Article 4 Urban domestic garbage is divided into recyclable garbage, perishable garbage, hazardous waste garbage and other garbage, and the classification standards are as follows:
(1) Recyclable materials refer to domestic garbage suitable for recycling and resource utilization. It mainly includes: unpolluted waste paper, waste plastics, waste metal, waste packaging materials, waste textiles, waste electrical and electronic products, waste glass, aluminum-plastic composite packaging of waste paper, etc.
(2) Perishable garbage refers to the daily kitchen waste of residents and perishable garbage generated by farmers' markets and agricultural products wholesale markets, mainly including: waste food, vegetable and fruit garbage, carrion, internal organs of livestock and poultry products, etc.
(3) Hazardous wastes refer to wastes that directly or potentially endanger human health and the natural environment. Mainly includes: waste batteries (cadmium nickel batteries, mercury oxide batteries, lead batteries, etc.). ), waste fluorescent tubes (fluorescent tubes, energy-saving lamps, etc. ), waste thermometers, waste sphygmomanometers, waste drugs and their packaging, waste paints, solvents and their packaging, waste pesticides, disinfectants and their packaging, waste films, waste photographic paper, etc.
(4) Other garbage refers to the remaining garbage except recyclable, perishable and hazardous wastes. Article 5 The municipal and district (city) and county people's governments shall strengthen the organization and leadership over the classification of municipal solid waste, incorporate it into the national economic and social development plan, establish a capital investment and guarantee mechanism, and coordinate and solve major problems in the classification management of municipal solid waste within their respective administrative areas. The agency of the municipal government with administrative functions is responsible for the organization and leadership of the classification of municipal solid waste within the management area according to the authorization. The Town People's Government and the sub-district offices are responsible for the specific implementation of the classification of municipal solid waste, and organize units and individuals within their respective jurisdictions to carry out the classification of municipal solid waste. Neighborhood (village) committees shall cooperate with the related work of municipal solid waste classification. Sixth city and district (city) county environmental sanitation administrative departments responsible for the administrative area of urban domestic waste classification management.
The relevant departments of the municipal and district (city) county governments shall, according to their respective responsibilities, be responsible for the related work of classified management of municipal solid waste. Seventh municipal solid waste classification follows the principle of government leading, public participation, territorial responsibility and coordinated promotion. Article 8 The municipal, district (city) and county people's governments and their relevant departments shall take various forms to strengthen the publicity of laws, regulations and knowledge on municipal solid waste classification and raise the public's awareness of garbage classification. Radio, television, newspapers, Internet and other media, as well as outdoor and indoor (in-car) advertisements, shall publicize the classification of municipal solid waste for public welfare in accordance with relevant regulations.
Managers of public places such as airports, stations, docks, subways, shopping malls, restaurants, parks, tourist attractions, etc. shall conduct classified publicity on municipal solid waste.
Party and government organs, military units, enterprises and institutions, social organizations, etc. Publicity and education on the classification of municipal solid waste should be carried out in this unit.
Preschool education institutions, primary and secondary schools shall, in accordance with the arrangement of the administrative department of education, incorporate the knowledge of municipal solid waste classification into the teaching content and social practice. Ninth city and district (city) county people's government shall, in accordance with the relevant provisions, commend and reward the units and individuals that have made outstanding contributions in the classification of municipal solid waste. Chapter II Planning and Facilities Management Article 10 The municipal, district (city) and county environmental sanitation administrative department shall, jointly with relevant departments, prepare a special plan for the classification of municipal solid waste in their respective administrative areas, which shall be implemented after being approved by the people's government at the same level. Article 11 The land for facilities for classified collection and disposal of municipal solid waste shall be included in the scope of protection of urban yellow line, and no unit or individual may occupy or change its use without authorization. Twelfth municipal environmental sanitation administrative departments shall, jointly with relevant departments, formulate the construction standards for supporting urban domestic waste sorting facilities for construction projects. The competent department of urban and rural planning shall incorporate the relevant contents in the construction standards for supporting construction projects of municipal solid waste sorting facilities into the planning and setting requirements for supporting public service facilities of construction projects. Thirteenth units engaged in the development of new areas, the transformation of old areas and the development and construction of residential quarters, as well as the managers of public facilities and places such as transportation, culture, sports, entertainment, leisure, sightseeing, commerce and trade, should support the construction of municipal solid waste sorting facilities according to law. Supporting the construction of municipal solid waste sorting facilities should be designed, constructed, accepted and delivered at the same time with the main project of the construction project.
After the completion of supporting municipal solid waste sorting facilities, the construction unit shall organize the completion acceptance according to law; Without acceptance or unqualified acceptance, it shall not be delivered for use. Article 14 The municipal administrative department of environmental sanitation shall formulate the norms for setting up the municipal solid waste sorting facilities.
The setting of municipal solid waste sorting facilities shall meet the requirements of the specification, and the existing facilities shall be transformed if they do not meet the requirements. Fifteenth municipal solid waste sorting facilities shall be maintained by their managers, users or management and maintenance units of municipal solid waste sorting facilities in accordance with environmental hygiene standards to ensure that the facilities are clean and in good condition.
It is forbidden to occupy, damage, shut down, leave idle, dismantle the municipal solid waste sorting facilities or change the nature of their use.
