Legal Basis: Article 225 of the Criminal Law of the People's Republic of China
The crime of illegal business operation violates the state regulations, and one of the following illegal business operation, disrupts the market order, and the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than five years, or detention, and shall be punished by or be sentenced to a fine of not less than one and not more than five times of the illegal proceeds; the circumstances are particularly serious, and shall be sentenced to a fine of not less than five years and not more than five times of the illegal proceeds; the circumstances are particularly serious. Particularly serious, shall be sentenced to fixed-term imprisonment of five years or more, and shall also be fined not less than one and not more than five times the illegal income or confiscate property:
(1) unauthorized operation of exclusive, monopoly goods or other items restricted from sale and purchase by laws and administrative regulations;
(2) sale and purchase of import and export licenses, certificates of import and export origin, as well as other business licenses or approval documents prescribed by law and administrative regulations;
(3) sale and purchase of import and export licenses, certificates of import and export origin and other business licenses or approval documents;
(c) illegal operation of securities, futures, insurance business without the approval of the relevant state authorities, or illegally engaged in the funds payment and settlement business;
(d) other serious disruption of the market order of illegal business practices.
