Construction units should be in accordance with the provisions of this list, respectively, to organize the preparation of the environmental impact report of construction projects, environmental impact report form or fill in the environmental impact registration form. Article 3 The environmentally sensitive areas referred to in this list refer to the various types of protected areas at all levels established by law and the areas that are particularly sensitive to the environmental impacts of construction projects, including the following areas within or outside the red line of ecological protection:
(1) nature reserves, scenic spots, sites of the world's cultural and natural heritage, marine special protection zones, and drinking water source protection zones;
(2) basic farmland protection areas, basic farmland protection zones, marine special protection zones, and drinking water source protection zones; and (ii) basic farmland protection areas, basic grasslands, forest parks, geological parks, important wetlands, natural forests, important habitats for wild animals, key protection of wild plant breeding grounds, natural spawning grounds, baiting grounds, wintering grounds and migratory corridors for important aquatic organisms, natural fishing grounds, key soil erosion prevention and control zones, sandy land closed protection zones, and closed and semi-closed sea areas;
(iii) areas for the purpose of Residence, health care, culture and education, scientific research, administrative offices and other major functions of the area, as well as cultural relics protection units. Article 4 The construction unit shall determine the environmental impact assessment category of construction projects in strict accordance with this list, and shall not change the environmental impact assessment category without authorization.
Environmental impact assessment documents should be on the construction project on the impact of environmentally sensitive areas for key analysis. Article 8 This Directory shall come into force on September 1, 2017, and the former Classified Management Directory for Environmental Impact Assessment of Construction Projects (Decree No. 33 of the Ministry of Environmental Protection) published on April 9, 2015 shall be repealed at the same time.
