Penalties for expired food are as follows:
1. For the food sold beyond the shelf life, the relevant competent departments shall, according to their respective responsibilities, confiscate the illegal income, the food illegally produced and sold, and the tools, equipment, raw materials and other items used for illegal production and sales;
2, the illegal production and operation of food value is less than ten thousand yuan, a fine of fifty thousand yuan and one hundred thousand yuan;
3, the value of more than ten thousand yuan, ten times more than twenty times the value of the fine;
4. If the circumstances are serious, the license shall be revoked;
5. Need to compensate consumers:
(1) can claim to return or exchange goods and claim compensation for the cost of purchasing expired food;
(2) You can claim compensation ten times the price of expired food;
(3) If personal injury is caused to consumers, you can claim personal injury compensation from the merchants;
(4) If it causes general personal injury to consumers, it may claim compensation for the corresponding medical expenses, nursing expenses during treatment, reduced income due to missed work and other expenses;
(5) Those who cause disability may claim compensation for self-help furniture, living allowance, disability compensation and the living expenses necessary for the people they support.
To sum up, in view of the characteristics of large quantities and batches of food in shopping malls and supermarkets, it is required that all shopping malls and supermarkets must designate the person in charge of each food counter to check whether the food on the shelves is expired or deteriorated every day, and clean up the food with a shelf life of less than 10 days and put it into the sales area near the expired food. Other food business operators regularly conduct self-inspection on the shelf life of food according to their own conditions. All food business units shall conduct daily inspection on the food that is about to expire, and establish inspection ledgers to remove expired food in time.
