection and Management Article 9 Parents or guardians of infants and young children (hereinafter collectively referred to as guardians of infants and young children) shall take the initiative to apply for admission to the child care institution and submit the true identity certification materials of the infant and child and their guardian. Article 10 Childcare institutions shall sign a childcare service agreement with the guardians of infants and young children, clarifying the responsibilities, rights and obligations, service items, charging standards, dispute resolution methods, etc. of both parties. Article 11 Before entering a nursery, infants and young children must complete age-appropriate vaccinations and pass the health examination by a medical and health institution before entering the nursery; if they leave the institution for more than 3 months, they must undergo a new health examination when they return. Article 12 Childcare institutions shall establish a management system for information on infants and young children, collect and update information in a timely manner, and submit it to the filing department on a regular basis. Article 13 Childcare institutions should establish a system for contacting parents, hold regular parent meetings, receive visits and consultations, and help parents understand the content and methods of childcare and care.
Child care institutions should establish a parent committee and listen to the opinions and suggestions of the parent committee on important matters related to infants and young children. Child care institutions should establish a parent open day system. Article 14 Childcare institutions shall strengthen contact and cooperation with the community, publicize scientific parenting knowledge to the community, carry out various forms of service activities, and promote the early development of infants and young children. Article 15 Childcare institutions shall establish an information disclosure system, regularly publicize charging items and standards, child care, dietary nutrition, health care, safety and security, etc., and accept supervision. Chapter 4 Childcare Management Article 16 Childcare institutions should arrange the lives of infants and young children in a scientific and reasonable manner, and provide services such as eating, drinking, breastfeeding, toileting, washing, cleaning, sleeping, dressing and undressing, and game activities. Article 17 Childcare institutions should adapt to feeding requirements, scientifically formulate recipes, and ensure a balanced diet for infants and young children. If there are special feeding needs, the guardian of infants and young children should provide written explanations. Article 18 Daycare institutions shall ensure that infants and young children have no less than 2 hours of outdoor activities every day, and may make adjustments as appropriate in cold or hot seasons or special weather conditions. Article 19 Childcare institutions shall use games as the main form of activities to promote the all-round development of infants and young children in aspects such as physical development, movement, language, cognition, emotion and sociality. Article 20 Game activities should pay attention to the emotional changes of infants and young children, focus on face-to-face and one-on-one communication and interaction with infants and young children, alternate between dynamic and static, and reasonably match a variety of game types. Article 21 Childcare institutions shall provide appropriate stimulation, enrich infants and young children’s direct experience, support infants and young children’s active exploration, operational experience, interactive communication and expression, give play to infants and young children’s autonomy, and protect infants and young children’s curiosity. Article 22 Childcare institutions shall establish a daily record and feedback system for care services, and regularly communicate with infant and toddler guardians about the development of infants and toddlers. Chapter 5 Health Management Article 23 Childcare institutions shall, in accordance with relevant nursery health and health regulations, improve relevant systems, effectively manage the health of infants, young children and staff, and ensure indoor and outdoor environmental sanitation. Article 24 Child care institutions shall insist on morning and afternoon inspections and full-day health observation. If any physical, mental or behavioral abnormalities of infants and young children are found, they shall promptly notify the guardians of infants and young children. Article 25 If a childcare institution discovers that an infant or young child has suffered or is suspected of suffering domestic violence, it shall promptly report the case to the public security organ in accordance with the law. Article 26 Infants and young children should receive treatment in the hospital or be cared for at home during their illness. Article 27 Childcare institutions shall establish systems for sanitation and disinfection, isolation of sick children, and infectious disease prevention and management systems, and do a good job in disease prevention and control and infant and child health management. Article 28 Before taking up their posts, staff of childcare institutions shall undergo a health examination by a medical and health institution and must pass the examination before taking up their posts. Childcare institutions should organize on-the-job staff to conduct a health examination once a year. If an on-the-job worker suffers from an infectious disease, he or she should immediately leave the post for treatment; after recovery, he or she must present a medical record and a health certificate issued by a medical and health institution before returning to work. Chapter 6 Safety Management Article 29 Childcare institutions shall implement the main responsibilities of safety management, establish and improve safety protection measures and inspection systems, and equip necessary security personnel and physical and technical defense facilities. Article 30 Daycare institutions shall establish a complete system for picking up and dropping off infants and young children, and infants and young children shall be picked up and dropped off by their guardians or adults entrusted by them. Article 31 Childcare institutions shall formulate emergency plans for major natural disasters, infectious diseases, food poisoning, stampedes, fires, violence and other emergencies, and regularly conduct safety education and emergency response capability training for staff. Child care institutions should clarify the full-time and part-time fire safety management personnel and their management responsibilities, strengthen the maintenance and management of fire protection facilities, and ensure the safety of fire, electricity and gas. Staff of daycare institutions should master basic first aid skills and basic methods of prevention, avoidance, escape, and self-rescue. In emergencies, they must give priority to ensuring the safety of infants and young children. Article 32 Childcare institutions shall establish monitoring systems for care services, safety and security, etc. The monitoring and alarm system ensures 24-hour security, and the living and activity areas of infants and young children should be fully covered. Surveillance video data shall be retained for no less than 90 days.
Chapter 7 Personnel Management Article 33 The staff of childcare institutions shall have full capacity for civil conduct and good professional ethics, love infants and young children, be physically and mentally healthy, have no record of child abuse, no criminal record, and comply with relevant national and local regulations. Required Qualifications. Article 34 Childcare institutions shall establish pre-job training and regular training systems for staff, and continuously improve the professional abilities, professional ethics and mental health levels of staff through centralized training, online learning and other methods. Article 35: Childcare institutions shall strengthen legal education for staff and enhance legal awareness. There is zero tolerance for child abuse and other behaviors. Once discovered, the relevant responsible persons and responsible persons will be held accountable in strict accordance with relevant laws, regulations and regulations. Article 36 Childcare institutions shall sign labor contracts with staff in accordance with the law to protect the legitimate rights and interests of staff. Chapter 8 Supervision and Management Article 37 Childcare institutions shall strengthen party organization building and actively support the activities of trade unions, the Communist Youth League, Women’s Federation and other organizations. Childcare institutions should establish a trade union organization or employee representative conference system and strengthen democratic management and supervision in accordance with the law. Article 38 Childcare institutions shall formulate annual work plans, report their work to the health department at the end of each year, and report at any time when necessary. Article 39 Maternal and child health care, disease prevention and control, health supervision and other institutions at all levels shall strengthen business guidance, consulting services and supervision and law enforcement for the health care work of childcare institutions in accordance with their duties. Article 40: Establish an information disclosure system and a quality assessment system for childcare institutions, implement dynamic management, and strengthen social supervision.
