Regulations on the Management of Radiation Accidents (2001)

Chapter I General Provisions Article 1 In order to strengthen the management of radiation accidents, timely and effective handling of radiation accidents, and to mitigate the consequences of the accidents, in accordance with the "Regulations on Radiation Protection of Radioisotopes and Radiation Devices" (hereinafter referred to as the "Regulations" and other relevant laws and regulations, the formulation of these provisions. Article 2 These provisions shall apply to the handling of radiation accidents occurring in the course of the production, sale, use, transfer, transportation and storage of radioisotopes and radiation devices within the territory of the People's Republic of China. Article 3 The handling of radiation accidents shall be carried out under a system of departmental responsibility, hierarchical management, reporting and filing. Article 4 The Ministry of Health and the Ministry of Public Security are responsible for supervising, managing and guiding the investigation and handling of radiological accidents nationwide in accordance with the scope of responsibilities stipulated in the Regulations.

Local people's governments above the municipal level are responsible for the investigation and handling of radiation accidents and the supervision and management of the work within their respective areas of responsibility.

The health administrative departments of the people's governments at the county level, the public security organs to assist the higher people's governments in the health administrative departments, public security organs to investigate and deal with radiation accidents. Article health administrative department is responsible for investigating and dealing with the human body is irradiated by an excessive dose of radiation accidents, public security organs to assist in the investigation.

The public security organs are responsible for investigating and dealing with radioisotope loss, theft of radiation accidents, health administrative departments to assist in the investigation. Article VI of radiation accidents occurring in the unit and its higher authorities, must actively cooperate with the health administrative departments, public security organs of the investigation of radiation accidents, and do a good job in the aftermath of the work. Chapter II Accident Grading and Reporting Article 7 radiation accidents according to the dose of human exposure or radiation source activity is divided into: general accidents, serious accidents and major accidents. Specific grading is shown in Attachment I and Attachment II. Mixed radiation accidents, according to the highest level of judgment.

The level of radiation accidents by the administrative organ responsible for the investigation to determine. Article VIII of the occurrence or discovery of radiation accidents units and individuals, must be reported as soon as possible to the health administrative departments, public security organs, not later than two hours. The "Radiation Accident Report Card" (see Annex I) shall be reported by the accident unit within twenty-four hours. If it causes environmental radioactive contamination, it should also be reported to the local environmental protection department at the same time.

County-level health administrative departments, public security organs after receiving the report, shall immediately report to the municipal health administrative departments and public security organs with jurisdiction over the accident. Article IX health administrative departments, public security organs in the receipt of serious accidents or major accidents reported within twenty-four hours shall be reported to the Ministry of Health, Ministry of Public Security level by level. Chapter III Emergency Treatment of Accidents Article 10 When an accident occurs in which the human body is exposed to an excessive dose of irradiation, the accident unit shall promptly arrange for the irradiated person to undergo a medical examination or receive medical treatment at a designated medical institution, and at the same time, the source of the danger to take emergency safety measures. Article 11 In the event of a workplace radioisotope contamination accident, the accident unit shall:

(1) immediately evacuate the staff concerned, blockade the scene; cut off all links that may expand the scope of contamination, and quickly carry out testing to prevent the contamination of food, livestock and poultry, and water sources;

(2) immediately take temporary isolation and emergency rescue measures for the people who may be contaminated by radionuclides or radiation damage, and take emergency safety measures at the same time in the hazardous sources. Isolation and emergency rescue measures, in the case of effective personal safety protection measures to organize personnel to completely remove the contamination and implement other medical treatment and processing measures as needed;

(c) quickly determine the type of radioisotopes, activity, the scope of contamination and the degree of contamination;

(d) contamination of the site has not yet reached a safe level, shall not be lifted before the blockade. Article XII of radioactive sources lost, stolen accident, the accident unit shall protect the scene, and seriously cooperate with the public security organs, health administrative departments for investigation and detection. Article XIII of the accident occurred in the administrative department of health after receiving the accident report, should immediately organize the relevant personnel with instruments and equipment to the scene of the accident, verification of the accident, estimate the dose of illumination, determine the type of accident level, put forward control measures and treatment programs, and promptly investigate the case. Article XIV of the accident occurred after the public security organs received the accident report, shall immediately send people to the scene of the accident, responsible for the accident scene investigation, collection of evidence, site protection and file an investigation, and take effective measures to control the expansion of the accident. Chapter IV Accident Investigation Article XV of the radiation accident, should be filed for investigation. Article XVI of the general radiation accidents, by the municipal people's government of the municipal people's health administrative departments and public security organs to organize the investigation, the provincial people's government of the health administrative departments and public security organs for supervision and guidance. Article XVII of serious and major radiation accidents, by the provincial people's government health administrative departments and public security organs to organize a case investigation, the lower level of the people's government health administrative departments and public security organs to cooperate. The Ministry of Health and the Ministry of Public Security shall carry out supervision and guidance, and shall provide administrative and technical support in accordance with the circumstances of the accident or at the request of the health administrative department and public security organ of the provincial people's government. Article XVIII of radioactive material loss, theft of accidents, by the public security organs in accordance with the law to file an investigation, the health administrative departments to provide technical support. Article 19 After the end of the investigation of radiation accidents, by the health administrative departments responsible for the investigation of health, public security organs in accordance with the relevant laws and regulations to deal with the closure of the case; constitutes a crime, shall be investigated for criminal responsibility. Within thirty days after the closure of the case, the health administrative departments responsible for investigating and handling the public security organs shall write a "report on the closure of radiation accidents" (see Annex II) reported to the Ministry of Health, the Ministry of Public Security at all levels.
