Xiamen Haicang Taiwan Investment Zone Interim Management Measures

Chapter I General Provisions Article I In order to further expand the opening up, accelerate the pace of development and construction of the Xiamen Haicang Taiwan Investment Zone, according to the State Council and the relevant laws and regulations, the formulation of these measures. Article 5 The following production projects shall not be established in the investment zones:

those prohibited by Chinese policies;

those with outdated technology or obsolete equipment;

those polluting the environment without practical measures to control it;

those consuming a large amount of water and with a low value-added;

those that do not conform to the industrial planning or industrial policies. Article 6 Domestic and foreign enterprises in the investment zone, including overseas Chinese, Hong Kong, Macao, Taiwan and other economic organizations and individuals must comply with the Constitution of the People's Republic of China, laws, administrative regulations, local laws and regulations as well as the investment zone in accordance with the provisional management measures formulated by the regulations. Article XIII of the Management Committee is responsible for approving the introduction of various types of investment projects in the investment zone as well as the establishment, change or withdrawal of various types of enterprises and institutions.

The Management Committee enjoys the approval authority of Xiamen Municipal Government for foreign investment projects and domestic investment projects. If it is necessary to report to the higher authorities for approval outside the scope of authority, it shall be submitted by the municipal government departments.

Article 19 The Management Committee entrusts its subordinate economic entities to be responsible for specific development matters in the investment zone. Article 20 of the investment zone staff to go abroad on official business, to Hong Kong, Macao and Taiwan by the Management Committee in accordance with national regulations for approval by the municipal government for the relevant procedures. Article 22 The "three-funded" enterprises in the investment zone, foreign investors as investment imported for the production and management of the enterprise's equipment, building materials; for the production of export products imported raw materials, raw devices, parts, packaging; for the production of a reasonable number of imported for their own use of transportation, office supplies; investment in foreign and foreign technical staff of a reasonable number of settled articles.
