1. First apply to the local labor department for work-related injury identification, which is the premise of all problems. If you don't apply for work-related injury identification, you can't get compensation through work-related injuries. If the unit does not apply, the individual employee must apply within one year from the date of injury; 2. According to the provisions of Article 18 of the Regulations on Work-related Injury Insurance, the following materials shall be submitted to apply for work-related injury identification: (1) an application form for work-related injury identification; (two) the existence of labor relations with the employer (including factual labor relations); (3) Medical diagnosis certificate or occupational disease diagnosis certificate (or occupational disease diagnosis certificate). The application form for ascertainment of a work-related injury shall include basic information such as the time, place and cause of the accident and the degree of injury of the employees. If the materials provided by the applicant for work-related injury identification are incomplete, the social insurance administrative department shall inform the applicant in writing of all the materials that need to be supplemented at one time. The administrative department of social insurance shall accept the corrected materials after the applicant has been informed in writing. 3. According to Article 17 of the Regulations on Work-related Injury Insurance, the employer shall apply for work-related injury identification for employees within 30 days from the date of accident injury. If the unit fails to apply, the injured employee shall apply to the labor department where the unit is located for work-related injury identification within 1 year from the date of the accident injury. 4. If a work-related injury is identified as a work-related injury, you can apply for labor ability appraisal after the injury is stable, identify the level of work-related injury, and then calculate the amount of disability compensation according to the level of disability; 5. Regarding other issues related to the identification of work-related injuries in Jilin, according to Article 8 of the Administrative Measures for the Identification of Work-related Injuries, an application form for the identification of work-related injuries should be filled in and the following materials should be submitted: (1) The original and photocopy of the decision on the identification of work-related injuries; (2) Complete medical records such as valid diagnosis certificates, copies or duplicates of inspection reports that meet the relevant provisions of medical institution medical record management; (three) the original and photocopy of the valid identity certificate such as the resident ID card or social security card of the injured employee; (four) other materials as prescribed by the labor ability appraisal committee. 6. If the employer fails to fulfill the above obligations, the injured workers can complain to the local labor inspection brigade, or directly submit an arbitration application to the labor arbitration committee to safeguard their legitimate rights and interests.
